JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
SIMPLIFIED ACQUISITION PROCEDURES (SAP) FAR 13.106-1(b)
SOLICITATIONS MAY BE LIMITED TO ONE SOURCE ONLY IF THE CONTRACTING OFFICER DETERMINES THAT ONLY ONE SOURCE IS REASONABLY AVAILABLE. THIS DETERMINATION MUST BE SUPPORTED WITH FULL JUSTIFICATION FOR SOLE SOURCE FROM THE CUSTOMER. WHEN THE CUSTOMER DESCRIBES AN ITEM WITH A PURCHASE DESCRIPTION WHICH LIMITS THE AVAILABILITY TO ONE SOURCE, THE JUSTIFICATION MUST EXPLAIN WHY THE ITEM IS THE ONLY ONE THAT WILL MEET THE GOVERNMENT’S REQUIREMENT. STATEMENTS SUCH AS "ONLY KNOWN SOURCE" OR "ONLY SOURCE WHICH CAN MEET THE REQUIRED DELIVERY DATE" ARE INADEQUATE TO
SUPPORT A SOLE SOURCE PURCHASE.

IDENTIFICATION OF THE AGENCY AND THE CONTRACTING OFFICE, AND SPECIFIC IDENTIFICATION OF THE DOCUMENT AS A “JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION.” PLEASE CITE THE
AUTHORITY AND TYPE OF JUSTIFICATION.
The United States Coast Guard (USCG), Aviation Logistics Center (ALC), Engineering Services Division (ESD), Engineering Support Branch (ESB) anticipates the award of a firm-fixed price purchase order on a sole source basis. This justification for other than full and open competition is submitted for approval in accordance with (IAW) Federal Acquisition Regulation (FAR) 6.303-1(a) using the authority in FAR 6.302-1(b)(2) – this is a Brand Name specific acquisition with limited sources that will satisfy the agency requirements.
BRIEF DESCRIPTION OF SUPPLIES OR SERVICES REQUIRED, AND THE INTENDED USE.
ESD intends to purchase the Elbit Systems Night Vision Goggle (NVG) Mounts and accessories shown in the table below on a Brand Name basis.
Line Item Description Part Number NSN Qty Optional Qty
1 NVG MOUNT 271073-2 5855-01-527-5700 50 Up to 50 ea
The ELBIT Systems has acquired the Harris® company manufacturing the AN/AVS-9(V) Aviator’s Night Vision Imaging System (PN 273998-3) to the Gentex® HGU-56/P Flight Helmet or the legacy Gentex® SPH-5CG Flight Helmet via the respective ANVIS Dual Visor Assembly used by each helmet.
Coast Guard Technical Order (CGTO) PG-85-00-310-A, Aviation Life Support Equipment (ALSE) Systems Process Guide (dated 29 September 2020) dictates the use of both the Gentex® HGU-56/P and SPH-5CG Flight Helmets for use by all USCG flight crew. The NVG Mount fits both Helmet types.
UNIQUE CHARACTERISTICS THAT LIMIT AVAILABILITY TO ONLY ONE SOURCE, WITH THE REASON NO OTHER
SUPPLIES OR SERVICES CAN BE USED.
While there are other NVG mounts that are compatible with both of the USCG’s flight helmets and the NVG system, no other mount is capable of meeting the USCG’s additional requirements. These requirements are necessary due to the rough and frequent usage the mounts receive as a result of the demanding operational tempo of search and rescue missions. USCG requirements for the NVG mount include:
• compatible with both the Gentex® HGU-56/P and SPH-5CG Flight Helmets and their associated ANVIS Dual Visor Assemblies. Must also be compatible with the Harris® AN/AVS-9(V) Aviator’s Night Vision Imaging System and the rotary wing version of the low profile battery pack;
• exact radial up and down movement as compared to the 271073-2 mount.
