Specific characteristics of the material or service that limit the availability to a sole sourcebrand product unique: On
exclusion of other sourcesbrands: SWRMC Code 330, requires replacement parts for the shop's 15, 20 and 60 ton crane to support USS COMSTOCK LSD-45 CNO avail scheduled to start on The parts must come from the Original Equipment Manufacturer (OEM). Although, the parts are not unique in physical appearance, they must be manufactured by the Original Equipment Manufacturer (OEM) LAKE SHORE SYSTEMS INC to ensure they meet the designed specifications as required by the Navy standards specifications.
LAKE SHORE SYSTEMS INC is the Original Equipment Manufacture (OEM), and is the only company with the capability to meet one or more of the critical elements as required per the Navy Standards specifications. As, the various parts supports the specific 15, 20 and 60 ton crane; therefore, the required items/ parts must be compatible in all aspects (form, fit and function) with the existing crane.
As such, it is imperative the Government go directly to the OEM company, whom attains the knowledge, and expertise in producing these specific parts, as they obtain all proprietary rights to all materials, drawings, and equipment associated with the required parts. (See OEM sole source letter) LAKE SHORE does not have any authorized distributors for the above-mentioned various crane parts.
The OEM parts require and must be ordered now to be ready for use in support of the upcoming ship maintenance availability commencing on

connect or interface with the existing system: The Class LSD/s parts are strictly designed, installed and designated per NAVSEA DWG, and per NAVSEA TECH MANUALS (TM) listed by Work
Item WI# 589-11-002 TM SG811-AV-MMA-010 Rev 5, Topside Crane, 15, 20 and 60 Ton. The replacements must have the same function to ensure it's compatibility in all aspects (form, fit, and function) with the existing systems presently installed, which are manufactured by the OEM LAKE SHORE SYSTEMS INC.
Furthermore, due to the proprietary nature of these items, the required parts can only be obtained from the OEM; in which, is the only company that can provide the required parts as set forth above.

The items are direct replacement partscomponents for existing equipment Provide the information about the Next: LAKE SHORE SYSTEMS INC has the proprietary rights to equipment, parts, and drawings that are affiliated with 15, 20 and 60 ton crane.

Original Equipment Manufacturer OEM etc: Items listed are direct replacement parts for the 15, 20 and 60 ton crane and these parts are proprietary to the OEM LAKE SHORE SYSTEMS INC.
Thus, LAKE SHORE SYSTEMS INC. is the only company that manufacturers direct replacements for these specific parts and is compatible in all aspects (form, fit, and function), with the existing system that is presently installed.

unacceptable delays in fulfilling the mission of the agency: Both the maintenance team and Code 500 conducted market research on the various crane parts and discovered the various parts do not have navy stock numbers (NSN) and only have part numbers and verified that LAKE SHORE SYSTEMS INC is the OEM and owns all the proprietary rights to all parts, materials, drawings, and equipment.
Thus, both the Contract Specialist and Contracting Officer have determined that the circumstances of this action would result in a substantial duplication of cost that could not be recovered through competition if the agency does not move forward with a sole source procurement for the various crane parts. The Government would incur duplicate costs for research and development, ship alt expenses, and expense in time and effort for solicitation, competition, and evaluation.
Furthermore, in the event the various crane parts are not procured through LAKE SHORE SYSTEMS INC, the Government will experience significantly unacceptable delays in fulfilling the Navy's mission. SWRMC would be at a high risk for on time delivery being unable complete the repairs required during the ship availability due to prohibitive delay for the required research and development, ship alt, and time and effort for solicitation, competition, and evaluation.
Lastly, in accordance with FAR 13.106-1(b), the contracting officer deems only one source is reasonably available. Moreover, procurement of this product from any other source would result in substantial duplication of costs to the Government that could not be recovered through competition because the Government would be required to purchase an entirely new system.
