Department of the Army FAR Part 6 Justification and Approval for Other than

Full and Open Competition

1. Contracting Activity: 409th Contracting Support Brigade (CSB), Theater Contracting Command (TCC) - Kaiserslautern

2. Description of Action: Installation Management Command (IMCOM) Europe Garrison G6 requests a firm-fixed-price contract with a cost-reimbursement CLIN, with HP Enterprise Services, 13600 EDR Drive A3S-B53, Herndon, VA, 20171-3299. The Government projects award for March 2016 and fiscal year 2016, Operations and Maintenance, Army funds will be used. An acquisition plan is not required because this procurement does not meet the threshold at Defense Federal Acquisition Regulation Supplement 207.103(d)(i)(B). The required acquisition strategy is currently awaiting Chief of Contracting Office (COCO) approval.

3. Description of Supplies/Services: IMCOM – Europe has a requirement to provide Information Technology Support Services (ITSS) for the U.S. Army Garrisons throughout Europe.

Base: 16 March 2016 – 15 June 2016 1st Option Period: 16 June 2016 – 15 July 2016 2nd Option Period: 16 July 2016 – 15 August 2016 FAR 52.217-8: 16 August 2016 – 31 August 2016

Total Estimated Value: $ 596,263.47

4. Authority Cited: 10 U.S.C. 2304(c)(2), as implemented by FAR 6.302-2, Unusual and compelling urgency.

5. Reason for Authority Cited: HP Enterprise Services (HPES) is the incumbent contractor for this requirement and is the only reasonable source for the execution of a bridge contract because they are successfully performing the required services with highly specialized and qualified personnel. The requirement for a bridge contract arose from a post-award protest of contract number W91QUZ-06-D-0012 0U01, information regarding this protest can be found in the paragraphs below.

(a) As described at FAR 6.302-2, when the agency’s need for the supplies or services is of such an unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals, full and open competition need not be provided for.

The urgent need of this requirement is the direct result of a post award protest which resulted in a stop-work order while the agency takes corrective action.

Service: ITSS IMCOM-Europe

Version – November 2015

The date it became known that an interim contract was needed to bridge the gap resulting from the post award protest was 1 March 2016. The current task order ends on 16 March 2016, not allowing for proper contracting and procurement lead times for developing a competitive solicitation.

The personnel required to perform the ITSS for this requirement must be highly trained and specialized in their task and able to immediately perform without assistance or guidance, the process of vetting these employees would result in a break in service.

The specified contractor, HPES, is the incumbent and has successfully been performing this requirement with the properly trained and certified employees.

This bridge contract is the result of a post-award protest competed to all of the ITES-2S contract holders, two responses to the solicitation were received and found technically acceptable. However, as a result of the protest is was found that GDIT did not in fact have the required personnel to support this requirement.

Revised proposals are being requested and evaluation of those will result in a competitive award for the follow-on for this requirement.

(b) Alternatives: There are no alternatives available to the Government, because this action was competed, award made, but a post-award protest resulted in a stop work order and the need to re-evaluate the proposals. The personnel and expertise required to perform this requirement is already in place by the incumbent, HP Enterprise Services, and would be impossible for a new contractor to put into place prior to the expiration of the current task order on 16 March 2016. Therefore, while the agency takes corrective action in response to the protest, the incumbent is required to continue performance.

(c) Award of task order W91QUZ-06-D-0012 0U01 was made on 12 February 2016 to General Dynamics Information Technology (GDIT). A post-award protest was filed on 22 February, by HPES on the basis that the evaluation criteria was not followed, especially as it related to Task 8 of the Performance Work Statement (PWS). After legal review of the agency level protest a determination to take corrective action was made, leading to the requirement for a bridge contract to be put into place. Protest resolution is expected within the coming weeks, the current task order will expire on 15 March 2016.

(d) If this J&A is not approved we will have direct failure of mission and impacts on IMCOM-EUROPE and Garrison missions. The contracted function being performed directly affects the IMCOM-EUROPE mission, services and support provided to its 7 garrison and mission partners at USAREUR, EUCOM, AFRICOM, USAFE, and Rotational Aligned Forces (FAR) and forward operating sites. The communications systems and support provided to our Department of Emergency Services (DES) is reliant on these systems that tie into garrisons support structure for command and control for force protection, fire, and emergency services. The European Restructuring Initiative (EIR) and the re-alignment of forces are directly supported through IMCOM-EUROPE staff which are reliant on the communications systems and video teleconferencing systems supported under this contract. The housing and barracks spacing information which is managed by the contractor in G4 provides space utilization information for planning and alignment of forces which directly affects readiness. Without this contract in place we will have mission failure in many areas within a very short time frame which will directly affect our mission partners.

6. Efforts to Obtain Competition: This requirement has historically been a competitive requirement, and will remain so. A sole source bridge is required while corrective action from a protest is being taken and competition and proper evaluation of all proposals is ensured. In accordance with FAR 5.202(a)(2), this action will not be synopsized.

Effective competition will be achieved through the competitive solicitation of the follow-on task order for this requirement and is only being circumvented for this bridge as a result of a post-award protest, in which award was made under competitive conditions.

7. Actions to Increase Competition: Historically this is a competition acquisition and the requirement for a sole source bridge is the direct result of a post-award protest. It is anticipated that the follow-on task orders will be awarded competitively.

8. Market Research: Market research was conducted by the contract specialist, Elizabeth Phelps, to determine the viability of competing a short interim task order.

However, this requirement was recently competed utilizing the Army’s CHESS Information Technology Services IDIQ Suite, the ITES-2S. This competition resulted in two proposals, GDIT and HPES. Therefore, it was determined that there were no other qualified sources to perform this interim task order.
