About this file
This justification and approval document outlines a limited competition contract award for hot oil flush services. The Portsmouth Naval Shipyard Detachment San Diego requires these services to be performed by Clarus Fluid Intelligence or South Bay Sand Blasting and Tank Cleaning on an external hydraulic system aboard a naval vessel. The period of performance is from February 13, 2020 to April 23, 2020, with an estimated total value of $410,000. Due to the urgent and compelling need to return the vessel to operational status, the contracting office issued solicitation N3904020R0078 on a limited basis to two contractors with relevant experience who can meet the required schedule. The Navy awarded contract N3904020P0092 for these hot oil flush services to an unknown vendor on February 12, 2020 for an unknown amount.

Code: 410 P.R. Number: N3904020RC0244
JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
JUSTIFICATION
1. Contracting Activity
The Contracting Activity is the Contracting Division (Code 410), Portsmouth Naval Shipyard (PNS), Kittery, ME. The requiring activity is the Portsmouth Naval Shipyard Detachment San Diego (PNSDETSD), in support of Emergent Repair Availability Technical Availability (ERATA) work for at Naval Base Point Loma (NBPL), San Diego, CA.
2. Description of the Action Being Approved
This is an other than full and open action submitted for approval to issue a Firm Fixed Price Contract resulting from a Commercial Request for Quotation. This proposed action provides for either Clarus Fluid Intelligence(Cage 4GXVO), or South Bay Sand Blasting and Tank Cleaning (Cage OSAJ6), to perform a Hot Oil Flush of the
External Hydraulic System. This is a Mission Essential Repair which is annotated by a CAT 3 CASREP.
3. Description of Supplies/Services
This requirement is for a Firm Fixed Price Contract for vendor services to accomplish disassembly, inspection, flush and reassembly of the engine, and the External Hydraulic System. The Statement of Work (SOW) encompasses the material, technicians and mechanics, management, supervision, and transportation necessary to clean, inspect and repair all identified deficiencies in order to make External Hydraulic System certified for unrestricted operation.

Estimated Dollar Value Total
4. Statutory Authority Permitting Other Than Full and Open Competition
The statutory authority permitting other than full and open competition is 10 U.S.C. 2304 (c) (2) or 41 u.s.c. 3304 (a) (2), as implemented by Federal Acquisition Regulation {FAR) 6.302-2{a) (2).
5. Rational Justifying Use of Cited Statutory Authority
In accordance with FAR 6.302-2, this requirement is of such an unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources. This authority permits limiting the number of sources solicited and to not use full and open competition for this requirement.
There is not sufficient time to issue a full and open request for quotation, evaluate and award a negotiated contract in accordance with policy guidelines, and coordinate the security requirements for this effort with a vendor unfamiliar with the base access process.
This is extremely urgent in nature as the casualty of the External Hydraulic System renders the boat inoperable. In order to return the boat to the fleet, and restore it to a deployable status, the maintenance needs to be performed immediately. has scheduled operations that will be significantly impacted by any delay in repairs.
6.
of Efforts Made to Solicit Offers from as Many as Practicable
Initial notification of this requirement was received by the Contracting Office on February, 5 2020. Based on the urgent nature of this work, and the requested start date of February 18 2019, an award must be made by 14 February, 2020 and there is not sufficient time to post a synopsis and seek additional sources. This Justification and Approval (J&A) is hereby requesting approval to waive the synopsis.
Clarus Fluid Intelligence has performed this identical 'hot oil flush' service under contracts N3904018P0095, N3904018P0003, N3904014P0296, and N0018913PP437. They have also performed similar 'hydraulic flushes' under contracts N3904017P0309, N3904014P0028, N0018911MP809. They are very .familiar with the security requirements, and procedures required to execute the services, and can meet the schedule.
South Bay Sand Blasting and Tank Cleaning has performed 'hot oil flush' service under contracts N3904019P0351. In addition they also has experience performing this service for the Government (PHNS), as a subcontractor on a Government contract. They are also familiar with the security requirements and can meet the schedule.
In addition to the above information, the Contracting Office does not anticipate that any other sources who have expressed interest in previous requirements, generated from this specific location, would be able to offer a greater advantage (ie, price or schedule) to the Government.
Two vendors: Clarus, and South Bay will be contacted regarding this requirement.
Upon approval of this J&A, it will be posted on the Government-wide point of entry, on https://www.beta.sam.gov/, as intent to negotiate on a sole source basis with FBE, in accordance with FAR 6.305.
7. Determination of Fair and Reasonabl
A determination of fair and reasonable price will be based on price analysis by the Contracting Officer of the contractor's quotation and/or a comparison of previous pricing history, historical contract analysis, published price list of same or similar items, or any other reasonable basis, in accordance with FAR 15.404, prior to award.
