About this file
This justification and approval document authorizes a sole source contract award to Anark Corporation for brand name mission critical 3D PDF and browser-based publishing software, maintenance, and services. The Naval Air Systems Command will award a firm fixed price contract to Anark Corporation from 1 September 2020 through 30 September 2024 for a total of $3,327,747.40. The software and services are required to deploy an automated publishing system to ingest technical data packages from original equipment manufacturers in proprietary CAD formats, validate the data, and publish accessible 3D PDF and HTML5 technical manuals for aviation logistics and maintenance personnel. The justification cites only one responsible source being able to meet requirements to integrate with existing product lifecycle management systems without technical or schedule risks. Market research found no other compatible commercial products that could satisfy needs.

JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity.
Naval Air Systems Command (NAVAIR) Headquarters
2. Description of the Action Being Approved.
This Justification and Approval (J&A) authorizes and approves a Firm Fixed Price (FFP) sole source contract to provide brand name mission critical software products, maintenance, and services to deploy and integrate a 3D PDF and browser-based publishing system with the Aviation Logistics Environment (ALE) Aviation Product Lifecycle Management (AVPLM) software platform. The contract will be awarded to Anark Corporation, 2970 Wilderness Place, Suite 110, Boulder, CO 80301. This effort will enable Program Managers Air (PMAs) to efficiently receive 3D Technical Data Packages (TDPs), verify and validate the model data, and publish the model data in a consumable format available to non-Computer Aided Design (CAD) users, logisticians, and supply chain personnel who require the data to support NAVAIR’s weapons and support systems. This work is sponsored by the NAVAIR Echelon III Technical Data Department at Naval Air Station (NAS) Patuxent River, MD and Naval Air Technical Engineering Center (NATEC) San Diego, CA with the work-taking place at the vendor’s site.
3. Description of Supplies/Services.
The supplies and services required for this effort are brand name Anark Core Server (ACS) and Anark Core MBEWeb (ACM) software and Anark business use cases developed in previous projects with Naval Sea Systems Command (NAVSEA), NAVAIR PMA-261 H-53K Program, and Naval Air Warfare Center Aircraft Division (NAWCAD) Lakehurst, as well as the Air Force, and the Army. All projects involve the deployment of automated, Product Lifecycle Management (PLM)-integrated publishing systems capable of ingesting proprietary model data, verifying and validating the data, and publishing 3D TDPs in 3D PDF or HTML5 formats instead of native 3D models. Associated services are required to support configuration of the Anark Core Server software to operate in the NAVAIR environment. Associated services include the integration of ALE AVPLM information technology (IT) capabilities into Anark Core Server system workflows. This acquisition will expand and build upon the current investment NAVAIR has made in the Anark Core 3D TDP publishing system and the Team center PLM software platform for Commander, Fleet Readiness Centers (COMFRC). These business processes will enable digital data updates, sharing, and visibility across all levels of aviation maintenance, and product support providers, which is critical for Aircraft Readiness analysis.

4. Statutory Authority Permitting Other Than Full and Open Competition.
10 U.S.C. 2304(c)(1), as implemented by Federal Acquisition Regulation (FAR) 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements.
5. Rationale Justifying Use of Cited Statutory Authority.
An award to any other source would result in unacceptable delay in fulfilling the agency requirements and would cause substantial duplication of cost, pursuant to FAR 6.302-1(a)(2)(iii)
(A) and (B). The Anark Core software platform has been deployed as part of a project with the Navy’s next generation Model Based Product Support (MBPS) system as part of an enterprise capability to acquire, deploy and sustain weapon systems’ digital twins. To date several programs and platforms, such as PMA-261 H-53K, NAVAIR, NAWCAD Lakehurst and Patuxent River, have procured and are using Anark Core Server for its 3D data exchange requirements. Anark has proprietary rights to this software, and there are no other vendors for this software. If another manufacturer’s software were substituted for incorporation, the environment would be dissimilar and would result in the introduction of technical configuration, security, and schedule risks. The consequences of these risks would be increased overall costs to the Government, delays in fulfilling Government requirements, and loss of efficiency. Changes to the technical baseline would require verification through developmental testing to ensure the system meets architecture and functional requirements and capabilities. This additional engineering effort is estimated at $1.5 million and would cause at least a twelve-month delay to the template development and integration project.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
In an effort to identify competitive interest, market research was conducted by technical representatives and Subject Matter Experts (SMEs) to determine what products in industry were currently available that would meet the functionality requirements of the Government. The SME participate in numerous DoD, professional, and industry groups including representation on the American Society of Mechanical Engineers, Engineering Drawing Practices committees, Model- Based Enterprise forums, and the DoD Engineering Data and Modeling Working Group (DEDMWG). The focus in each of these groups are the Model-based Design capabilities of the various software tools available to industry and DoD to improve Model-based Enterprise capabilities.
Market research was also conducted via the National Aeronautics and Space Administration (NASA) Solutions for Enterprise Wide Procurement (SEWP) website (www.sewp.nasa.gov).
The technical representatives also searched on Google and GSA Advantage (www.gsaadvantage.gov) websites. The software and services were not found to be competitively available from authorized resellers. Results of the market research also indicated there are no other compatible products that ensure the form, fit, and function to satisfy the Government needs in a one for one fashion.
In accordance with Defense Federal Acquisition Regulation Supplement (DFARS) Procedures, Guidance, and Information (PGI) 206.302-1, a sources sought request for information was synopsized on the Beta.Sam.gov website on 18 June 2020 for 15 days and the Government received two small business responses, one being the incumbent and the other company was found indeterminable. The indeterminable company did not mention any of the specific requirements related to the development of an integrated-PLM publishing solution. There was no indication of experience with 3D PDF/HTML5 publishing; knowledge/experience with PLM software tools; interfaces; knowledge/experience with model data; nor model validation software. Anark confirmed that they have no authorized resellers of their products. They are the only source that can provide the required software and services to satisfy NAVAIR Echelon III Technical Data Department, NATEC, and ALE program requirements. The Contracting Officer subsequently posted a sole source pre-solicitation synopsis pursuant to FAR 5.201(b) and will review any responses received.
7. Determination of Fair and Reasonable Cost.
In accordance with FAR 15.402, the Contracting Officer shall ensure that all supplies and services provided under this contract are procured at a fair and reasonable price. The Contractor will be required to submit a formal proposal with sufficient information to support the accuracy and reliability of the estimate. Anark Corporation’s proposal will be reviewed by experienced technical and cost analysts with the aid of necessary field pricing support to confirm the pricing is fair and reasonable. The Contracting Officer will utilize price analysis as the basis for negotiating a fair and reasonable commercial price.
8. Actions to Remove Barriers to Future Competition.
For each subsequent purchase, the NAVAIR Echelon III Technical Data Department, NATEC, and the ALE Program of Record (POR) SMEs will conduct market research and pursue other vendors and solutions to determine if alternatives can meet future requirements, future budget and funding availability, and support reduction in the Logistics IT Portfolio. As this is a commercial product, the Government does not have data rights and does not foresee procuring data rights in the future to compete the software solution in the future.
