About this file

This document is a Justification and Approval (J&A) for Other Than Full and Open Competition for a digital display (Gunner's Display) used on the M777A2 155MM Howitzer. The Army Contracting Command-Detroit Arsenal (ACC-DTA) proposes to award a Firm-Fixed-Price contract to Canadian Commercial Corporation, to be 100% subcontracted to General Dynamics Land Systems-Canada Corporation. The total estimated contract value is $3,579,642.00 for 303 units, with an option for an additional 303 units, totaling 606 units.

The justification for sole-source procurement stems from the unique technical requirements of the Gunner's Display. The Technical Data Package (TDP) does not fully disclose the complete technical requirements, and the government lacks the necessary computer software and intellectual property rights for competitive procurement. Extensive market research, including internet searches and a Sources Sought Notice, failed to identify alternative manufacturers. The government estimates that reverse engineering would cost approximately $3.4 million and take 4.8 years. The contract will be awarded using Army Working Capital Funds, with the government continuing efforts to obtain TDP rights and increase competition for future procurements.

JUSTIFICATION AND APPROVAL

FOR OTHER THAN FULL AND OPEN COMPETITION

JA-00524

1. Contracting Agency: Army Contracting Command-Detroit Arsenal (ACC-DTA).

2. Description of Action: ACC-DTA proposes to award a new Firm-Fixed-Price contract to Canadian Commercial Corporation, Commercial and Government Entity (CAGE) 98247, to be 100% subcontracted to General Dynamics Land Systems-Canada Corporation, (CAGE) 05257, for the Indicator, Digital Display (Gunner’s Display), National Stock Number (NSN) 6625-01-609-2815, United States Government (USG) Part Number (P/N): 13022787, Manufacturer P/N: AGD1-2, using Army Working Capital Funds.

3. Description of Supplies/Services: The Gunner’s Display is used on the M777A2 155MM Howitzer.

. The total estimated contract value is $3,579,642.00 for a quantity of 303 each (EA), with an option quantity of 303 EA, resulting in a total quantity of 606 EA.

4. Authority Cited: The statutory authority permitting other than full and open competition for this effort is 10 United States Code (U.S.C.) 3204(a)(1) as implemented by Federal Acquisition Regulation (FAR) 6.302-1(a)(2)(ii)(A) and (B), “Only One Responsible Source and No Other Supplies and Services Will Satisfy Agency Requirements,” Supplies may be deemed to be available only from the original source in the case of a follow-on contract for the continued development or production of a major system or highly specialized equipment, including major components thereof, when it is likely that award to any other source would result in (A) Substantial duplication of cost to the Government that is not expected to be recovered through competition and (B) Unacceptable delays in fulfilling the agency’s requirements.

5. Reason for Authority Cited: The Gunner’s Display is utilized on the M777A2 Howitzer and was developed by General Dynamics Land Systems - Canada Corporation.

The Source Controlled top drawing only lists one source. The Technical Data Package (TDP) does not fully disclose the complete technical requirements that would allow this item to be manufactured by anyone other than General Dynamics Land Systems-Canada Corporation. The Government also does not have the complete computer software necessary for competitive procurement. For these reasons, the Gunner’s

Display from General Dynamics Land Systems-Canada Corporation is the only display which can be utilized on the M777 Howitzer. The Contract Specialist sent a TDP Negotiated License Request email to General Dynamics Land Systems-Canada Corporation on 01 August 2022, inquiring as to whether the firm is willing to license the TDP. The Contract Specialist received email communication on 04 October 2022

stating General Dynamics Land Systems-Canada Corporation may be interested in selling the TDP Rights. The Contract Specialist received additional email communication on 09 February 2023 from General Dynamics Land Systems-Canada Corporation, providing a price proposal regarding the TDP Negotiated License Request email.

The Contract Specialist sent a follow up TDP Negotiated License Request email to General Dynamics Land Systems-Canada Corporation on 13 March 2024. No response has been received to date.

The Government does not have the pertinent technical data to enable competitive re-procurement, nor the necessary intellectual property data rights to the pertinent technical data to enable competitive re-procurement. Reverse Engineering using subject matter expert (SME) historical data and MIL-HDBK-115C as guidance will be required to create a Level III TDP to compete for a new vendor capable of manufacturing a comparable Gunner’s Display.

The Government would not be able to recover, through subsequent competition, the additional costs involved in reverse engineering the item to create a new and competitive Gunner’s Display.

Therefore, sole source procurement to General Dynamics Land Systems- Canada Corporation (CAGE: 05257) is the only method of procurement currently available to ensure supportability of fielded M777A2 155MM Howitzers.

6. Efforts to Obtain Competition:

a. Effective competition: Due to the reasons cited in section 5 above, the Government is not pursuing competition for this item. The notices required by FAR 5.201 shall be published, and any bids or proposals received shall be considered.

b. Subcontracting competition: The solicitation and resulting contract will include all required FAR and Defense Federal Acquisition Regulation Supplement (DFARS) subcontracting clauses to maximize small business opportunities and utilization.

7. Actions to Increase Competition: For future procurements, the Government will continue efforts to obtain the TDP/Specifically Negotiated License and conduct continuous market research which will aid in increasing competition or finding another source.

8. Market Research: A Sources Sought Notice was posted to SAM.gov on 02 August 2022 and closed on 21 August 2022. The Contract Specialist received two responses to the Sources Sought Notice to include Sterling Design (4LLQ0) and General Dynamics Land Systems-Canada Corporation (05257). Sterling Design provided a response on 21 August 2022, stating they are a small business who have designed, manufactured, and sustained military displays. Following their initial response, the Contract Specialist inquired if they were an authorized distributor for General Dynamics Land Systems- Canada Corporation. On 07 December 2022, Sterling Design stated they are not an authorized distributor of General Dynamics Land Systems Canada Corporation, which makes them incapable of providing the item. The Contract Specialist received the completed Sources Sought document from General Dynamics Land Systems-Canada Corporation on 16 August 2022 documenting their full capability in producing the Gunner’s Display. The Contract Specialist re-posted the Sources Sought Notice to SAM.gov on 19 March 2024, with a closing date of 29 March 2024. No responses were received.
