About this file
This justification and approval document allows for a sole source award of a construction contract to upgrade the direct digital control system at the Mississippi Air National Guard Combat Readiness Training Center. The project requires replacing and upgrading hardware, firmware, and software of the existing Siemens Insight Revision 3.10 direct digital control building automation system and utility monitoring control system. Siemens is the sole provider of parts compatible with the current Siemens system. The justification cites that using Siemens products is necessary to ensure seamless integration with the existing Siemens equipment. The contracting office must receive any responses by July 14, 2021. The anticipated cost is determined to be fair and reasonable based on previous similar contracts.

MISSISSIPPI AIR NATIONAL GUARD
GULFPORT CRTC – BATTLEFIELD AIRMEN CENTER
4715 HEWES AVENUE
GULFPORT MISSISSIPPI 39507
13 May 2021
MEMORANDUM FOR NGMS-PFC
ATTN: Mr. David Ogelsby
FROM: ANG CRTC-Gulfport/CE 4600 Hewes Ave., Bldg. 132, Gulfport, MS 39507-4321
SUBJECT: Justification and Approval for Other Than Full and Open Competition
1. Contracting Activity: Combat Readiness Training Center (CRTC)
2. Description of the Action: This action is to award a firm fixed price (FFP) contract for construction services to upgrade the DDC System Basewide at CRTC. Type of funds: SRM.
3. Description of the supplies and services: Requirement is to provide labor, tools, parts, materials, facilities, and transportation necessary to upgrade the existing DDC System. The base bid of this project includes, but not limited to, replacing and upgrading hardware, firmware, and software of the base-wide direct digital control (DDC) building automation system (BAS) and utility monitoring control system (UMCS) and incidental related work as annotated in the attached plans and specifications. Siemens is the sole provider for these and parts replacement of the current DDC system. The existing DDC brand is SIEMENS Insight Revision 3.10. Scope of work consists of removing part of the existing SIEMENS DDC system and installing a new/replacement parts as necessary with coordinating SIEMENS equipment and rework current parts for reuse within this same DDC System.
4. Authority Cited: DFARS 206.302-1(c)(2); Only one responsible source and no other supplies or services will satisfy agency requirements.
5. Reason for Authority Cited: For facility construction, providing “brand name or equal” requirements effectively and efficiently communicates the Government’s requirements to vendors. Removing brand names entirely would be an injustice to both customer and supplier, and would not be cost effective. DDC System would have to be replaced in its entirety should another contractor with a different manufacturer be awarded this effort. However, competition is not limited. Market Research indicates there are several authorized Siemens distributors capable of providing this necessary maintenance. There is also the Prime contractor, Subcontractor relationship that allows for this requirement to be offered to an 8(a) thus ultimately enhancing the Government’s goal of small business 8(a) award. This information is available in the Market Research Report.
6. Efforts to Obtain Competition: N/A
7. Actions to Increase Competition: N/A
8. Market Research: Researched through conversations with architects, engineers, general contractors, and vendors. General contractors and vendors affirmed that “brand name or equal” requirements provide a clear frame of reference in communicating the Government’s needs.
However, this requirement must be Siemens products to work seamlessly with the existing Siemens products. This requirement is not for a full replacement. Market Research indicates there are sufficient small businesses authorized by Siemens to provide the product and services for this requirement. But due to time restraints and to enhance the 8(a) business community, this requirement was offered to SBA as a sole source 8(a).
9. Interested Sources: Yes, a small business 8(a) firm was offered to the Small Business administration for which they provided an acceptance letter was received in July of 2020. The recommended business is familiar with CRTC, Government contracting processes and the Siemens DDC System.
