Contracting Officer’s Determination Memorandum for Sole Source (Including Brand Name) for less than SAT
In accordance with FAR 13.106-1 (b) (1), for purchases not exceeding the simplified acquisition threshold (SAT) contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization). The determination must explain why the item or service provider is the only one that will meet the Government's requirement. Statements such as "only know source" or "only source which can meet the required delivery date" are unacceptable to support a sole source purchase.

CCAM-ALK-LEAD FORM 4312, March 2019
The upgrade of main and cooling unit controls in Temperature Testing Chamber. The upgrade is necessary because of the obsolescence of the controls of the cooling units and control room. The upgrade will be performed by Weisstechnik, formerly Cincinnati Sub Zero, the Original Equipment Manufacturer (OEM).
Letterkenny Army Depot intends to procure a sole sourced upgrade by Weisstechnik, the Original Equipment Manufacturer (OEM),for the controls of the cooling units and control room including the human manual interface (HMI).
Market research indicates that Weisstechnik is the only company able to upgrade with new controls with the existing logic and software packages used in the cooling units and the main control room HMI. The software that is used in the temperature chamber is proprietary to the OEM.
The purchase of a different temp chamber would cost approximately $2M. Replacing the cooling units and control room would cost around $1M. Trying to reverse engineer the software to work with another company's controllers and HMI with the existing cooling units would cost around $500,000. New equipment would require a different software package for the entire temp chamber system including the cooling units, main controls, and HMI.
Because of the obsolete equipment and parts, any breakdowns would cause major downtime of the temperature chamber and cause delivery delays for the PATRIOT program.