• reinforced chassis to prevent breakage during rigorous use;
• quick disconnect device for the rapid removal of NVGs;
• battery plug is incorporated into the mount so that no power adapter is required, thus minimizing the amount of equipment attached to the helmet and reducing possible egress hazards;
• modular design which is easily repairable by field units;
Market research has shown that the ELBIT Systems NVG Mount is the only mount capable of meeting all of the USCG’s requirements.
ELBIT Systems NVG Mount was designed by ITT (Excellus, Harris) and has attained the data rights through their merger. ELBIT Systems own all rights to the technical data, specifications, and drawings required for its manufacture. The rights to the technical data necessary in order to acquire this item from sources other than the OEM are not owned by the Government.
A DESCRIPTION OF EFFORTS MADE TO ENSURE THAT QUOTATIONS OR OFFERS ARE SOLICITED FROM AS MANY
POTENTIAL SOURCES AS PRACTICABLE (INCLUDE YOUR MARKET RESEARCH EFFORTS HERE).
Extensive market research was conducted using both Government and commercial sources. Market research included querying the following information systems and web sites: Defense Logistics Agency (DLA) Federal Logistics Information Service (FLIS);
Department of Defense Federal Electronic Mall (DoD FEDMall); the General Services Administration’s (GSA) on-line purchasing service – GSA Advantage!®; and the Inventory Locator Service e-marketplace (ILSmart). The Thomas Register of American Manufacturers, now known as ThomasNet, was used to identify manufacturers of night vision equipment and on-line research was performed into the product offerings of various manufacturers. In addition, knowledgeable individuals from Government and industry were interviewed regarding the commercial marketplace for this type of equipment.
This item is not available from any Strategic Sourcing Contract Vehicles or from any mandatory Government source IAW FAR
8.002. The mount is also not available from any non-mandatory source IAW FAR 8.004.
A combined synopsis/solicitation will be posted to the Federal Business Opportunities (FBO) web site at www.fbo.gov IAW FAR 5.101(a)(1). All responsible sources may submit a quote which shall be considered by the USCG
REASON THAT SUGGESTED SOURCE IS THE ONLY SOURCE WHICH CAN PROVIDE THE SUPPLIES OR SERVICES.
As the OEM, ELBIT Systems owns the rights to the technical data, specifications, and drawings required to manufacture this item. USCG Aviation Engineering has assigned this item an Acquisition Method Code (AMC) of 3 and an Acquisition Method Suffix Code (AMSC) Code of R. IAW Volume 10, Table 71 of DoD 4100.39 (series), an AMC of 3 directs that the part must be acquired directly from the actual manufacturer, whether or not the prime contractor is the actual manufacturer. An AMSC of R stipulates that the data or the rights to use the data needed to purchase this part from additional sources are not owned by the Government and it has been determined that it is uneconomical to purchase them.
EXPLAIN WHY AN ADEQUATE PURCHASE DESCRIPTION OR OTHER INFORMATION SUITABLE TO SOLICIT BY FULL
AND OPEN COMPETITION HAS NOT BEEN DEVELOPED OR ARE NOT AVAILABLE.
The item to be purchased must meet critical operational and reliability requirements, the achievement of which require unique production techniques and extensive and/or sophisticated testing. The Government does not own or possess any rights to the technical data, specifications, and drawings required to manufacture this item. In addition, the Government has not developed the technical data required to manufacture this part. The purchase or development of the technical data required to manufacture this item has been deemed uneconomical.
PROVIDE A STATEMENT OF ACTIONS, IF ANY, THE GOVERNMENT MAY TAKE TO REMOVE OR OVERCOME ANY
BARRIERS TO COMPETITION BEFORE FUTURE ACQUISITIONS ARE REQUIRED.
As previously stated, the Government does not own or possess any rights to the technical data required to manufacture this item. This prevents the USCG from being able to provide an adequate technical description to potential new sources. Therefore, it is difficult to take steps to foster competition when the manufacturing, performance, and testing data are proprietary to the
OEM.
The USCG will continue to monitor the commercial marketplace for the availability of new NVG mount designs and determine whether any new product is capable of meeting the USCG’s requirements.
