About this file

This document is a justification and approval for a sole source contract award. Naval Oceanographic Office (NAVOCEANO) requires sonar program support services for sonar systems and related equipment aboard its T-AGS 60 class ships and Hydrographic Survey Launch boats operating worldwide. The estimated 6-month contract value for installation, dockside verification, at-sea testing and validation, and training is . Kongsberg is the sole source as it is the original equipment manufacturer of the proprietary sonar technologies, and no other contractor has rights to or capabilities to maintain the specialized equipment requiring proprietary data access and specialized training. Two request for information notices did not identify any other company able to provide the needed services. The contract was awarded sole source to an unknown vendor on September 23, 2020.

4. IDENTIFICATION OF STATUTORY AUTHORITY:

10 U.S.C. 2304(c)(l); as implemented by Federal Acquisition Regulations (FAR) 6.302-1 only one responsible source and no other supplies or services will satisfy agency requirements.

5. RATIONALE JUSTIFYING USE OF CITED STATUTORY AUTHORITY:

Kongsberg is the sole designer and manufacturer of the various proprietary sonar and sonar support systems that are installed and in operation onboard NA VOCEANO ships and HSLs worldwide. As Kongsberg is the original equipment manufacturer (OEM) of the sonar systems, and they are proprietary technology of Kongsberg, neither the government nor any other contractor has rights to this technology. Sonar equipment, including deep sea sonar, is highly specialized equipment that requires specialized training, expertise, and access to proprietary data in order to maintain, repair, and manufacture.

Only Kongsberg can provide the services due to the highly specialized equipment that requires specialized training, expertise, and access to proprietary data. Therefore, the government cannot perform the required services and no other company has been identified that can provide the required services.

6. DESCRIPTION OF EFFORTS MADE TO SOLICIT OFFERS FROM AS MANY

OFFERORS AS PRACTICABLE:

A general description request for information (RFI) N0018920QQDSS was publically posted to the Government Point of Entry (GPE) in October 2019 to identify companies within the underwater sonar, including deep-sea sonar, industry and their capabilities. Out of the nine responses received, no company was identified to have the ability to provide or perform the required services. A second, requirement specific, RFI was posted to the GPE from January 28, 2020 to February 4, 2020. No interest was expressed in this requirement during the period it was posted.

7. DETERMINATION OF FAIR AND REASONABLE COST:
