About this file

This justification and approval document relates to a sole source contract award for Commander's Interface Units to Raytheon. The Defense Logistics Agency Land and Maritime plans to award an indefinite delivery/indefinite quantity contract to Raytheon for 61 units initially and up to 122 units total. Raytheon owns the technical data rights for this component as the original equipment manufacturer. Reverse engineering would be required to introduce competition but is not currently feasible due to lack of funding and technical data packages. No other vendors have expressed interest in qualifying as an alternative source.

consistently. It is estimated to obtain competitive technical data that it would take two additional years and $2,000,000 after which a breakout contractor would need $1,000,000, a year to qualify, and an additional year for production. It should be noted that during this process, there is no guarantee that a breakout contractor’s process would be successful or result in suitable production items, or that the follow-on production would meet any deadlines. Additionally, qualification of another contractor does not guarantee a cost savings large enough to recover the various costs incurred in the processes of competition. At this time there are no alternative responsible contractors for this item.

6. Efforts to Obtain Competition: As addressed above, Raytheon owns all technical data rights for this component. Reverse Engineering is the only recourse the USG could entertain. No efforts to obtain competition for this acquisition will be taken for the reasons stated above.

Complete Level III TDPs, suitable for competition, are not available for purchase. Further, there is no funding to qualify a new vendor. There are no vendors currently in the process of being qualified. There are no current or planned efforts to qualify any additional sources for the reasons listed above, including the fact that there is no funding for this effort. The USG would not be able to conduct reverse engineering efforts at this time. Although this procurement will be restricted to the above source, every effort will be made to obtain potential sources by synopsis and posting to the FedBizOpps website. Interested sources can obtain approval via the Source Approval Program with the TACOM Competition Management Office (CMO).

7. Actions to Increase Competition: As stated in paragraph 5, there is no known effort under way or funding where by the supplies/services described in paragraph 3 for this proprietary item can be competed.

Contractors interested in becoming a source of supply need to meet the requirements of the Source Approval Program at their own expense. The TACOM Life Cycle Management Command, Competition Management Office (CMO), is the lead proponent for the Source Approval Program. While interested contractors can contact the CMO for assistance with the Source Approval Program, Engineering requires successful testing to support the approval of a new source of supply and the Government has no plans or funding to complete qualification testing at this time. To date, there has not been any expressed interest by any known vendor(s) to become qualified source(s) to produce this item.

8. Market Research: Computer based market research was conducted on 2/16/2018 for this item, “Part Number 12975896-2 (CIU)”. This search did not return any new sources of supply.

A sources sought synopsis was posted to FedBizOpps on 02/16/2018 via Sources Sought Notice 2018-291:

9. Interested Sources: To date no other known source has expressed interest in writing regarding the manufacture of this item. Interested contractors should contact the Source

Approval Program though the Competition Advocate's Office to become qualified for future procurements.

10. Other Facts:

a. Procurement history: Past procurement has been made to Raytheon:

Contract: DAAE2002G0003-0003 Award Date: 07 Mar 2006 Value: $23,627,977.00

b. Acquisition data availability: The Government does not own the build to print drawings and associated quality assurance data to the Commander’s Interface Unit needed to procure this item competitively. Raytheon is the original equipment manufacturer (OEM), and the sole approved source of supply.

c. Subcontracting Competition: The government will require the awarded contractor to subcontract with small business when possible.
