JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity.
Naval Air Warfare Center, Aircraft Division (NAWCAD) Lakehurst, NJ
2. Description of the Action Being Approved.
This Justification and Approval (J&A) authorizes and approves the procurement of various brand name Audio Visual (AV) Video Teleconference (VTC) equipment NAWCAD Webster Outlying Field (WOLF) Command’s Integrated Command, Control and Intel Systems (IC2&IS) Network Engineering and Operations Center Branch. The brand name AV VTC equipment comes from the following manufacturers: AEQ; Alpha American; American Fibertek, Inc. (American Fibertek); Amino Communications (Amino); American Power Conversion Corporation Doing Business As (DBA) Schneider Electric USA, Inc. (APC); Artel LLC (Artel); Atlas Innovative Electronic Designs LLC (AtlasIED); Audio-Technica U.S., Inc. (Audio-Technica); AVP Manufacturing & Supply, Inc. (AVP); Biamp Systems LLC (Biamp); Blackmagic Design Pty. Ltd. (Blackmagic); BRG Precision Products, Inc. (BRG); Channel Master; ClearOne Communications, Inc. (ClearOne); Clock Audio; Cobalt Digital, Inc. This procurement will support the NAWCAD WOLF Command’s integration of specialized AV VTC systems supporting Intelligence Agencies and the Command, Control, Communications, Computers, Cyber, Intelligence, Surveillance and Reconnaissance (C5ISR) missions of Joint Staff and Combatant Commanders, Department of Defense (DoD) Agencies and Services, and Department of Homeland Security operational and support components. This equipment will be procured via full and open competition between authorized resellers. The resulting contract will be a three year Indefinite Delivery Indefinite Quantity (IDIQ). There is a minimum quantity of 10 AV VTC equipment parts, and a maximum quantity of 23,786 AV VTC equipment being procured. A list of the AV VTC equipment from the brand name manufacturers can be found on Attachment 001 of this J&A. Delivery orders will be issued on a Firm Fixed-Price basis.
3. Description of Supplies/Services.
The NAWCAD WOLF Command’s Integrated Command, Control and Intel Systems (IC2&IS) Division engineers, design, and deliver specialized AV VTC communication systems supporting Intelligence Agencies and C5ISR missions to Joint Staff and Combatant Commanders, DoD Agencies and Services, and Department of Homeland Security operational and support components requiring specialized communication capabilities for global information operations. These systems are typically used in command centers, operation centers, conference rooms, and classrooms. 4. Statutory Authority Permitting Other Than Full and Open Competition.
10 U.S.C. 2304(c)(1), FAR 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements.
5. Rationale Justifying Use of Cited Statutory Authority.
XXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXX XXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXX. This combination includes compliance with the DoD Information Network Approved Products List, intelligence community cybersecurity policies, National Information Assurance Partnership (NIAP) Common Criteria, and inclusion on various Intelligence Agency Approved Products Lists.
The requested brand name AV VTC equipment has been evaluated using Common Methodology for Information Technology Security Evaluation (version 3.1) for conformance to the Common Criteria for Information Technology Security Evaluation (version 3.1). XXXXXXXXXXXXXX XXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXX XXXXXXXXXXX. The Approved Products List and other relevant authorization dates for equipment on this Contract will be identified at the time of delivery order due to the numerous intelligence agencies, Joint Staff and Combatant Commanders, DoD Agencies and Services, and Department of Homeland Security operational and support components whose requirements for AV VTC communications systems will be supported with delivery orders under this IDIQ.
The requested brand name AV VTC equipment is also the only known combination of equipment compatible with the proprietary Government owned custom AV VTC control software utilized by the NAWCAD WOLF Command to deliver these specialized systems. Each AV VTC system is managed/operated by an existing control subsystem that is tailored for the specific combination of AV VTC equipment, the quantity and classification level of the video inputs, and the operational needs of the user. The user operates the AV VTC control subsystem via a touch panel; this panel is provided with the proprietary Government custom software installed and tailored to the user’s system. The requested brand name AV VTC solution includes only manufactured equipment compatible with the existing proprietary Government custom control software.
XXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXX XXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXX XXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXX XXXXXXXXXX. The use of a common set of equipment reduces costs for engineering and technical support staff, the cost of spare parts inventories, the volume and cost of providing software updates, and the complexity of the technical documentation for these systems. Any changes to the selected AV VTC solution components would cause changes to the numerous equipment interfaces in this complex system, and thus would require engineering re-design of the overall system. Component changes would also require major updates to the proprietary Government owned control software and retesting of the systems. Alternating any vendor, technology, make and/or model, or programming would cause unwarranted duplicative cost to the Government. Modifying the mature architecture would require engineering re-design, additional software programming, additional cybersecurity equipment testing, additional network security documentation, and additional training. Each change to an equipment manufacturer is estimated to result in duplicative costs of XXXXX, which includes the following: XXXXX for additional compatibility testing and cybersecurity testing, XXXXX to update the custom control software code, XXXXX for training on the different equipment, and XXXXX for engineering re-design and documentation updates. A change to the manufacturer for all of the requested equipment is estimated to result in XXXXX interface variations resulting in duplicative costs totaling XXXXX that would not otherwise be recovered through competition.
The efforts required to change the selected brand name AV VTC solution components would also delay XXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXX XXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXX XXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXX XXXXXXXXXXXXXXXXXXXXX.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
Market research was conducted to identify commercially-available AV VTC equipment. Multiple solutions were identified and reviewed to determine each solution's ability to meet the requirements. Of the manufacturers identified in the market research, only the requested AEQ, Alpha American, American Fibertek, Amino, APC, Artel, AtlasIED, Audio-Technica, AVP, Biamp, Blackmagic, BRG, Channel Master, ClearOne, Clock Audio, Cobalt Digital, Crown Audio, Cybex, Denon, Dish, DX Engineering, ESE, Foxcom, GEFEN, GPO Display, JBL, Klipsch, KSI, Lab Gruppen, L-Com, Lynx, Mohu, Perfect Vision, PureLink, QSC, Rack Solutions, RGB Spectrum, Ross Video, Serial Comm, Sescom, Shure, Sound Tube, Stewart Audio, Tannoy, Tripp Lite, and Vetra brand name AV VTC equipment provided solutions that meet the requirements without duplicating costs.
Further market research was conducted to identify vendors capable of providing the AV VTC equipment required for the IC2&IS AV VTC system. Each of the required manufacturers were searched via the National Aeronautics Space Administration Solutions for Enterprise Wide Procurement V and General Services Administration (GSA) websites to identify potential resellers of the required equipment. GSA Advantage was searched by all part numbers; however, not all parts were available through GSA Advantage. Required sources, such as National Stock Number Inventory, were also checked; however, there was not enough inventory to satisfy the request of this procurement.
Based on the market research performed, it is the Government's intention to issue a solicitation on SAM.gov to award a single IDIQ contract for the required AEQ, Alpha American, American Fibertek, Amino, APC, Artel, AtlasIED, Audio-Technica, AVP, Biamp, Blackmagic, BRG, Channel Master, ClearOne, Clock Audio, Cobalt Digital, Crown Audio, Cybex, Denon, Dish, DX Engineering, ESE, Foxcom, GEFEN, GPO Display, JBL, Klipsch, KSI, Lab Gruppen, L-Com, Lynx, Mohu, Perfect Vision, PureLink, QSC, Rack Solutions, RGB Spectrum, Ross Video, Serial Comm, Sescom, Shure, Sound Tube, Stewart Audio, Tannoy, Tripp Lite, and Vetra brand name AV VTC equipment. In accordance with FAR Part 12, Streamlined Acquisitions for Commercial Items, a combined synopsis/solicitation will be posted.
7. Determination of Fair and Reasonable Cost.
The Contracting Officer has determined the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable.
8. Actions to Remove Barriers to Future Competition.
At this time, AEQ, Alpha American, American Fibertek, Amino, APC, Artel, AtlasIED, Audio-Technica, AVP, Biamp, Blackmagic, BRG, Channel Master, ClearOne, Clock Audio, Cobalt Digital, Crown Audio, Cybex, Denon, Dish, DX Engineering, ESE, Foxcom, GEFEN, GPO Display, JBL, Klipsch, KSI, Lab Gruppen, L-Com, Lynx, Mohu, Perfect Vision, PureLink, QSC, Rack Solutions, RGB Spectrum, Ross Video, Serial Comm, Sescom, Shure, Sound Tube, Stewart Audio, Tannoy, Tripp Lite, and Vetra are the only known manufacturers that offer products which meet the Government’s requirements. The NAWCAD WOLF Command will continue to monitor the market for technological advances that may drive changes to the system design and potentially increase competition.
