About this file

This is a Justification and Approval (J&A) document for Other Than Full and Open Competition for the Hampton VA Medical Center to procure Stryker Saw and Drill Surgical Instruments and accessories. The procurement will be conducted as a Service-Disabled Veteran-Owned Small Business (SDVOSB) set-aside with an estimated award date of April 15, 2024.

The requirement includes various Stryker System 9 surgical instruments and accessories used by 8 surgeons across orthopedics, podiatry and vascular surgery specialties, including drills, saws, batteries, and containers. The items must be supplied by Stryker-authorized distributors, with three SDVOSB firms identified: Academy Medical Inc., Beacon Point Associates, and TrillaMed LLC. The J&A cites "Only One Responsible Source" as the authority, since only authorized Stryker distributors can provide the equipment with full OEM warranty. Market research confirmed these items are available as an Open Market SDVOSB set-aside under NAICS code 339112, which has an SBA Non-Manufacturer Rule class waiver. The Contracting Officer expects to receive at least two quotes from SDVOSB firms and will determine price reasonableness through comparison with previous purchases.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Market research was conducted, details of which are in the market research section of this document. This effort did not yield any additional sources that can meet the Governments requirements. There is several authorized reseller/distributors that can provide the items/products as part of an Open Market contract. There is competition anticipated for this acquisition.

The VA Rule of Two can be met for this requirement. The Contracting Officer does have a reasonable expectation of receiving 2 or more quotes from SDVOSB if we were to set this requirement aside as 100% SDVOSB. The Contracting Officer believes that the most advantageous acquisition strategy for the government is to solicit this acquisition as SDVOSB set-aside Open Market IAW VAAR 819.7006.

Stryker products may not be sold by other resellers without written authorization directly from Stryker. Any Stryker product(s) sold to the Government through a Stryker authorized reseller is verified to be new products (not grey market) and will come with the full OEM warranty.
