About this file

This document contains a justification for other than full and open competition and a related federal contract opportunity solicitation. The justification document outlines that the United States Coast Guard Aviation Logistics Center intends to issue a firm-fixed price purchase order on a brand name basis to Aerial Machine & Tool Corporation, doing business as Capewell Aerial Systems, for various flotation and safety equipment including vests, collars, belts, and bladders. The justification cites that Capewell is the original equipment manufacturer and sole owner of technical data and specifications required to manufacture the items, preventing other potential sources. The related solicitation seeks quotes for the same items and quantities by April 30, 2021 and is set aside 100% for small businesses, with anticipated award by February 26, 2021. Quotes must include traceability to Capewell as the manufacturer.

The latch requires a quick release safety locking mechanism. The aircraft safety belt has a buckle latch-lock incorporated into the buckle that prevents inadvertent opening of the buckle when worn correctly. The Air Crew rotary wing belt is used on rotary wing and fixed wing aircraft. The Vest, Flotation Collar, Casing, Bladder Assemblies are all-unique to USCG survival vests, previously approved and part of required maintenance procedures. The Raft Retention Assembly are approved for securing LRU-25 raft inside the aircraft.

UNIQUE CHARACTERISTICS THAT LIMIT AVAILABILITY TO ONLY ONE SOURCE, WITH THE REASON NO OTHER SUPPLIES OR SERVICES

CAN BE USED.

The USCG ALC is responsible for Coast guard Aviation supply. To accomplish these goals ALC Aviation Life

Support Equipment (ALSE) program element standardizes life support equipment authorized for use. Only approved life support, safety and rescue equipment for use by Aircrew and/or on-board Coast Guard aircraft is authorized.

Lifesaving equipment selection criteria are based on 46 CFR Part 160 and C.G. policy per Rescue and Survival

Systems Manual COMDTINST M10470.10 (series). Approved equipment are standardized and maintained in accordance with (IAW) Aviation Life Support Systems Manual COMDINST M13520.1 (series), Helicopter Rescue

Swimmer Authorized Equipment Process Guide CGTO PG-85-00-330, and Aviation Life Support Systems Process

Guide CGTO PG-85-00-310. Detailed maintenance and servicing of the equipment is accomplished IAW the applicable Aviation Maintenance Procedure Cards (MPC).

A DESCRIPTION OF EFFORTS MADE TO ENSURE THAT QUOTATIONS OR OFFERS ARE SOLICITED FROM AS MANY POTENTIAL

SOURCES AS PRACTICABLE (INCLUDE YOUR MARKET RESEARCH EFFORTS HERE).

Extensive market research was conducted using both Government and commercial sources. This included querying the following information systems and web sites: Defense Logistics Agency (DLA) Federal Logistics Information Service

(WebFLIS); Department of Defense Electronic Mall (DoD EMall); General Services Administration (GSA) Advantage online purchasing service; Inventory Locator Service e-marketplace (ILSmart); internet search engines; and the OEM’s web site. These items are not available from any required or optional source of supply IAW FAR 8.002. Capewell sells directly to the Government and also a network of authorized commercial dealers. All responsible sources may submit a quotation which shall be considered by the agency.

REASON THAT SUGGESTED SOURCE IS THE ONLY SOURCE WHICH CAN PROVIDE THE SUPPLIES OR SERVICES.

Capewell is the OEM and therefore, owns all rights to the technical data, specifications, and drawings required to manufacture these items. Capewell has not licensed the rights to the technical data required to manufacture these items so there are no other sources capable of their manufacture.

EXPLAIN WHY AN ADEQUATE PURCHASE DESCRIPTION OR OTHER INFORMATION SUITABLE TO SOLICIT BY FULL AND OPEN

COMPETITION HAS NOT BEEN DEVELOPED OR ARE NOT AVAILABLE.

The items to be procured are complex and must meet critical operational and reliability requirements, the achievement of which require unique production techniques and extensive and/or sophisticated testing. The Government does not own or possess any rights to the technical data, specifications, and drawings required to manufacture these items and the purchase of these rights has been deemed uneconomical. In addition, the Government has not developed the technical data required to reverse engineer these parts and has no plans to do so.

PROVIDE A STATEMENT OF ACTIONS, IF ANY, THE GOVERNMENT MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS TO

COMPETITION BEFORE FUTURE ACQUISITIONS ARE REQUIRED.

As previously stated, the Government does not own or possess any rights to the technical data, specifications and drawings required to manufacture these items which has prevented the USCG from being able to provide an adequate technical description to potential new sources. Therefore, it is difficult to take steps to foster competition when the manufacturing, performance, and acceptance data are proprietary to the OEM.
