About this file

This document provides a justification for other than full and open competition for solicitation SPE7LX-23-R0068 from the Defense Logistics Agency Land and Maritime. The solicitation is for five injector assembly national stock numbers used in Isotta Fraschini diesel engines that power Littoral Combat Ships and Avenger Class Mine Countermeasures Vessels. The justification is that the Government does not physically possess or have rights to sufficient technical data to purchase these items from any source other than the approved manufacturer, Isotta Fraschini Motori Spa (CAGE A0106), as this company is the original equipment manufacturer and only source with the required technical data and manufacturing expertise. The agency will continue market research efforts and supplier engagement initiatives to identify additional potential sources if feasible.

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

SOLICITATION SPE7LX-23-R0068

DLA Land & Maritime Justification for Other Than Full & Open Competition or technical data that are not economically available to the Government, and the data or knowledge is essential to maintaining the quality of the part. An alternate source must qualify in accordance with the design control activity's procedures, as approved by the cognizant Government engineering activity.

The qualification procedures must be approved by the Government engineering activity having jurisdiction over the part in the intended application. If one source is approved, AMCs 3, 4, or 5 are valid. If at least two sources are approved or if data is adequate for an alternate source to qualify in accordance with the design control activity's procedures, AMCs 1 or 2 are valid.

[X] AMSC D. (NSNs 2930-15-179-8741 and 5331-15-180-0624) The data needed to acquire this part competitively is not physically available, it cannot be obtained economically, nor is it possible to draft adequate specifications or any other adequate, economical description of the material for a competitive solicitation. AMCS 3, 4, or 5 are valid.

[X] AMSC Q. (NSNs 4320-15-010-6700 and 4820-15-019-8670) The Government does not have adequate data, lacks rights to data, or both needed to purchase this part from additional sources. The Government has been unable to economically buy the data or rights to the data, although the part has been undergoing full screening for 12 or more months. Breakout to competition has not been achieved, but current, continuing actions to obtain necessary rights to data or adequate, reprocurement technical data indicate breakout to competition is expected to be achieved. This part may be a candidate for reverse engineering or other techniques to obtain technical data. All AMSC Q items are required to be reviewed within the timeframes cited in 2-203(b). If one source is available, AMCs 3, 4, or 5 are valid.

If at least two sources exist, AMCs 1 or 2 are valid.

[X] Other: Per the approved manufacturer parts list for these NSNs in SAP (as received from the Defense Logistics Information Service), the following CAGE is the only source that has been identified as having the proper and complete technical data and manufacturing expertise to supply these items to DLA and the using military services: Isotta Fraschini Motori Spa (A0106).

The five NSNs on this project belong to end items that are specifically designed for Isotta Fraschini’s diesel engines. The Littoral Combat Ships use four 750-kilowatt V1708 diesel engine generators that are only designed and manufactured by Fincantieri Isotta. The Avenger Class Mine Countermeasures Vessels are equipped with four ID 36SS6V diesel engines that are only designed and manufactured by Isotta Fraschini. Therefore, the approved parts must be procured so the engines work properly.

A technical review in support of a potential LTC was performed on November 17, 2022. DLA Land and Maritime Product Specialist, SAPD-FLD, reviewed the technical information and certified it as accurate and complete. On June 20, 2023, the Product Specialist reviewed these items and considered them commercial. The Product Specialist certified that the Government does not physically have in its possession sufficient, accurate, or legible data to purchase this item from another source other than the one listed above and that all means to obtain a technical data package Adequate for manufacture of the item have been exhausted.

11. The following actions are being taken to identify additional sources:

[X] Solicitation contains DLA Procurement Note, L04 Offers for Part Numbered Items [X] Solicitation contains DLA Procurement Note, M06 Evaluation of Offers for Part Numbered Items [ ] VE Bailment Program [ ] Source Development Review [ ] Reverse Engineering [X] Other

The Government will continue to conduct market research to ascertain if changes occur in the marketplace that would enable future actions for this item to be competitive.

In an effort to encourage participation by manufacturers in the acquisition process and to help decrease barriers for companies looking to become sources of supply, DLA Land and Maritime hosts Captains of Industries bringing in industry leaders for particular commodities or weapon systems. DLA, depending on budget allowance, also holds supplier conferences.
