BRAND NAME JUSTIFICATION UNDER SIMPLIFIED PROCEDURES FOR CERTAIN COMMERCIAL
ITEMS IN ACCORDANCE WITH FAR 13.5

2. Nature and/or Description of the Action Being Processed: This procurement is for Arjo Patient Lifts in accordance with FAR 13.5 Simplified Procedures for Certain Commercial Items and specifically FAR 13.501 Special Documentation Requirements, where acquisitions conducted under Simplified Acquisition Procedures are exempt from the requirements of FAR Part 6, but still require a justification using the format of FAR 6.303-2.
The George E Wahlen VA Medical Center has a brand name requirement for the purchase of 53 Arjo Maxi Sky 2 ceiling lifts (AP-2363) and 54 (AP-2364) new ceiling lift cassettes with an enhanced charging system (ECS) and infection control (IC) option. This requirement will be awarded as a new contract that is firm-fixed-price.

The 53 ceiling lifts will be for patient care areas that do not have patient lifting options installed or are easily available in small spaces or due to constraints with equipment that is low to the ground not allowing for castors on portable equipment to be placed beneath exam tables. The Safe Patient Handling and Mobility (SPHM) employees will utilize the patient lift for routine patient handling tasks and assist veterans with mobility challenges.
The 54 cassettes will replace the outdated Arjo Maxi Sky 600 ceiling lift cassettes on existing Arjo brand tracks and rails within the medical center. Currently, the VAMC has Arjo Maxi Sky 600 ceiling lifts installed in 75 patient care areas, Arjo Maxi Sky 2 with enhanced charging system (ECS) ceiling lifts installed in 7 patient care areas, and Arjo Max Sky 2 with enhanced charging system (ECS) ceiling lifts installed in 7 patient care areas, and Arjo Maxi Sky 2 with ECS and IC installed in 26 patient care areas totaling 108 Arjo Maxi Sky brand ceiling lifts within our hospital facility.
Recently 6 of the 75 Maxi Sky 600 ceiling lift cassettes are irreparable and irreplaceable due to manufacturer discontinuation of the Maxi Sky 600 ceiling lift cassette causing work arounds with BioMed and within patient care areas. The Arjo Maxi Sky 2 with enhanced charging system (ECS) and infection control (IC) option is the only system that is compatible with the Arjo brand ceiling lift track system currently installed in the hospital facility without Arjo’s written permission and added cost to the facility to have the tracks and rails retrofitted.
This is a concern related to the rapid construction of negative pressure rooms in March 2020 to accommodate for patient surges due to the COVID-19 pandemic. As the Respiratory Intensive Care Unit (RICU) was rapidly constructed, 7 Arjo Maxi Sky 600 cassettes had to be removed from the Specialty and Internal Medicine Clinics and placed on existing Arjo ceiling lift track systems in this
RICU.
The VAMC must be able to utilize compatible ceiling lift cassettes from other patient care areas and according to patient care priority if one were to become damaged. The medical center needs to maintain uniformity throughout the facility with the same manufacturer of ceiling lift, upgrading options as they become available.
4. Statutory Authority Permitting Restricted Competition:
FAR 13.5 Simplified Procedures for Certain Commercial Items. The statutory authority for applying the Simplified Procedures for Commercial Items of FAR 13.5 is 41 U.S.C. § 1901 and is implemented by FAR 13.106-1(b)(2) for restricting competition on this procurement. Competition is restricted on this procurement for the reason below:

