JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

JUSTIFICATION

1. Contracting Activity

The Naval Sea Systems Command, Undersea Systems Contracts Division, NAVSEA 026.

2. Description of the Action Being Approved

The Navy intends use other than full and open competition to modify the current Sopheon Corporation purchase order number N00024-16-P-6645 to acquire cloud hosting services in support of the pilot program for “Enterprise Management Software” ( ) which consists of ten (10) Sopheon Accolade Roadmapping software user licenses, currently held by Team Submarine Program Executive Office under the existing purchase order.

3. Description of Supplies/Services is leading the development of the Plan ( ) and SEA 073 supports this plan by providing and managing the . The Sopheon Accolade Roadmapping software will be used to develop the technology “roadmap” for these plans which defines the technology for submarines. To be functional, the Sopheon Accolade software must be migrated to a cloud hosted environment.

To comply with applicable policy and regulation, the cloud hosting services must be implemented on a Federal Risk and Authorization Management Program (FedRAMP) approved hosting environment, within a commercially available infrastructure, and pursuant to Information Assurance (IA) requirements. In order to meet Navy requirements to implement , a cloud hosted test environment must be completed by 30 November 2017 and the pilot program of the full operational hosting services of the Sopeheon Accolade software to the cloud shall be implemented no later than to meet technology development efforts for the ) submarines.

4. Statutory Authority Permitting Other Than Full and Open Competition

10 U.S.C. 2304(c)(1), only one responsible source and no other supplies or services will satisfy agency requirements.

5. Rationale Justifying Use of Cited Statutory Authority

This acquisition is conducted under the authority of 10 U.S.C.

2304(c)(1), as implemented by FAR 6.302-1(a)(2)(ii). Sopheon is the only responsible source capable of satisfying NAVSEA’s requirements and award to any other source would result in unacceptable delays.

As the developer of the Accolade software and incumbent contractor, Sopheon has the unique capability of transferring the proprietary Accolade licenses from the data center server to the cloud, while monitoring and taking any corrective actions if the software malfunctions in any way. As the developer of the software, Sopheon has the specific and special knowledge of the technical parameters to expediently implement the user interface and back-end changes required to migrate the software to a cloud hosting environment. The web enabled access will allow Team Submarine to transform strategic technology development planning from an annual event into a continuous process.

The test environment Sopheon is providing is part of a pilot program that SEA073 is running to implement EIM software in support of and ) technology development portfolio. This test environment will run concurrenly with the production environment, in order to provide a safe and secure place to correct any failures or malfunctions that may occur in production. This will ensure that the end user is not affected by any unexpected or unintended results that may occur while problem solving. Sopheon is the only source which can provide the cloud hosting test environment by and concurrently complete the migration of the Accolade software to an operational cloud hosted environment no later than .

Awarding this contract to any other source would result in unacceptable delays. In order to do so, a competitive contracting action would need to take place. Competing this action would extend the implementation of the cloud hosted services to a date that would not meet the Navy’s needs. Team Submarine estimates that the impact of competing this effort would result in a delay of up to sixteen months. This duration is based on the competitive procurement lead time (ten months), the vetting and designation of an authorized cloud-hosting provider (three months) and the Information Assurance (IA) certification period, necessary to host and start the testing environment (three months). These actions must be performed consecutively, with the inability to overlap the actions. Furthermore, in order to compete the effort, the Navy will have to analyze the Accolade software and establish the technical parameters necessary for the migration. To do so will require an unknown amount of time and further delay the schedule.

Any delay in the operational hosting services of the Sopheon Accolade software to the cloud would adversely impact Team Submarine’s ability to sequence and align technology development efforts to support submarines.

Any delay will limit advanced technology implementation and the ability to improve strategic alignment of research and development priorities across the portfolio.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable

The proposed contract action was synopsized on the Federal Business Opportunities website on 13 September 2017. No responses or expression of interests were received.

Concurrently, the Contract Officer posted a sources sought notice requesting capability statements from responsible businesses capable of providing cloud hosting services. NAVSEA received seven submissions in response to this notice. Team Submarine’s review of these submissions found that only four had the proper FedRAMP and DISA IL4 certifications and none of the sources would have been capable of migrating the Accolade Software and providing an operational production environment by , due to the time necessary for the competitive procurement lead time, the vetting and designation of an authorized cloud-hosting provider, the Information Assurance (IA) certification period, and the development of the necessary technical parameters for the migration(See paragraph number five above).

7. Determination of Fair and Reasonable Costs

The Contracting Officer has determined that the anticipated cost to the Government for the supplies/services covered by the J&A will be fair and reasonable. Similar commercial cloud hosting services have comparable pricing.

8. Actions to Remove Barriers to Competition

Upon the successful conclusion of this pilot program, the follow-on effort shall be the responsibility of Space and Naval Warfare Systems Command (SPAWARSYSCOM) as an Enterprise Information System. Any follow-on cloud hosting services associated with the effort identified herein shall be handled under a full and open competition. The overall decision making schedule of this pilot program, to either continue on with enterprise wide, competitively awarded contracts or discontinue the program, is 36 months, as follows:

Decision Point Estimate Date Test Certification/ Start of Pilot Program End of Pilot Program Assessment Final Enterprise Information System decision April 2020 Release competitive Accolade cloud hosting solicitation(s)

May 2020

Award of competitive cloud hosting contract October 2020
