JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN

COMPETITION (OVERSEAS CONTRACTING ACTIVITIES)

I recommend that Embassy Beijing use other than ftd1 and open competition for the acquisition of LES Group Health and Life Insurance services covering the period of five months from August 1, 2018 to December 31, 2018.

Nature and/or description of the action being approved.

This action will be the first out-of-scope modification to current contract SCH50012R2003 which was awarded to China Life Beijing. Post needs another five-month extension to allow sufficient time to perform the pre-award actions. Furthermore, an adequate amount of time is required for the post award actions required from the contractor, HR, Bangkok and procurement.

A description of the supplies or services required to meet the agency's needs.

LES group health and life insurance services.

Total cost of services for 5 months is estimated at RMB 3,749,385 (US$ 566,543. Rate 6.618).

An identification of the statutory authority permitting other than full and open competition.

Citation: 41 U.S.C. 253 (c) (2), FAR 6.302-2; Unusual and Compelling Urgency; (Based on the available time and urgency of the requirement as detailed below)

The need for the supplies or services is urgent and compelling and to rebid this five-month extension would seriously strain the Embassy's limited resources which are being employed to complete the current solicitation process for the new contract and to perform other critical procurement actions. This five-month extension is to allow a short term "bridge" between the expiry date of the current contract and the expected new contract to commence on January 1,2019.

A demonstration that the proposed contractor's unique qualifications or the nature of the acquisition requires use of the authority cited (for sole source acquisitions; also required for unusual and compelling urgency where more than one offer will not be solicited).

China Life, Inc. Beijing is the incumbent contractor for the Embassy's employees.

Therefore, they have all the processes already set up and they are familiar with the Embassy's working procedures so that services can be continued without a need for transition and on a timely basis.

A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable. The description should include whether a FedBizOpps notice was or will be publicized, as required by FAR 5.2, and if not, which exception under FAR 5.202 applies (e.g., blanket waiver provided in DOSAR 605.202-70).

NIL

A determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

The bi-weekly premiums for each category of the extension is the same as the bi-weekly premiums in Option Year 4 of the current contract which were obtained using full and open competition procedures and therefore determined as fair and reasonable.

A description of the market survey conducted and the results or a statement of the reasons a market survey was not conducted.

A market survey was not conducted for this extension because this is just a very short term bridge.

Any other facts supporting the use of other than full and open competition.

Post has re-competed the requirement under full and open competition but the new contract cannot be awarded before August 1, 2018 due to the documentation requirements and lengthy procedures involved in the pre-award and post award phases.

A listing of sources, if any that expressed, in writing, an interest in the acquisition.

No interest from other sources for 5 months contract only.

A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required.

Post has re-competed the requirement under Solicitation 19CH5018R2000 and award is expected to be made before January 1, 2019.
