About this file
This justification document outlines a sole source procurement by the Defense Logistics Agency Land and Maritime for holdback bars used in aircraft carrier catapult systems. The procurement is for up to 75 holdback bar assemblies per year from two approved sources: York Precision Machining and Hydraulics and Curtiss-Wright Flow Control Corporation. The bars are classified as critical safety items and require stringent welding and testing procedures approved by Naval Air Systems Command. Market research found no other capable suppliers. The solicitation will be posted to the DLA website for 30 days to allow any other potential sources to pursue approval from NAVAIR. The previous contract was awarded on May 12, 2020 to an unknown vendor for an unknown amount.

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
SOLICITATION SPE7M219R0006
DLA Land & Maritime Justification for Other Than Full & Open Competition
(FEB 2017)
[ X] ORIGINAL
1. The Defense Logistics Agency, DLA Land and Maritime, is the contracting activity.
2. The action being approved is the acquisition of supplies on other than a full and open competition basis.
3. The supplies required to meet the using activity’s needs are described as follows:
BRIEF DESCRIPTION NSN/P/N QUANTITY TOTAL EST. VALUE AMSC
Holdback, Bar, Assembly 1720-01-064-6070 20 EA - 75 EA C
Identify end item, weapon system, or class of item: This NSN 1720-01-064-6070 is described as a Holdback, Bar, Assembly, Nose Gear Launch a component of the Launching Engine Assembly for the catapult system on the US Aircraft Carriers. A holdback bar restrains the aircraft until enough thrust builds to ensure a safe launch. The WSDC codes listed on the Integrated Data Sheet are (82N) Aircraft Launch and Recovery Equipment.
This item is listed as being a Critical Safety Item (CSI).
ESTIMATED BASE VALUE: 55 EA =
ESTIMATED TOTAL VALUE + RANGES: Up to 75 = $
A J&A from the most recent award is not available. Recent contracts were awarded by Naval Inventory Control Point.
AMC/AMSC codes were reviewed by the Product Specialist of record on December 10, 2018.
4. The statutory authority permitting other than full and open competition is:
[ X] 10 U.S.C. 2304(c)(1) - Available from only one or a limited number of sources.
5. If restricted to the only source(s) of supply, include source(s) and CAGE code: (81A16) York Precision
Machining and Hydraulics and (95169) Curtiss-Wright Flow Control Corporation. This item requires stringent welding procedures to be approved by NAVAIR. It also requires special testing and Quality conformance.
These two (2) sources are the only manufacturers that have the appropriate manufacturing expertise and quality capabilities according to NAVAIR. It is noted that (95169) Curtiss-Wright Flow Control Corporation will not participate indicating a “No Bid” via a submitted DIBBs quote on SPE7M19T1390.
The use of the authority cited below:
[ X ] AMC 1. Suitable for competitive acquisition for the second or subsequent time.
The use of the authority cited is based on:
[ X ] AMSC C. This part requires engineering source approval by the design control activity in order to maintain the quality of the part. Existing unique design capability, engineering skills, and manufacturing knowledge by the qualified source(s) require acquisition of the part from the approved source(s). The approved source(s) retain data rights, manufacturing knowledge, or technical data that are not economically available to the Government, and the data or knowledge is essential to maintaining the quality of the part. An alternate source must qualify in accordance with the design control activity's procedures, as approved by the cognizant Government engineering activity. The qualification procedures must be approved by the Government engineering activity having jurisdiction over the part in the intended application. If one source is approved, AMCs 3, 4, or 5 are valid. If at least two sources are approved or if data is adequate for an alternate source to qualify in accordance with the design control activity's procedures, AMCs 1 or 2 are valid. The weapon system indicator code is F “failure will render end item inoperable”. As such, acquisition from the currently approved sources is required to maintain the quality of the part.
Pursuant to the engineering and design activity, Naval Air Systems Command (NAVAIR) the sources cited in paragraph 5 have the appropriate knowledge, manufacturing expertise and quality capabilities to supply this NSN.
This is a flight critical safety item and in accordance with DFARS 209.270, DLA must procure this item only from those sources approved by the design control activity.
6. Efforts to ensure that offers are solicited from as many sources as practicable are:
[ X ] The acquisition will be synopsized on or about February 18, 2019 for 15 days to FEDBIZOPPS.
7. I hereby determine that the anticipated cost to the Government will be fair and reasonable. Certified Cost and Pricing Data will be required because the current estimated value is above the threshold of $2 Million, FAR 15.403-4. The Acquisition Specialist will request assistance from the DLA Land and Maritime Pricing and request a DCMA audit. A price analysis will be conducted as well with usage of the BLS Producer Price Index (PPI) and the learning curve analysis.
8. Market Research/Efforts to Obtain Competition:
Market Survey [10 U.S.C. 2304(f)(3)(D)]:
A Sources Sought notice was posted to FEDBIZOPPS on January 10, 2019 with an attached market survey for completion for 5 days. The Sources Sought notice produced no responses. The Purchase Requisition was initially solicited automatically and produced 4 responses (SPE7M19T1390). (95169) Curtiss-Wright Flow Control Corporation submitted a “No Bid”. Two (2) surplus offers were received, but determined to be technically unacceptable. (81A16) York Precision Machining and Hydraulics provided a quote with pricing that caused the solicitation to exceed the Certified Cost and Pricing Data threshold. The buyer also researched past technical documents provided by the Product Specialist. The most recent DLA PR was cancelled due to an approved source unable to find a welder to perform to NAVAIR requirements. The item is a complex assembly with seven CSI sub-components.
Total number of vendors contacted: 1
Names of vendors contacted and responding: The Acquisition Specialist provided a market survey to (81A16) York Precision Machining and Hydraulics.
Techniques used to conduct survey:
Posted a Sources Sought on January 10, 2019 for 5 business days with attached market survey to FedBizOpps.
Emailed a questionnaire to the one (1) listed approved sources.
Internet Search.
Review of technical documents.
Types of information requested: Business size, estimated price and delivery, economical quantities, commerciality, purpose and function, and capability to provide Certified Cost and Pricing Data.
Summary of information received: Received one (1) market survey response.
(81A16) York Precision Machining and Hydraulics is a small business manufacturer with 23 employees. They will participate in this procurement.
Information received regarding the commerciality of the item(s): This is exclusively used for the ALRE, Catapult and Arresting Gear. Review of Material Master indicates that this NSN has an AMC/AMSC rating of 1 C, and the Commercial Off The Shelf is blank. An internet search was conducted for this NSN, and the results indicate that the item is not for commercial use. Market research with an approved manufacturer and technical information provided by the Product Specialist do not identify this item as commercial. There is no evidence that this NSN is available on the commercial market nor is it of a type customarily used by the general public or by non-governmental entities for purposes other than government or military purposes as defined in FAR 2.10.
9. Additional facts supporting other than full and open competition are:
[ X ] Other: (Explain) This is a Critical Safety Item with an SPC code of 01. Naval Air Systems Command, Lakehurst (NAVAIR) is the design control activity and determines which manufacturers are capable of producing the item to its CSI requirements. The components being acquired under this solicitation have been classified as “critical” requiring engineering source approval by Naval Air Systems Command (NAVAIR). Only those companies who have submitted requests for source approval and have been approved will be eligible for award.
