About this file
This document is a justification and approval for using other than full and open competition to award a sole source contract. The Military Sealift Command requires original equipment manufacturer Lakeshore Systems, now known as Trident Maritime Systems, to provide spare parts for stem ramps used on T-EPF class ships. The parts include sheaves, cables, and cylinders and will be acquired under request for quotation number N3220523Q2120. As the historical OEM and only source with access to proprietary technical data and expertise to provide directly interchangeable parts, Lakeshore Systems is the only responsible source that can meet the agency's needs to ensure system reliability and prevent failure. While MSC seeks submissions from non-OEM contractors for qualification, no other potential sources for these engineered, ship critical safety items have been identified at this time. The contracting officer determined the anticipated sole source price will be fair and reasonable.

5. Rationale Justifying Use of Cited Authority: Lakeshore Systems is the historical OEM for these items.
Lakeshore Systems, also known as Trident Maritime Systems - Heavy Equipment Group, is the authorized OEM and the only source capable of providing the required parts to replace the spare parts as required for the T-EPF Class. The existing stem ramps are complex and engineered to specifications that only Lakeshore Systems would have access to at this time. The stem ramps are designated as a ship critical safety item by the design control activity as identified in COMSCINST 4490.l(Series). Only Lakeshore Systems, also known as Trident Maritime Systems - Heavy Equipment Group, has access to proprietary technical data and has the expertise to identify and provide direct replacement parts, which must be compatible in terms of form, fit, and function with existing equipment or configurations. This ensures equipment reliability. Deficient parts could cause system failure.

The Government intends to post a sole source combined synopsis and solicitation notice along with this justification at the Government Point of Entry with the intent of awarding a firm-fixed- price purchase to the sole source provider.
7. Determipatiop of Fair apd Reasopahle Cost: The Contracting Officer has determined the anticipated cost to the Government of the supplies covered by this J&A will be fair and reasonable IAW FAR 13.106-3(a).
8. Actjops to Removed Barrjers to Future Competjtjop: For reasons set forth in paragraph 5, MSC has no plans at this time to allow for non-OEM suppliers in future contracts or purchase orders for the types of supplies covered by this document. If another potential source emerges, MSC will assess whether competition for future requirements is feasible.
