JUSTIFICATION AND APPROVAL

FOR OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity: DLA Land Warren

2. Description of Action: The proposed action is to award a new contract with 100% option for Power Distribution Assembly (PDA) for the M95 Mortar Fire Control System (MFCS).

Competition will be limited to Quasar Power & Technologies Inc. DBA: Milpower Source (CAGE Code: 0B7R6). The contract is anticipated to be awarded to MILPOWER with an estimated value of utilizing Army Working Capital Funds (AWCF).

3. Description of Supplies/Services:

Estimated Unit price: This is the Last Acquisition Cost (LAC) from the Army’s Logistics Modernization Program (LMP).

The Power Distribution Assembly (PDA) takes power from multiple sources and conditions out a clean DC voltage that follows MIL-STD-1275 for use with the M95 MFCS that is installed within a given Mortar Gun vehicle variant (M1064/M1129/M1252/M1252A1/XM1297). The PDA provides the conditioned power to operate the M95 Pointing Device, Commander’s Interface computer or Fire Control Computer, Gunner’s Display, Driver Display, Global Positioning System (GPS) and other devices depending on the gun vehicle variant.

Acquisition Method Code (AMC): 3 – Acquire, for the second or subsequent time, directly from the actual manufacturer.

Acquisition Method Suffix Code: (AMSC): B - This part must be acquired from a manufacturing source(s) specified on a source control or selected item drawing as defined by the current version of DoD-STD-100. If one source is available, AMCs 3, 4, or 5 are valid. If at least two sources exist, AMCs 1 or 2 are valid.

7. Actions to Increase Competition:

No contractors are in the process of being qualified at this time, nor will be prior to the contract award due to funding constraints. Currently, there has not been any expressed interest by any known vendor(s) to become qualified source(s) to produce this item. Any new vendor who decides to pursue the qualification process will be directed to the CMO’s SAP.

8. Market Research:

The Systems Engineer for Mortar Fire Control System from Combat Capabilities Development Command – Armaments Center (CCDC-AC) performed market research by completing an internet search for same/similar items on August 22, 2019.

Utilizing online catalogs published by manufacturers, distributors, and dealers, and Army Contracting Command-New Jersey, no other / similar direct replacement Power Distribution Assembly was located. Only one existing contract for this item was able to be located. Results are as follows:

The component is a unique military item used with the M95 MFCS, which has no commercial equivalent. A review of the closest equivalent literature made available on-line by manufacturers, distributors, and dealers as of August 22, 2019 shows no commercial or non-developmental item that will satisfy the Army's requirement for the subject component. Some companies reviewed were EATON, IEM, TE, UEC Electronics, Littlefuse. None of these had the form, fit, or function necessary for use with the M95 MFCS.

9. Interested Sources:

A sources sought notice for this NSN was posted on December 2, 2019. To date, no sources have written to express an interest, nor has the Government identified any other source possessing an interest in being an alternate source for the item.

I hereby determine that the anticipated cost to the Government for this contract action will be fair and reasonable. This determination will be based on the results of a detailed cost and or price analysis. The expected value is below the certified cost or pricing threshold of $2 Million therefore FAR 15.403-3 Requiring Data Other Than Certified Cost or Pricing Data will apply. If an offer received is over $2 Million, the contractor will be required to submit certified cost and pricing data IAW FAR 15.403-4. This item is non-commercial.
