About this file
This document is a Sole Source Justification and Approval (JA-24-D-441) under FAR 13.501 for the procurement of Defense Advanced Global Positioning System Receivers (DAGRS) by the Army Contracting Command - Aberdeen Proving Ground (ACC-APG). The contract is with BAE Systems Information and Electronic Systems Integration Inc., who is the Original Equipment Manufacturer (OEM) and sole reseller of the DAGRS Part Number 822-1873-003. The procurement involves 69 DAGRS units with an option to purchase an additional 26, totaling 95 units.
The justification emphasizes the criticality of sourcing directly from BAE Systems, citing potential risks of operational setbacks if an alternative system is qualified. Attempting to qualify a different system into the M1A2 SEPv3 tank platform could lead to deployment delays, compatibility issues, and approximately $3,000,000 in additional costs. Market research included a Sources Sought notice on SAM.gov, which received two responses from Pythia International and Sterling Computers Corporation, but both were denied resale authorization by BAE Systems. The contract is a commercial firm fixed-price arrangement with country-funded non-expiring funds, highlighting the strategic importance of maintaining mission readiness for Foreign Partner defense capabilities.

If BAE systems’ DAGRS are not procured and a different P/N is qualified, the government risks significant operational setbacks. Qualifying an alternative system into the M1A2 SEPv3 tank platform would lead to delays in deployment mission capable tanks, additional costs in testing and validation, and potential compatibility issues.
These delays and costs would subsequently compromise CECOM-SAMD’s mission readiness and effectiveness in critical situations, potentially costing approximately $3,000,000,00 and extending project timelines by 12-months.
6. Publicizing Contract Actions: In accordance with FAR 13.501(a) this requirement is sole source. Therefore, in accordance with 13.501(a)(1)(iii), this justification will be redacted and posted 14 days after contract award on SAM.gov.
7. Efforts to Obtain Competition: The Contracting Officer shall publish the notices required by FAR 5.201 and any bids or proposals shall be considered. On 22 April 2024, a Sources Sought was posted with a closing date of 6 May 2024. Two (2) responses were received from- Pythia International and Sterling Computers Corporation stating they could provide P/N 822-1873-003, see Section 9 Market Research for further information. On 20 May 2024 a Notice of Intent to Sole Source to BAE was also posted on SAM.gov.
a. Effective competition. Because this is a sole source action, effective competition is not anticipated.
b. Subcontracting competition. Subcontracting efforts do not exist or apply for this action. BAE is the OEM for this procurement.
8. Actions to Increase Competition: On 28 February 2024, Mr. Thomas Ohrt, BAE, Contract Manager confirmed via email that they’re the OEM of the DAGRS. To date, no other manufacturer’s product exists that can perform the same functions as the BAE DAGRS that are being requested by the customer. Therefore, no actions have been taken by CECOM-SAMD to increase competition on this requirement. However, Contracting posted a Sources Sought for the required items on SAM.gov on 22 April 2024, see Section 9, “Market Research”.
9. Market Research: A Sources Sought was posted on SAM.gov on 22 April 2024 with a closing date of 6 May 2024. Two (2) responses were received from Pythia International and Sterling Computers Corporation. Their responses indicated they could provide the required P/N. However, both interested parties were in the process of attempting to attain approval from BAE Systems to resell the P/N. At the time of their submissions, this approval had not been granted and subsequently it was denied for both interested parties.
