About this file
This justification and approval document seeks a sole source award to procure a Chevalier horizontal slant bed lathe and related accessories from Chevalier Machinery Inc. to replace an existing lathe damaged by flooding at the Naval Surface Warfare Center Carderock Division facility. The lathe is required to resume work on several ongoing Naval Sea Systems Command projects. A sole source award is justified because only the same make and model will be compatible with the facility foundation and spare parts on hand. The solicitation will be posted on beta.SAM.gov and seeks pricing for the lathe, holder, rear chuck, coolant system, leveling wedges, and installation/acceptance services. Quotes are due by April 14, 2021 with award planned shortly after.

JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL & OPEN COMPETITION
JUSTIFICATION
1. Contracting Activity
Naval Sea Systems Command (NAVSEA), Naval Surface Warfare Center Carderock Division
(NSWCCD), Contracting and Acquisitions Department, Code 02.
2. Description of the Action Being Approved
NSWCCD is seeking to award a purchase order on a brand name basis, for the acquisition of the following materials: one (1) Chevalier horizontal slant bed lathe; one (1) holder; one (1) rear chuck; one (1) 300 PSI coolant system , 15 leveling wedges, and services for installation, demonstration and acceptance. This is in support of replacing the same make and model of machine previously used at NSWCCD’s facility that sustained damage from a flash flood. The damage to the machine was beyond cost-effective repair.
This justification document is in accordance with FAR 13.501(a).
The requirement will use the combined synopsis and solicitation procedure set forth in FAR
12.603, and the notice will be posted to the beta.SAM.gov website. The total estimated value of this acquisition is approximately $ .
The action contemplated with this justification is a firm-fixed price (FFP) purchase order.
3. Description of Supplies/Services
The FBL-530A MC slant bed lathes are highly accurate machines that will handle rough and fine tuning operations for large work pieces. The items to be procured are as follows
Part # Description Quantity
1. FBL-530 A MC Horizontal Lathe 1
2. 3" U holder 1
3. . Rear chuck adapter 28" max chuck 1
4. . 300 psi coolant pump and hoses 1
5. . Leveling wedges 15
6. Services Installation, Demo, Acceptance 1 lot
Original Equipment Manufacturer:
Chevalier Machinery Inc.
9925 Tabor Place Santa Fe Springs, CA 90670 562-903-1929
The total estimated value of this acquisition is approximately $ .
4. Statutory Authority Permitting Other Than Full and Open Competition
10 U.S.C. 2304(c)(1) . “The property or services needed by the agency are available from only one responsible source or only from a limited number of responsible sources and no other type of property or services will satisfy the needs of the agency.” (FAR 13.106-1(b)(2))
5. Rationale Justifying Use of Cited Statutory Authority
Use of this make and model of machine is critical to several ongoing NAVSEA projects worked on at NSWCCD’s facility using this machine. The non-operational status of this machine has caused
NSWCCD to pause these NAVSEA projects, adversely affecting NSWCCD’s ability to meet the required project timelines for each project. It is critical that NSWCCD procure a new machine of the same make and model, in order to resume work on these projects as soon as possible.
Acquiring the same make and model of machine that was previously in place in the Agency’s facility precludes any need for the Agency to modify the foundation of the facility to match the new machine’s footprint. Every make and model of machine has specific foundation requirements, which correspond with the proper installation of each machine. These foundation requirements customarily include the foundation area required for the new machine based on the machine dimensions; the subfloor requirement necessary to support the machine based upon the machine’s weight; and the number of anchors required to properly secure the machine to the new foundation. Skipping or overlooking the matching of the foundation of the facility to the specifications of the machine will adversely affect the operational capabilities of the machine.
In order to properly level the machine, the Agency must install the machine on a foundation that meets the machine’s foundation specifications. An improperly balanced machine will not function properly, making it impossible to manufacture products that meet the required specifications that
NAVSEA needs. Additionally, if the subfloor foundation requirements are not adhered to, the weight of the machine may cause the foundation of the facility beneath the machine to crumble, resulting in the machine becoming unbalanced, and negating the machine’s designed capability.
By acquiring the exact same make and model of machine, the Agency will not need to execute the extensively detailed, time-consuming and costly step of accommodating the foundation of the facility to a different make and model of machine. Removal of the current foundation and installation of a new foundation could cost an estimated $ .
Additionally, during the time span when the machine was operational, NSWCCD acquired and still maintains spare parts, components and accessories for this make and model of machine.
Acquisition of a different machine would render these parts, components and accessories useless. The replacement of these accessories would cost an estimated $ .
Moreover, NSWCCD has trained its personnel to operate this make and model of machine.
Because NSWCCD personnel are intimately familiar with this particular make and model of machine, it is important that the Agency procure the same make and model of machine to maintain continuity, timeliness, and quality for production support. The acquisition of a new make and model of machine will require the retraining of NSWCCD personnel assigned to use the machine, resulting in additional costs incurred by the Agency, as well as significantly impacting the Agency’s ability to finish the projects currently paused.
Therefore, in accordance with FAR 13.106-1 (b)(1)(i), it has been determined that the circumstances of this contract action deem this brand name procurement reasonable.
Should NSWCCD procure a different brand of slant bed lathe other than Chevalier, the procurement would result in (a) substantial duplication of costs to the Government, which would not be recovered through open competition of minimum specifications and (b) unacceptable delays in replacing the FBL-530A MC Heavy-Duty, Slant-Bed, CNC Lathe with Live Tooling.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable
NSWCCD intends to issue a combined synopsis/solicitation pursuant to FAR 12.603, and the notice will be posted to the beta.SAM.gov website.
7. Determination of Fair and Reasonable Cost
In accordance with FAR 15.402, the Procuring Contracting Officer (PCO) shall ensure that all supplies and services provided under this contract are procured at a fair and reasonable price.
The PCO shall determine that the anticipated contract represents the best value (as defined in
FAR 2.101), and results in the lowest overall cost alternative (considering price, special features, administrative costs, etc.) to meet the Government’s needs. The PCO will use past procurements from the Navy and other Department of Defense (DoD) agencies that have acquired the lathe.
This includes contract number N0016717P0093, a solicitation competed on minimum specifications, which resulted in the purchase of the machine that was damaged by flooding.
This information will form the basis for negotiating a fair and reasonable price.
8. Actions to Remove Barriers to Competition
The Government will continue to canvass the machining industry (via symposiums, conferences, RDT&E Testing) for advancements in the battlefield dosimetry technology. If the capability of the lathe technology changes, the Government will reexamine future needs and applications. The Government intends to maintain open communication with the lathe industry as the needs of the Government evolves with technological advances.
