JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity.

Naval Air Warfare Center Aircraft Division (NAWC-AD) Patuxent River, MD

2. Description of the Action Being Approved.

This justification and approval authorizes and approves a sole source, cost-plus-fixed-fee (CPFF) six month Level of Effort extension from 22 February 2012 through 21 August 2012, to the NAVAIR 6.6.3 Air-to-Air/Strike Defense Suppression (SDS) Weapons Systems Logistics Management Support, under task order N00178-04-D-4130-M801 currently being performed by Synectic Solutions, Inc. This extension will allow the Government sufficient time to effectively accomplish a competitive SeaPort-e follow-on task order award for the NAVAIR 6.6.3 logistics management support effort which will result in reduced cost, schedule and programmatic risks.

3. Description of Supplies/Services.

This requirement will provide acquisition logistics management, support, analyses, and evaluation of logistics planning supportability for the NAVAIR 6.6.3 air-to-air missiles, strike and time sensitive weapons, cruise missiles, and aerial targets. The contractor shall provide the requisite knowledge, experience, and technical data that can meet the Government’s requirements on a timely basis. This work will be performed at Government and contractor facilities in Patuxent River, MD; NAS North Island, CA; St. Louis, MO; and Tobyhanna Army Depot in Chambersburg, PA.

See Appendix A for Estimated Dollar Value

4. Statutory Authority Permitting Other Than Full and Open Competition.

10 U.S.C. 2304(c)(1), Only one responsible source and no other supplies or services will satisfy agency requirements.

5. Rationale Justifying Use of Cited Statutory Authority.

On 26 October 2006, Synectic Solutions, Inc. was awarded the NAVAIR 6.6.3 Air-to-Air Missile/SDS Weapons task order N00178-04-D-4130-M801 under a best value, small business set-aside competition through SeaPort-e. The task order was awarded with a base year plus four option years in the total amount of $9,160,130.00, inclusive of options. The follow-on competitive task order action is in process; however, the current support order will expire on 21 February 2012.

The rationale stated above makes it necessary to continue performance with the same contractor. The period of performance is based on the authority of FAR Clause 52.217-8, Option to Extend Services. This J&A authorizes an extension of six months resulting in a revised task order end date of 21 August 2012.

Per FAR 6.302-1(a)(ii), only Synectic Solutions, Inc. can perform the required continuation effort without both substantial duplication of costs, not expected to be recovered through competition, and unacceptable delays to NAVAIR 6.6.3 program objectives. Synectic Solutions, Inc. can perform the prospective tasks now because they currently provide the requisite logistics management services necessary to adequately support the NAVAIR 6.6.3 air-to-air missiles, strike and time sensitive weapons, cruise missiles, and aerial targets.

Any firm other than Synectic Solutions, Inc. would have to duplicate these efforts. This period of time is unacceptable to the Government in that it would disrupt the ongoing and necessary logistics management support for day to day operations of NAVAIR 6.6.3 that would result in negatively impacting direct fleet support.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

The proposed task order actions were synopsized on the FEDBIZOPPS website on 4 January 2012. No responses were received to this synopsis. Any subsequent responses will be reviewed by the Procuring Contracting Officer. No additional market research was conducted as it is not practicable, for the reasons discussed in paragraph 5 above, for any company other than those identified herein to provide the required services. This event is ongoing thru 20 January 2012.

7. Determination of Fair and Reasonable Cost.

In accordance with FAR 15.402, the Contracting Officer shall ensure that all supplies and services provided under this task order are procured at a fair and reasonable price. The Contracting Officer will perform price analysis and utilize the necessary resources to help determine a fair and reasonable price.

8. Actions to Remove Barriers to Future Competition.

This extension is being processed while the follow-on task order process is being completed. The follow-on task order will be the result of a competitive procurement which is estimated to be awarded no later than 21 August 2012.
