About this file
This is a Justification for Other Than Full and Open Competition document submitted by the Defense Logistics Agency (DLA) Troop Support, Medical Supply Operations ECAT Division, for a single-source procurement from Boston Scientific.
The procurement is for Boston Scientific's Neuromodulation "procedural packages" to be delivered via Just-in-Time (JIT), Direct Vendor Delivery (DVD), or Consignment methods to Military Treatment Facilities (MTFs) across the Department of Defense. The procedural packages include implantable devices, instrumentation sets, and ancillary accessories required for neuromodulation surgeries. The estimated five-year contract value is approximately $7,189,536.00, with a maximum dollar value of $14,379,072.00 based on anticipated demand growth. The contract will use a fixed price with economic price adjustment (EPA) structure. The procurement is justified under 10 U.S.C. 3204(a)(1) as implemented by FAR 6.302-1(a)(2) for "Only One Responsible Source" because neuromodulation product selection is driven by physician training, experience, and specialization rather than price alone. Boston Scientific's products are unique and proprietary, with representatives providing 24/7 technical support and on-site surgical guidance at MTFs. A Sources Sought Notice issued on March 20, 2025, closed April 21, 2025, with Boston Scientific as the only responder. The justification will be posted to the DLA Internet Bid Board System (DIBBS) and synopsized on SAM.gov in accordance with FAR 5.2 and 6.305(c).
