About this file
This justification and approval document outlines a sole source contract award for ship's service turbine generator repair and alteration services. Pearl Harbor Naval Shipyard and Intermediate Maintenance Facility awarded a fixed price contract valued at $6,595,858 to Northrop Grumman Systems Corporation doing business as Northrop Grumman Marine Systems. As the original equipment manufacturer, Northrop Grumman is the only source that can provide proprietary maintenance data and specialized tooling for Virginia class submarine ship's service turbine generators. The justification cites 10 U.S.C. 2304(c)(1) for limiting competition to the sole responsible source able to meet the agency's minimum needs.

NAVSEA CONTRACTS HANDBOOK
JUSTIFICATION AND APPROVAL
FOR USE OF
OTHER THAN FULL AND OPEN COMPETITION
The Government’s minimum needs have been verified by the certifying technical and requirements personnel.
4. Statutory Authority Permitting Other Than Full and Open Competition
10 U.S.C. 2304(c)(1) Only One Responsible Source and No
Other Supplies or Services Will Satisfy Agency Requirements.
5. Rationale Justifying Use of Cited Statutory Authority
Per PHNSY Engineering & Planning Department (EDP), the OEM for the SSTGs, Northrop Grumman Marine Systems, is the only qualified vendor able to provide and perform the requirement identified in Paragraph 2 above to ensure satisfactory performance within the scheduled availability.
Original Equipment Manufacturer (OEM) Northrop Grumman Marine Systems 1167 Main Street, Suite 100 P.O. Box 420 Wyoming, RI 02898 Phone: (401) 491-9550 / (401) 954-4301 Fax: (401) 491-9551
Northrop Grumman has developed proprietary processes and specialized tooling to support the maintenance, repair, and alteration of the #1 and #2 SSTG aboard Virginia-class submarines and has not shared their proprietary data. As such, Northrop Grumman is the only vendor able to meet the Government’s requirement.
To successfully support this requirement for the PHNSY, a sole source solicitation and negotiated contract with Northrop Grumman is in the best interest of the Government.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable
Prior market research conducted 10 June 2021 found no other qualified vendors with the capability to provide material, maintenance, repair, and overhaul of the SSTG No. 1 and No.
2 onboard Virginia Class submarines.
The proposed contract was synopsized as a sources sought for market research purposes in SAM.gov on 24 September 2021.
No other potential sources expressed an interest in this requirement.
On 28 September 2021, a pre-solicitation notice was published on the SAM.gov for the purpose of notification that the Government intends to solicit and negotiate with only one source under the authority of FAR 6.302(1)(b).
Additional market research was not conducted, because it is not practicable, for the reasons discussed in paragraph 5 above, for any company other than Northrop Grumman to provide the required supplies and services.
7. Determination of Fair and Reasonable Costs
The Contracting Officer has determined that the anticipated cost to the Government for the supplies covered by the J&A will be fair and reasonable.
Similar quantities of this requirement have been purchased from this offeror in the past, and cost/pricing information was received on those past procurements. This information will be sufficient to support the fair and reasonable cost determination of this procurement.
The Contracting Officer will determine fair and reasonable cost prior to award of the contract.
8. Actions to Remove Barriers to Competition
For the reasons set forth in Paragraph 5, PHNSY & IMF C410 has no plans at this time to compete future contracts for the types of supplies/services covered by this document. If another potential source emerges, PHNSY & IMF C400 will assess whether competition for future requirements is feasible.
