CMO Control Number: 2016-013
DEPARTMENT OF THE ARMY
JUSTIFICATION FOR OTHER THAN
FULL AND OPEN COMPETITION
1. Contracting Agency: Army Contracting Command (ACC) Warren, Michigan 48397- 5000, is the responsible contracting activity for this action.
2. Description of the Action: This action will result in a modification to contract W56HZV-11-C-0109 with General Dynamics Land Systems (GDLS) for customer service and support. This modification will extend the Cost Plus Fee (CPFF) contract by 12 months. Award is projected for December 2015 and will utilize FY15 Army Working Capital Funds (AWCF) funding.
3. Discussion of Supplies/Services: This contract supports approximately 1,000 NSNs of unique spare parts for the Abrams Tank, the Bradley Fighting Vehicle, and the Wolverine Heavy Assault Bridge (HAB) and its variants in support of TACOM LCMC. This contract is for upgrading hardware configurations; testing serviceability of field returns; repairing Line Replaceable Units (LRUs) and Shop Replaceable Units (SRUs); disassembling excess, obsolete, or scrap down parts; issuing, receipt, packaging, and warehouse storage facility and Defense Automatic Addressing System Center (DAASC) Integrated E-Mail Logistics System (DIELOG); implementing Unique Identification (UID), where missing. These services are equivalent to a combined multiple-contractor repair depot, wholesale storage depot, and U.S. Army Direct Support Maintenance Unit. The performance of this contract will be accomplished at Fort Hood, TX. The proposed action will result in a 12 month period of performance extension to the current contract that is required until the follow-on contract can be awarded. The Bradley was an add-on to the initial Team Armor Partnership (TAP) contract with no repairs. At this time Bradley depot repairs are performed, and they benefit from the NEOF (No Evidence of Failures) screening, reduced time to get its LRU back on the shelf through MILSTRIP, and the UID labeling effort. The estimated value of this 12 month extension is $12,000,000.
4. Authority Cited: The statutory authority permitting Other than Full and Open Competition cited for this action is 10 United States Code (U.S.C.) 2304 (c) (1) as implemented by Federal Acquisition Regulation (FAR) 6.302-1 (a) (2) (iii) (A) & (B), “Only One Responsible Source”.
5. Reason for Authority Cited:
a. The use of 10 U.S.C. 2304 (c) (1) and FAR 6.302-1 “Only One Responsible Source” is justified because only GDLS has the historical corporate knowledge, expertise, and background for this complex contract. This is a follow-on to the current contract for a 12 month period of performance extension. This extension is needed for acquisition to properly complete the next follow-on; five year Long Term Contract (LTC).
- Exemption #4
(2) (ii), “Only one responsible.” There have been no changes in the supporting rationale or circumstances with the exception of a significantly smaller business base and updated market research.

13. Fair and Reasonable Cost Determination:
I hereby determine that the anticipated cost for this contract action will be fair and reasonable. This determination is based on results of the Technical Data Reviews and Cost/Price Analysis performed at the time of original award, coupled with the analysis performed on the pricing to be utilized during the period of performance of this Option Year 4 extension. Since the time the original award was made, GDLS has experienced an increase in both direct and indirect rates, resulting in a higher cost of doing business.
By offering to perform during this extension at the same cost as Option Year 4, the Government is receiving a fair and reasonable cost, and this extension is the most advantageous approach for the Government to receive the required service that GDLS performs. This extension will utilize the same rates previously negotiated and agreed to within Option Year 4, which was certified to at time of initial award. The cost and pricing data certification provided at that time will be utilized for this extension, as this is a cost contract and the extension will be executed with the same rates.
