SECTION B – SUPPLIES OR SERVICES AND PRICING

B.1 GENERAL

The Contractor shall perform the services described in the attached Scope of Work in accordance with the requirements of this solicitation/contract.

B.2 PERIOD OF PERFORMANCE

This contract is for 180 days. The period of performance will begin when the onsite Notice to Proceed is issued by the Contracting Officer.

B.3 PRICES/COSTS

1. Price proposals must be prepared according to the price sheets.

2. It is the offeror’s responsibility to understand all performance requirements and to correctly price its offer before award. No price increases will be permitted for any alleged miscalculations of the pricing after award. Specific reservations, exclusions, or assumptions affecting price or performance are not permitted and will not be honored; any proposals containing such limitations will not be accepted.

3. Please submit all pricing on the attached vendor pricing sheet, with the total proposed price on the SF 1449.

G.2 CHANGES OR REVISIONS

The Government shall not be liable for any costs due to changes or revisions from the requirements originally negotiated and agreed to, unless such changes or revisions are authorized and approved by the Contracting Officer.

Any requests for changes or revisions received from the contractor shall be referred to the Contracting Officer for review and approval before acceptance by the Government.

G.3. PAYMENTS

Payment will be made by the Government in monthly installments based upon, and in proportion to, the task or tasks completed and accepted by the Government and subsequent submission of a properly executed invoice. Payment will be due on the 30th calendar day (except for the final payment under the contract) after receipt of a proper invoice or date of receipt of services, whichever is later. It is the objective of the Government to obtain complete and satisfactory performance in accordance with the terms of the specifications and requirements of this contract.

G.4 GSAM 552.232-72 – FINAL PAYMENT UNDER BUILDING SERVICES

CONTRACTS (MAR 2012)

Before final payment is made, the Contractor shall complete and furnish the Contracting Officer with GSA Form 1142, Release of Claims, releasing all claims against the Government relating to this contract, other than claims in stated amounts that are specifically excepted by the Contractor from the release. If the Contractor’s claim to amounts payable under the contract has been assigned under the Assignment of Claims Act of 1940, as amended (31 U.S.C. 3727, 41 U.S.C. 15), a release may also be required of the assignee.

SECTION H - SPECIAL CONTRACT REQUIREMENTS

H.1 INSURANCE REQUIREMENTS

(a) The contractor shall provide insurance coverage for all risks associated with performing this contract. Liability insurance coverages, written on the comprehensive form of policy, are required in the following minimum amounts:

(1) Workers' compensation and employer's liability $100,000 or per statute

(2) General liability:

(i) Bodily injury $500,000 per occurrence

(ii) Property damage $100,000 per occurrence

(3) Automobile liability:

(i) Bodily injury $200,000 per person $500,000 per occurrence

(ii) Property damage $20,000 per occurrence.

(4) Commercial/contractual general liabilities: $1,000,000 per occurrence

(b) In addition, the contractor must provide coverage for any other risks as deemed appropriate, since the Government is not indemnifying the contractor against any risks under the contract. A current duplicate (not machine reproduced) certificate of insurance must be submitted to the Contracting Officer (CO) for approval before the contractor begins work under this contract;

duplicates of renewal certificates (not machine reproduced) obtained by the contractor during the life of this contract must immediately be provided to the CO. Also see the clause, "Insurance - Additional Named Insured" below.

(c) The insurance policy must contain an endorsement that any cancellations or material decreases in the coverages shall not be effective, unless the insurer or the contractor gives advance written notices of cancellations or changes in accordance with the CO's instructions.

(d) All premiums or costs incurred to comply with these insurance requirements will be paid by the contractor.

(e) If the contractor already has an organizational policy in effect, the CO requires evidence that it satisfies all of the above stated requirements. The contractor is required to provide such evidence as deemed necessary by the Contracting Officer before a notice to proceed with contract performance is issued. The Government reserves the right to disapprove the purchase of any insurance coverage not in the Government’s interest.

(f) This contract requires that all insurance coverages be kept in full force and effect until all contract work is completed; the insurance requirements also apply to subcontractors.

(g) The Government will not be responsible for any losses, damages, or liabilities beyond the amounts, limits, and conditions of the above required insurance.

Solicitation # 47PM1023R0014 - request for proposal (RFP)

Subject: Synopsis for EEOB BAS Terminal Replacement and Software Update

This is a combined synopsis/solicitation for commercial products or commercial services prepared in accordance with the format in subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued.

The U.S. General Services Administration (GSA), Public Buildings Service (PBS), has a requirement for (8) BAS Terminal Replacement and Software Update at EEOB, 17th, and

Pennsylvania Ave NW Washington DC 20506. GSA plans to sole source the procurement to

SCHNEIDER ELECTRIC HOLDINGS, INC. per the authority FAR Part 6.302-1. A Firm Fixed

Price contract will be issued as a result of this contract action.

The contract resulting from this solicitation will be for a period of 180 calendar days from award.

The applicable NAICS code is 335999, All Other Miscellaneous Electrical Equipment and

Component Manufacturing.

This procurement will be sole sourced under the statutory authority permitting action utilizing other than full and open competition based on the determination that there is only one responsible source, and no other supplies or services will satisfy agency requirements as implemented in FAR 6.302-1 and 41 U.S.C. 3304(a)(1).

The synopsis and solicitation will only be available electronically. It will be available on or about

May 25, 2023, until June 9, 2023. Potential offerors will be responsible for downloading the solicitation and for monitoring the website for possible amendments and/or additional information. To ensure that you receive all information regarding this solicitation, please register to receive updates at www.sam.gov, and follow the procedures for notification registration.

However, the Government intends to solicit only one source as determined in the attached

JOFOC.
