LIMITED SOURCE JUSTIFICATION
This acquisition is conducted under the authority of the Multiple Award Schedule Program as authorized by Title III of the Federal Property and Administrative Services Act of 1949 40 U.S.C. 501, Services for Executive Agencies, as implemented at FAR 8.405-6(c).
1. Contracting Activity.
The Naval Sea Systems Command, Naval Surface Warfare Center, Panama City Division (NSWC PCD), 110 Vernon Avenue, Panama City, FL 32407-7001 Contracts Department, Code 02.
2. Description of the Action Being Approved.

3. Description of Supplies/Services Required to Meet Agency’s Needs.

4. Authority and Supporting Rationale.
Per FAR 8.405-6(a)(1)(i)(B) Only one source is capable of providing the supplies or services required at the level of quality required due to the unique or specialized nature of the work. These services were previously procured under Seaport Task Order N00178-04-D-4018 in which ISPA Technology is a subcontractor to the prime, BAE Systems Technology Solutions and Services, Inc.
ISPA Technology is the only contractor that is currently mobilized and capable of providing the required programmatic, software development, cybersecurity, testing and technical support for the NSAM project. ISPA has been providing this support for over 12 months. The skill sets needed to provide this support requires specific resident knowledge that currently only ISPA possesses. Specifically, the skill set is Computer Science Degree with 3-5 years’ experience on C++ and Java; experience in the Agile (SCRUM) process for program development; experience in open, modular software development; and experience with Net-Centric Sensor Analysis for Mine Warfare (NSAM) or similar Post mission Analysis (PMS) software program. ISPA has extensive experience on the coding of the NSAM software package and are experts in using Agile Software Development techniques. The period of performance covered by this justification and approval will allow the necessary timeframe for a NSAM competitive Seaport task order to be awarded while preventing a work stoppage.
Market Research was conducted for the purposes of validating the history of Software Developers being a difficult labor category to staff.
Examples of either Human Resource or IT periodicals reviewed are: CNN Money; Tech Republic and Business Insider. The periodicals all reflected the difficulty of staffing Software Developers. When combined with the expertise of NSAM desired, ISPA is the only logical contractor for this effort.
5. Determination by the Ordering Activity Contracting Officer that the Order Represents the Best Value Consistent with FAR 8.404 (d).
The Contracting Officer has determined that this delivery order represents the best value and results in the lowest overall cost alternative to meet the Navy’s needs.

6. Description of the Market Research Conducted Among Schedule Holders and the Results or the Reason Market Research was Not Conducted.
FAR 5.202(4) does not require the Contracting Officer to synopsize the notice when the proposed contract action is expressly authorized or required by a statute to be made through another Government agency. FAR 8.404(a) does not require a synopsis as this acquisition is a fixed price order against a GSA schedule. See paragraph 8 for description of competitive efforts for solicitation of new contract. No additional market research was conducted because it is not practicable, for the reasons discussed in paragraph 4 above, for any company other than ISPA, to provide the required support.
7. Any Other Facts Supporting the Justification.
None
8. A Statement of the Actions, If Any, The Agency May Take To Remove Or Overcome Any Barriers That Preclude The Agency From Meeting The Requirements Of 8.405-1 And 8.405-2 Before Any Subsequent Acquisition For The Supplies Or Services Is Made.
NSWC PCD is in the process of developing the requirements for a 5-year competitive Seaport task order to support the NSAM project. It is anticipated that this Seaport task order will be awarded in the first quarter of FY 2019.
