About this file

This document is a Justification and Approval (J&A) for a limited/sole source procurement (N50054-24-119) related to ship repair and alteration work on the USS JAMES E. WILLIAMS (DDG-95). The work is required to be performed by General Dynamics NASSCO-Norfolk, the lead subcontractor, under the existing contract N00024-23-C-4424 awarded to General Dynamics NASSCO-San Diego. The work includes evaluating proposed access cuts, alignment checks, and recommendations for removing and installing new chiller equipment as part of Ship Alteration DDG51-95153. The J&A states that NASSCO-Norfolk is the only company able to perform this work, as it must be integrated into the current dry-dock availability. The contracting officer has determined the anticipated costs to be fair and reasonable based on historical data and the Independent Government Estimate. The related federal contract opportunity is for the RCC 505N work item on the USS JAMES E. WILLIAMS (DDG-95), which was awarded to an unknown vendor on November 18, 2024.

5. RATIONALE JUSTIFYING USE OF CITED STATUTORY AUTHORITY

General Dynamics NASSCO-Norfolk is the Lead Sub-Contractor for the work being accomplished onboard USS JAMES E WILLIAMS (DDG 95) during the ships FY24 DMP, under contract number N00024-23-C-4424, that was awarded to General Dynamics NASSCO-San Diego on 29 September 2023. This is a Chief of Naval Operations Maintenance Availability (CNO) and the ship is dry-docked at General Dynamics NASSCO- Norfolk shipyard in Norfolk, VA. The awarded contract also includes the ship s

Ship Alteration (SA) DDG51-95153 is scheduled to be installed onboard DDG 95 during the ships scheduled availability. To successfully accomplish this - install, joint efforts between the Planning Yard and NASSCO-Norfolk are essential in evaluating proposed access cuts and alignment checks, along with evaluating in reference to how the existing AC Plants will be removed and the new Chillers installed.

Additionally, technical feedback and specific recommendations, based on ship checks, will provide recommendations for enhancing producibility inclusive of any specialized equipment and devices that may be required by the Contractor, to be bought or manufactured, to conduct this alteration. Efforts to locate access cuts needed to support the HES-C install require the ship to be drydocked, therefore the work must begin no later than and must be integrated into the existing work package under contract N00024-23-C-4424. With no other scheduled time frame of the ship being docked prior to her , these efforts need to happen during the ships current FY24 DMP. Therefore, General Dynamics NASSCO-Norfolk is the only company able to perform the required work and during the current CNO.

Due to this work being directly related to work in the follow-on DMP availability, which was already awarded under this same contract, adding this work to a CMAV or other availability would not allow NASSCO to complete work already in their current follow-on availability. Therefore, General Dynamics NASSCO-Norfolk is the only company able to perform the required work and this work must happen during the dry-dock period of the current CNO.

6. DETERMINATION OF FAIR AND REASONABLE COSTS

The Contracting Officer has determined that the anticipated cost to the Government for the supplies/services covered by the J&A will be fair and reasonable. The estimated cost of this work item is based upon historical data as well as the Independent Government Estimate burdened ship repair labor rate and material burden rate were determined to be fair and reasonable at time of contract and delivery order award. The supported information provided should be sufficient to support the fair and reasonable cost determination of the procurement.
