About this file

This justification document describes a sole-source contract award to Delta Scientific Corporation for repairs and replacement of hydraulic power units for automated barricade systems at Joint Interagency Task Force South. Delta Scientific Corporation is the original equipment manufacturer of the barricade systems and their proprietary hydraulic power units, and no other company can provide compatible replacement units or warrantied repairs. Previous sole-source contracts to Delta Scientific Corporation dating back to 2005 have addressed repairs of various barricade system components. The contracting agency has determined there are no safety or technical alternatives to using Delta Scientific Corporation for these specialized proprietary repair and replacement requirements. The associated federal contract opportunity notice shows contract W912PX20P0006 was awarded sole-source to Delta Scientific Corporation on September 15, 2020 for $277,775.45 to address the hydraulic power unit life cycle replacement requirements.

Version – February 2017 FOR OFFICIAL USE ONLY

(b) Alternatives:

i. JIATF-S could replace (via a new acquisition) rather than repair the existing integrated stand-off blast perimeter barricade system, however that alternative would be cost prohibitive as new barricade systems would cost upwards of $200,000 each and have to include removal costs of roughly $30,000 to remove the current barricades which have been adhered and mounted into a poured pavement. Additionally, since JIATF-S already has made a significant investment of roughly $300,000 in the current barricade systems, this investment would be a sunk cost.

ii. JIATF-S could permanently close the barricade thus rendering the parking lot useless but that would result in offsite parking which in turn would lead to congested parking throughout the neighboring base housing as well as beyond the Naval Air-Station Key West gates.

If this justification is not approved and the service cannot be provided by the intended sole source Contractor then the Barricade System will cease to function properly and will not be operational. As such, JIATFS will have to close off parking behind the barricade.

6. Efforts to Obtain Competition: In accordance with FAR 5.202(a)(4), this action will not be synopsized.

a. Effective Competition: Because this is a sole source action, effective competition is not applicable.

b. Subcontracting Competition: Subcontracting competition is not applicable to this acquisition as award will be made sole-source to a SDVOSB.

7. Actions to Increase Competition: The DSC1200 Barrier and HPU System utilized in the Delta Scientific Barricades are proprietary the Delta Scientific Corp. and not available from any other commercial source or supply. Therefore, no actions to increase competition for repairs of the barricades can take place without removing and reinstalling a new barricade system.

8. Market Research: Market Research found the Delta Scientific Barricades to be commercial items however, at this time, no other commercial source manufactures a Hydraulic Power Unit that will integrate into the existing fixed HPU with the associated plumbing and electro-hydraulic schema compatible with the Delta Scientific DSC 1200 barricades. Additionally, installation of a different Hydraulic Power Unit other than that from Delta Scientific will invalidate the Delta Scientific warranty. Given the safety and liability issues associated with Automated Hydraulic Barricades any attempt to modify another company’s hydraulic power system or a generic type system was not considered.

9. Interested Sources:

Due to safety of life and property liabilities issues, use of a third party control system was not considered as Delta Scientific will not warranty or certify such work or systems.

Since Delta Scientific Corporation is a SDVOSB and the only source who can satisfy the

Version – February 2017 FOR OFFICIAL USE ONLY repair requirements, a Sources Sought notice has not been posted. To date, no other sources have written to express interest in the acquisition.

10. Other Facts:

a. Procurement History

(1) Contract numbers and dates of the last several contracts for repairs to one or more of the DSC1200 Delta Scientific Barricades located throughout the JIATF-S Command:

W912PX-15-P-0004 Barricade HPU Replacement Awarded: 04/06/2015 W912PX-13-P-0019 Install & Repair DBCS Awarded: 08/15/2013 W912PX-10-C-0014 Replace & Install 3 Barricades Awarded: 09/28/2010 W912PX-05-P-0019 Barricade Repairs Awarded: 03/22/2005

(2) The competitive status of these actions.

All of the actions cited in 10(a)(1) above were awarded sole-source to Delta Scientific Corporation

(3) Authority previously cited if less than full and open competition was used.

The authority previously cited was FAR 13.106-1(b)(1)

(4) If a justification was prepared to support the procurement made before this one, a summary of the contents of paragraph 7 of the justification for that procurement and an explanation of the results.

(5) If any prior contract for this requirement was accomplished using full and open competition, include a detailed explanation of the changed circumstances causing this action to now limit the sources.

Not Applicable

(6) An explanation of any unusual patterns that may be revealed by the history, e.g., several consecutive, urgent buys: There are no unusual patterns found after reviewing the previous acquisitions.

(7) If a justification was prepared to support the procurement made before this one, briefly describe the circumstances justifying the procurement and whether there have been any significant changes.

Previous acquisitions were all for repairs of various components of the DCS1200 barricade systems. All components repaired were proprietary to Delta Scientific Corporation and were not available from any other commercial source. Given safety and liability issues associated with the Automated Hydraulic Barricades, any attempt to modify another company’s hydraulic power system or incorporate generic parts was not considered by the Government.