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): The medical center currently has a total of 108 Arjo brand manufactured ceiling lifts currently installed and in use in 16 patient care units. Arjo Maxi Sky 600 ceiling lifts are installed and in use in Acute Medicine (15), Surgical (14), Telemetry (10), ICU (10), Same Day Surgery (2), Post Anesthesia Care Unit (4), Dialysis (2), Ambulatory Medicine Unit (1), Emergency Department (2), Respiratory ICU (8), Out-Patient Physical Therapy (1), and our Specialty Clinics (6) totaling 75. Arjo Maxi Sky 2 with ECS are installed and in use in CT (1), MRI (2), and Cardiology (4) totaling 7. Arjo Maxi Sky 2 with ECS and IC ceiling lifts are installed and in use in Acute Medicine/Rehab (8), Surgical (1), Ambulatory Medicine (13), Telemetry
(4) totaling 26.
Further, Arjo does not support other manufacturer’s ceiling lift brand cassettes to be placed on the existing Arjo brand ceiling lift tracks and rails within the patient care areas. The enhanced charging system within the Arjo Maxi Sky 2 is compatible with these existing Arjo brand tracks and rails.
The medical center has a variety of Arjo brand single patient use (SPU) Maxi Flite loop slings and Arjo brand re-usable loop slings in stock that may not be utilized on another manufacturer’s patient lift without written consent from Arjo and a competing manufacturer’s written consent to use with their equipment. It would not be in the Government’s best interest to acquire another manufacturer’s patient lift with 108 patient care areas utilizing the Arjo Maxi Sky ceiling lifts and the medical center maintaining a stock of Arjo manufactured supplies.
Accordingly, Arjo is the only source capable of providing the supplies described in Section III above without the Veteran’s Health Administration experiencing substantial duplication of cost that could not be expected to be recovered through competition and unacceptable delays in fulfilling its requirements.
6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: NASA SEWP and GSA Advantage vendor searches were conducted but were not successful. NASA SEWP only covers IT related products/services and no results were found on GSA Advantage when searching for the part numbers. A sources sought was not issued due to the timeframe that this requirement is needed.
A search on www.FPDS.gov was conducted and over 3,000 results were returned when using the keyword “patient lift”. According to the search, there are several different vendors capable of providing patient lifts. When searching specifically for NCO 19 actions, 52 results were found. Some of the recent awards went to Arjo, Inc. (36C25921F0236), Accessible Systems, Inc.
(36C25921P0581), RAMPCOUSA, INC. (36C25921F0266), and HOMECARE PRODUCTS, INC.
(36C25921F0213).

Award 36C25921F0236 was awarded by NCO 19 to Arjo as a brand name requirement for Salt Lake City on April 1, 2021.
7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: Fair and reasonable costs will be considered based off previous acquisitions and vendor responses.
8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Technical experts conducted market research by reviewing the specifications of eight (8) different ceiling lift manufacturers: EZ Way CL650, HandiCare C-625, Guldmann GH3, HumanCare Heli-Q, Barrier Free Lifts Unilift Series, Hill-Rom LikoGuard L, Tollos Cirrus, and VanCare Vander-Track II C-625. Of the (eight) 8 manufacturer’s product literature and technical specifications reviewed, none of them provide the eight (8) different spreader bar options or the three (3) infection control options the Maxi Sky 2 with ECS and IC has.
Further market research by the contracting officer was conducted on GSA, NASA SEWP, and FPDS.
FPDS was the only website that yielded results. While there are several vendors that can provide patient lifts, none would be able to meet the requirements listed above.
With the product manufactured by a large business and only one (1) SDVOSB capable of meeting the Government’s needs, an SDVOSB set-aside is not permissible as the Nonmanufacturer Rule (NMR) cannot be met.
9. Any Other Facts Supporting the Use of Other than Full and Open Competition: Arjo is the only known manufacturer that has three infection control pieces within its new Maxi Sky 2. This ceiling lift brand cassette has been studied by a third-party independent test facility with the conclusion that the kill time was reduced for four major bacterial strains on the new infection control non-porous strap compared to nylon straps after disinfecting with a commonly found disinfectant.
Additionally, Maxi Sky 2 IC is the only ceiling lift that allows for 8 different spreader bar solutions ehancing the clinical applications of the lift by allowing the patient to be positioned mechanically in any position from seated to upright to supine.
Among other safety and health features that Arjo offers, the Arjo accessories currently owned as well as any others can be re-used by the staff members of the SLC VAMC.
10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: Arjo, Inc. and Alliant Healthcare submitted interest in writing.
11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to
Competition before Making subsequent acquisitions for the supplies or services required: At this time, no actions have been taken. The medical center is outfitted with 108 Arjo brand manufactured ceiling lifts which meet strict requirements for both health and safety. Acquiring a different manufactured product would also mean having the current systems removed and updated to meet different standards.
