About this file
This document is a Justification for Other Than Full and Open Competition - Simplified Acquisition (under $150k) prepared to support a sole-source procurement for the Department of Homeland Security's Federal Law Enforcement Training Center (FLETC).
The FLETC intends to negotiate a sole-source contract with Action Target to procure twelve (12) MANCOM Touch Plus Carrier Systems to replace worn parts on their existing firing range systems, which were originally built by Action Target. The MANCOM Touch Plus Carrier System is a cable-driven retrieval system with modular touch pads, 360-degree target turning, user programs, and advanced LED lighting features that are unique and compatible with FLETC's existing infrastructure. The total estimated value of the procurement is $47,735.40. FLETC has determined that Action Target is the only responsible source that can provide the required products, as other manufacturers' systems are not compatible with FLETC's current setup. The procurement will be conducted under FAR Part 12, Acquisition of Commercial Items.

Introduction: Pursuant to Federal Acquisition Regulation 13.106-3(b)(3)(i), the following data is furnished to the Contracting Officer to support the requisitioning office’s request that the items/services identified on the above-mentioned PR be obtained using other than full and open competition. The Requisitioning Office understands that a contract may not be awarded on a sole source basis unless the Contracting Officer approves the request for Other Than Full and Open Competition.
1. Identification of Agency, Contracting Activity and Document. The Department of
Homeland Security (DHS), Federal Law Enforcement Training Center (FLETC), Procurement Division (PRO)
2. Nature and/or Description of Action Being Approved. Action Target Mancom Touch Plus Carrier System is cable-driven retrieval system with modular touch pads, 360-degree target turning, user programs, and advanced led lighting features. The Firearms Division currently utilizes this target system in its 96 firing points spanning across 4 indoor firing ranges.
3. Description of the Supplies or Services Required to Meet Agency’s Need & the Estimated
Value. The Action Target Mancom Touch Plus Carrier System is being purchased to replace worn out parts. We currently utilize this system on our firing ranges. The firing ranges were originally built by Action Target and use this exact type of target retrieval system. Quote for total buy including shipping is $47,735.40.
4. Identification of Statutory Authority Permitting Other Than Full and Open Competition.
41 U.S.C.3304(a)(1) – implemented by the FAR Subpart 6.302-1 entitled “Only one reasonable source and no other supplies or services will satisfy agency requirements.”
“(A) Demonstrates a unique and innovative concept (see definition at 2.101), or, demonstrates a unique capability of the source to provide the particular research services proposed;”
The firing ranges were originally built by Action Target and currently utilize its Mancom retrieval systems, and this system has shown to have a unique capability for safe use in multiple Firearms training courses. The purchase of items is to replace worn out parts and must be compatible with current target systems used on our firing ranges.
5. Identification of Exception to the Buy American Statute: N/A- Products are made in USA by Action Target. The Mancom Touch Plus Carrier Systems are specialized and propriety to Action Target.
6. Proposed Contractor’s Unique Qualifications/Nature of Acquisition Requiring Use of Other Than Full and Open Competition.
Action Target manufactures the Mancom Touch Plus Carrier System for its intended application and specific market use on live firing ranges. Other target retrieval manufactures are not compatible with the current system we utilize. Using Action Target’s carriers would allow Firearms to replace worn out parts, which must be compatible with our current modular track system and computer touch screen interface components, which allow firing lane control, programs and drills, and offer a solid ballistic design to withstand side impacts and prevent splatter damage. Utilizing Action Target’s target system would allow existing safety standards to remain in place. Also, any technical assistance that transcends FLETC's internal capabilities would be provided by a third-party consultant; Firearms and the Facility Management Division recommends “Action Target'' serve as this third-party consultant, as the range was built by this company.
7. Technical and Requirements Certification: I certify this requirement meets the Government’s minimum need and that the supporting data, which forms a basis for this justification, is complete and accurate.
