5. Description of Supplies/Services: The eIT PMO has a requirement to procure a Product Accountability System (PAS) to track product inventory and stability testing time points and results. The PAS requirement will be procured from Labvantage Solutions, Inc. and will include software licenses with annual maintenance and support. This will allow the eIT PMO’s PAS to run on the common infrastructure servers. The Period of Performance (PoP) for this requirement will be one 12-month base period with four 12-month option periods.
6. Authority Cited: 41 U.S.C. 1901 OR 41 U.S.C. 1903
(a) FAR 13.106-1(b)(1)(i): Only one source reasonably available (e.g., urgency, exclusive licensing agreement, brand name or industrial mobilization); OR
(b) FAR 13.106-1(b)(1)(ii): Only one source can provide a portion of the purchase that is a particular brand-name item; OR
(c) FAR 13.501(a)(1)(i): Only one source reasonably available (including brand name); OR
(d) FAR 13.501(a)(1)(ii): Only one source can provide a portion of the purchase that is a particular brand-name item.
7. Reason for Authority Cited: This authority was cited because no other company has a commercial solution that meets the activity’s requirement within the designated cost and time limitations.
8. Efforts to obtain Competition: A request for information (RFI) was posted to FedBizOps in August 2017 and four companies provided a response. Each response was evaluated and it was determined that all of the proposed systems required additional development and, therefore, were non-commercial and outside of the budget for this requirement. An analysis of alternatives (AoA) study was also conducted to discover other potential sources.
a. Effective competition. No effective competition is expected for this acquisition.
b. Subcontracting competition. It is not expected that subcontracting opportunities exist for this acquisition.
9. Actions to remove or overcome barriers Competition: No further actions will be taken to overcome barriers to competition. The Government has performed extensive market research and Labvantage is the only solution that meets the needs of the Government without extensive cost or schedule overruns.
10. Market Survey: The acquisition exceeds the simplified acquisition threshold (SAT), therefore, it is not set aside for small business.
The Government posted a request for information (RFI) in August 2017 to search for companies that provided the services required by the eIT PMO. Four companies responded to this RFI but the potential solutions were non-commercial and required additional development and/or were significantly outside of the Government’s expected budget.
The Government also conducted an AoA study to determine whether other solutions were available. The study concluded that Labvantage Solutions, Inc. provided the only commercial solution that was within the Government’s financial and time constraints.
A notice of intent to sole source was posted to Fedbizops on 12 July 2018 to notify the public of the Government’s intent to award a contract to Labvantage Solutions, Inc. The notice expires on 27 July 2018 and it is not expected that any further responses will be received. The Contracting Office checked SAM on 13 July 2018 and Labvantage Solutions, Inc. was not listed as an excluded party.
11. Interested Sources: The Government received four responses to the RFI posted in August 2017. The companies that responded were
. The solutions submitted by were non-commercial and significantly outside of the Government’s expected budget. These responses also required additional time delays for product development.
did provide a commercial solution but it was also outside of the Government’s expected budget.
The Defense Medical Logistics Standard Support (DMLSS) system was evaluated as a Government Off-the-Shelf (GOTS) solution, but was not deemed as a viable option upon evaluation.
