Justification for Other than Full and Open Competition

1. Identification of the agency and the Contracting Activity, and Specific Identification of the Document as a “Justification for Other than Full and Open Competition”

Description of Requirement: Building Automation System Replacement and Software

Update. Estimated Dollar Value:

This document is hereby identified as a “Justification for Other than Full and Open

Competition” under the authority of FAR 6.302-1. This document sets forth the justification and approval for use of one of the exceptions to full and open competition allowed under the Competition in Contracting Act (CICA) of 1984.

2. Nature and/or description of action being approved.

The BAS System at the White House Complex is in the process of being updated so that one BAS operating system (EcoStruxure) can be utilized for all of our buildings.

As a result, new equipment software licenses are required to support where legacy systems were replaced. Schneider Electric Building Critical Systems and their authorized distributors are the only source for the proprietary equipment and licenses required. However, Schneider Electric Critical Systems has built the stand-alone, “island” network on the White House Complex over the past 20 years and are the only company that hold the information housed in the database (building specific graphics, alarm points, connections, etc) that are required to make the hardware and software interface with the onsite BAS system.

3. Description of supplies or services required to meet the agency’s needs.

The Contractor shall provide (8) operator terminals, HP Z2 G5 Mini, 27” Samsung Monitors, MS Office Home and Business 2021. Provide MS Office Home and Business 2021 and configure all associated EcoStruxure software and EBO workstations, professional licenses.

An upload of the database to make the new hardware and software function with the onsite system is also required to make the system function.

4. Identification of statutory authority permitting other than full and open competition

41 U.S.C. § 3304(a)(2), Only one responsible source and no other supplies or services will satisfy agency requirements. See also FAR § 6.302-1.

5. A demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited.

In accordance with FAR Section 6.302-1, negotiations will be conducted on a sole source basis with Schneider Electric Building Critical Systems, Inc. to perform the services to support the WHSC Staff.

The GSA Facilities Management Office has determined the contractor’s ability to complete this requirement based on the following:

Schneider Electric Building Critical Systems not only owns the proprietary software required, but they also have a contract that maintains the existing BAS network and information database required to make all hardware and licenses work with the existing

White House Service Center BAS. The Contractor has the sufficient experience as well, working on the system required by the General Services Administration.

6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized.

Not applicable. See #5 above.

7. A determination by the contracting officer that the anticipated cost to the

Government will be fair and reasonable.

The GSA Facilities Management Office has prepared an Independent Government

Estimate (IGE) in the amount of for the services.

8. A description of the market research conducted and the results or a statement of the reason market research was not conducted.

Market research was not conducted because the BAS (Building Automated System) is

Schneider Electric Building Critical Systems proprietary system, and they are the only company capable of providing the onsite integration to the White House specific information.

9. Any other facts supporting the use of other than full and open competition.

Due to the contractor’s familiarity with the requirement, the Government is confident that the award of a stand-alone firm-fixed price contract to this contractor will result in the timely execution of this need.

10. A listing of the sources, if any, that expressed, in writing, an interest in the acquisition

Not applicable.

11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required.

Normally, procurement actions are handled using full and open competitive procedures for a requirement such as this one. However, because the existing BAS is a Schneider Electric

Building Critical Systems proprietary system, it is necessary to contract with Schneider

Electric Building Critical Systems for this requirement to be successful.

12. Contracting officer certification that the justification is accurate and complete to the best of the contracting officer’s knowledge and belief.
