JUSTIFICATION AND APPROVAL
FOR OTHER THAN FULL AND OPEN COMPETITION
SPRDL1-22-R-0050
1. Contracting Agency: Defense Logistics Agency - Land Warren (DLA-WRN).
2. Description of Action: DLA-WRN proposes to award a new Five-Year Indefinite Delivery Indefinite Quantity, Long Term, Firm-Fixed-Price contract to Inertia Dynamics, LLC., Cage 3FPW5, for National Stock Number (NSN) 6110-01-685-1937, Brake, Elevation Drive, Government Part Number 13056311 / Manufacturer Part Number 1823- 1065, using Army Working Capital Funds (AWCF).
3. Description of Supplies/Services: The Brake, Elevation Drive, NSN 6110-01-685- 1937, Government Part Number 13056311 / Manufacturer Part Number 1823-1065 is used on the M109A7, 155MM Self-propelled M109A7 Paladin Howitzer. The contract will be for a maximum quantity of 63 each. The minimum guaranteed quantity is three
(3) each with an estimated annual quantity of between eleven (11) each and sixteen
(16) each. The total estimated maximum value of the contract is
Acquisition Method Code (AMC): 3 - Acquire, for the second or subsequent time, directly from the actual manufacturer.
Acquisition Method Suffix Code (AMSC): B - This part must be acquired from a manufacturing source(s) specified on a source control or selected item drawing as defined by the current version of DoD-STD-100. Suitable technical data, Government data rights, or manufacturing knowledge are not available to permit acquisition from other sources, nor qualification testing of another part, nor use of a second source part in the intended application. Although, by DoD-STD-100 definition, altered and selected items shall have an adequate technical data package, data review discloses that required data or data rights are not in Government possession and cannot be economically obtained. If one source is available, AMCs 3, 4, or 5 are valid. If at least two sources exist, AMCs 1 or 2 are valid.
4. Authority Cited: The statutory authority permitting other than full and open competition for this effort is 10 United States Code (U.S.C.) 2304(c)(1) as implemented by the Federal Acquisition Regulation (FAR) 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.
5. Reason for Authority Cited: The Brake, Elevation Drive is part of the elevation mechanism which operates the up and down motion of the gun. It holds the gun in place when the elevation is being changed and serves as a failsafe for the Elevation Mechanism Motor. The Static Break Torque is 27.3 N-MIN with a Maximum Speed of 3200 RPM. The Brake Operating Speed is 16 to 28 Volts Direct Current (DC) and is capable of rotation in either direction. The Brake is capable of operation +/- 15 degrees from Horizontal. Release time is less than or equal to 150 milliseconds throughout the entire operating voltage range. This item is a critical component of the M109A7 Paladin Family of Vehicles (FOV).

Schedule Delay Calculation:
Reverse engineering this motor would require an estimated delay of at least 18 months. Prototype testing & Analysis of Application Specific Design would take a minimum of 12 months to be completed. In addition, Development of Qualification Procedures and Requirements would require at least 12 months prior to releasing a validated competitive TDP. Moreover, it would take a minimum of 8 months to conduct Environmental Testing. Furthermore, the System Support Package and the logistical development would each require 8 months minimum to be completed. This brings the overall estimated schedule delay to 66 months. A delay of this extent is not acceptable.
6. Efforts to Obtain Competition:
a. Effective competition: Due to the reasons cited in section 5 above we are not pursuing competition for this item.
b. Subcontracting competition: Unless the contract is awarded to a small business, the solicitation and resulting contract will include FAR clauses 52.219-8, "Utilization of Small Business Concerns"; 52.244-5, "Competition in Subcontracting"; 52.219-16, "Liquidated Damages--Subcontracting Plan";" and Defense Federal Acquisition Regulation Supplement (DFARS) 252.219-7003, "Small Business Subcontracting Plan (DoD Contracts)," to maximize small business opportunities and utilization, and the successful contractor will be required to submit a Small Business Subcontracting Plan.
7. Actions to Increase Competition: There are no plans to increase competition for future procurements due to the reasons cited above. As stated in Section 6, the Government does not own the TDP information necessary to support a competitive procurement. There are no known funding efforts in progress at this time to qualify other suppliers of this item nor will there be prior to the contract award due to funding constraints – no funds are available to qualify additional sources given the cost and time involved. Since the total cost associated with reverse engineering and its associated efforts will not be recovered through a competitive procurement, the Government will not take any actions to increase competition.
8. Market Research: U.S. Army Combat Capabilities Development Command (DEVCOM) Armaments Center (AC) engineer conducted market research on 3/14/2022. This engineer has performed an internet search on NSN Now, and Ability One websites for part number 13056311. The searches revealed that this customized military part is not available from any other sources.
