About this file

This document is a sole source justification for a VISN 19 UNIPOC license renewal contract. The Department of Veterans Affairs Veterans Health Administration Veterans Integrated Service Network 19 requires annual license renewal and sustainment services for UNIPOC software from Siemens Healthcare Diagnostics Inc. to integrate laboratory point-of-care devices with the Vista/CPRS system. The estimated value of the five-year firm-fixed-price contract is $464,473.20. A sole source award was justified because the UNIPOC software licenses are proprietary to Siemens, who is the only source that can provide the required license renewal and integration services. The incumbent, Siemens Healthcare Diagnostics Inc., was awarded contract 36C25922C0138 for an unknown amount on September 22, 2022.

3. The Siemens UniPOC servers are currently located at the Eastern Colorado Health Care System, servicing VISN 19 stations listed above. FAR 13.5 Simplified Procedures for Certain Commercial Items. The statutory authority for applying the Simplified Procedures for Commercial Items of FAR 13.5 is 41 U.S.C. § 1901 and is implemented by FAR 13.106-1(b)(2) for restricting competition on this procurement. Competition is restricted on this procurement for the reason below:

(X) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements

Services ( ) International Agreement ( ) Authorized or Required by Statute ( ) National Security ( ) Public Interest

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): The Siemens UniPOC servers are the existing system being utilized for the integration of Laboratory point of care devices to Vista/CPRS across the VISN; and the licenses are about to expire on 30 September 2022. The UniPOC software is proprietary to Siemens Healthcare and is the only vendor who can provide the license renewal and the highly service and maintenance of the integration process. Additionally, the UniPOC licenses are necessary to avoid disruption in the operation of the existing system. Siemens Healthcare has provided a sole source letter confirming the proprietary nature of the supplies/services needed under this requirement; and is uploaded in eCMS briefcase.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Market research conducted on UniPOC software/licenses yielded no results of any small businesses capable of providing this requirement. The GSA eLibrary, SBA and VetBIZ was searched and zero results. Reached out to Siemens Healthcare if there are any authorized distributor/reseller of the UniPOC software licenses and found out there were none. A sources sought was not issued because of the confirmation early on from Siemens that they have proprietary to the software/licenses and support.

7. Determination by the CO that the Anticipated Cost to the Government will be Fair and

Reasonable: The CO anticipates the cost to the Government to be fair and reasonable based on the IGCE and pricing that was obtain from the VISN 22’s current contract pricing being the same.
