1. Nature and/or description of the item/service being procured and its intended use (include the anticipated cost):
The requirement is for the installation of Government Furnished Property (GFP), forty (40) custom musical wind Chimes at the Tower of Voices located at the main entrance of the Flight 93 National Memorial, Somerset County, PA. The Tower of Voices is a 93-foot tall pre-cast tower intended to house the 40 custom musical wind activated chimes in honor of the passengers and crew of United Flight 93.
Work requires the use of a crane and other lift capabilities over a 10-day period to properly secure the new chimes in the tower. Installation includes protection of the tower, all surrounding features and landscaping as well as cleanup and final acceptance testing by the Government. Contract amount is estimated under $35,000 for the entire requirement
2. Sole Source Justification rationale (Check one and explain below):
_XX__ Only one responsible source.
______ Urgent and compelling circumstances exist. Include critical delivery or performance dates, and when you became aware of the requirement. Provide a specific statement of the impact on Government operations, financial or otherwise, if the required delivery or performance dates are not met.

Explain: The GFP consists of 40 Chimes, each chime has 8-inch outside diameter aluminum tubes which vary in length from 5 feet to 10 feet. Each chime consists of suspension components, striker, sail, fasteners, dampening material and tether and each are specifically tuned so they provide a specific frequency when activated by the wind. Once each chime is tuned it is specially finished and recalibrated to maintain the designed frequency. Any chimes which are damaged during transportation or installation will require the specific chime be uninstalled, returned to the fabricator for repair, refinishing and re-tuned prior to being reinstalled in the tower. Due to the extreme heights and site challenges extreme care must be taken to prevent damages to the chimes and tower. As a result, the Government has determined the risks associated with the installation warrants the use of the manufacturer to complete the installation and final acceptance testing to ensure no damages to the chimes are encountered and the final commissioning is completed for Government acceptance. Furthermore, the manufacturer has replicated the connection assembly features of the actual tower in the factory in order to properly assemble the chimes and is familiar with the proper method to install the chimes without possibility of damage to the Chimes or the Tower structure. Additionally, it is critical that the chime installation result in tight connections at the points of attachment to ensure the safety of park visitors and staff at the installation of the chimes. Familiarity with the connection requirements will enable the installer to properly install the chimes and minimize safety concerns because the tower is open to the public and visitors have access to the interior of the tower. Any errors in installation could subject the public to life safety dangers should the chimes become loose and fall to the ground.
3. Market Research. Please explain the results or why one was not performed. State whether any other offers were received, or anyone expressed interest:
The Government did not complete market research due to the unique one-off nature of the GFP and the

The Government reviewed the conditions and concluded, due to the extreme heights required to install each of the approximately 200 pound assemblies and the associated risk of damaging either the tower or the custom tuned wind chime assemblies and considering safety risks to the public, it is in the best interest to contract directly with the wind chime fabricator in order to mitigate all risks and address visitor safety concerns.
4. If this is a determination for sole source, the contracting officer certifies:
a. Only one source is available.
b. The anticipated price will be determined fair and reasonable using the price analysis techniques described in FAR Part 13.106-3(a).
