SOURCE SELECTION INFORMATION SEE FAR 3.104
FOR OFFICIAL USE ONLY
Control No: PAN NO. RA-T077-16
Contractor: CFD Research Corporation Supply/Service: Army SBIR Phase II Additional Effort
JUSTIFICATION AND APPROVAL
FOR OTHER THAN FULL AND OPEN COMPETITION
“Novel Cathodes for High Capacity Thermal Battery”
1. Contracting Activity: Army Contracting Command-Redstone (ACC-RSA), ATTN:
CCAM-RDA, Redstone Arsenal, AL 35898-5000.
2. Description of Action: This action is a modification to provide additional tasks under contract W31P4Q-16-C-0012, which was awarded competitively to CFD Research Corporation (CFDRC) on 11 December 2015 under the Army Small Business Innovation Research (SBIR) Program topic number A14-009. The contract is a research activity which is funded with Research, Development, Test and Evaluation (RDT&E) funding. The contract is a cost plus fixed-fee (CPFF) type requirement and this modification will not affect the contract type. The contract is a basic effort only with a total cost of $934,318.49, fee of $ 65,402.29, for a total CPFF amount of $999,720.78.
3. Description of Supplies or Services: CFDRC is currently executing an SBIR Phase II effort entitled, "Novel Cathodes for High Capacity Thermal Battery" under contract W31P4Q-16-C-0012 to develop, design, fabricate, test, and demonstrate novel cathode materials for thermal battery with high single cell potential, greater than
2.5 volts, high energy density. The total increase of this modification is $65,737.00 resulting in a total contract value of $1,065,457.78. The additional technical effort shall be completed by 30 September 2017.
4. Authority Cited: The statutory authority permitting other than full and open competition is 10 U.S.C. 2304(c)(1), as implemented by (FAR) 6.302-1(a)(2)(ii), “Only one responsible source and no other supplies or services will satisfy agency requirements.”
5. Reason for Authority Cited: CFDRC, 701 McMillian Way NW, Suite D, Huntsville, AL 35806, Cage Code 0DEW1 was selected competitively under the Army SBIR Program topic A14-009 to develop, design, fabricate, test, and demonstrate novel cathode materials for thermal battery with high single cell potential, greater than 2.5 volts, high energy density. The ideas and developments obtained through the completed Phase I contract and the Phase II contract are proprietary to CFDRC.
Only this proprietary technology and information will satisfy the Government's needs. No other vendor has access to the full CFDRC proprietary and patented designs. Therefore, CFDRC is the only contractor that could complete the proposed scope of work due to their prior knowledge and experience demonstrated in the current effort. Since CFDRC’s proprietary designs and data are being used, CFDRC is the only responsible source with the resources to fulfill the requirements of the Government. No other contractor has or can be made to have the essential qualifications to meet the Government’s requirements without substantial duplication of cost to the Government conservatively estimated to exceed $3,000,000.00 and not expected to be recovered through competition. This estimate is based upon engineering experience given the amount and period of performance of the current effort. Additionally, it is expected that using another contractor would result in unacceptable delays by adding four years or more in fulfilling the agency’s requirements.
6. Efforts to Obtain Competition: Since the proposed effort involves a continuation of effort which can only reasonably be provided by CFDRC and is an Army technology gap, no effort has been made to obtain competition for this action.
Effective competition is not applicable since this is a sole source action. Because this is a SBIR contract, the effort’s information will be protected from competition for up to 5 years. In accordance with the exception set forth in FAR 5.202(a)(7), a notice for this effort was not posted in FedBizOpps. A determination was issued by the Deputy Director of Contracting Policy and Operations on 16 October 2016 exempting the SBIR program from the requirement for either an RFI/SS notice or waiver approved by the Principal Assistant Responsible for Contracting.
7. Actions to Increase Competition: No efforts have been expended to increase competition for this action on further development of this sensitive technology. The SBIR program publishes numerous competitive solicitations annually that encourage proposals containing new and innovative concepts, which may advance the state-of-art.
8. Market Research: In addition to the Market Research Report captured in the market Research Report/Commerciality Determination for Contracts Awarded Under the Small Business Innovation Research and Small Business Technology Transfer (SBIR/STTR) Program Fiscal Year 2016 and in accordance with FAR Part 10, market research has been conducted for this acquisition by the Contracting Officer Representative (COR) for this effort. The COR, Dr. Mohan Sanghadasa, has an extensive technical background in development of thermal battery technologies. He is recognized as a government expert for these efforts within the Systems Simulation, Software, and Integration (S3I) Directorate, Aviation and Missile Research, Development, and Engineering Center (AMRDEC). Through this position, he is responsible for oversight for each of the scientific disciplines required for this effort and has an understanding of the various relevant technical communities', Department of the Defense’s, and academia’s, efforts related to the goals of this contract. He is aware of the responsible technical capability available to accomplish government requirements.
The exchanges of information between the Government and academic/industrial experts provide the S3I Directorate with an up-to-date survey of available related expertise and constitute a continuous market survey. The results of this market survey support the decision to award based upon the unique capabilities demonstrated by
CFDRC. Based on the above information, the basic clauses and provisions prescribed in FAR part 12 will not meet the needs of this requirement, and will not be utilized. This is not a commercial item/service. This effort was entered into the AMCOM Competition Advocate’s Shopping List (CASL) as part of the SBIR/STTR Phase I and Phase II Research/Research and Development Efforts on 30 September 2015.
9. Interested Sources: To date, no other sources have written to express an interest.
Any bid/proposal received under the SBIR program solicitation requirements, shall be considered; otherwise, it cannot be considered. The notice required by FAR 5.201 shall not be published in that the exception at FAR 5.202(a)(7) applies since the action results from acceptance of a proposal under the Small Business Innovation Development Act of 1982.
10. Other Factors:
a. Procurement history:
(1) Contract W31P4Q-16-C-0012 was awarded to CFD Research Corporation (CFDRC), 701 McMillian Way NW, Suite D, Huntsville, AL 35806, CAGE Code ODEW1, on 11 December 2015 under the Army SBIR Program topic number A14-009 to develop, design, fabricate, test, and demonstrate novel cathode materials for thermal battery with high single cell potential, greater than 2.5 volts, high energy density, at a total cost of $934,318.49, fee of $ 65,402.29, for a total CPFF amount of $999,720.78 for the contract.
(2) Competitive status of this current action is sole source. No other source has the necessary hardware, intellectual property, proprietary data, or expert personnel to mitigate the risks associated specifically with CFDRC’s novel cathodes for high capacity thermal battery technology under contract W31P4Q-16-C-0012.
(3) Phase I SBIR contract W31P4Q-14-C-0102 was awarded to CFDRC on 04 June 2014 on a competitive basis for $149,897.01.
(4) There have been no unusual patterns of awards for work of this type.
(5) AMRDEC and the Army SBIR Office continue to make known the national interest in this area of research through briefings to other Government agencies, solicitations, and policy statements.
b. Acquisition Data Availability. This effort will be a continuation of highly specialized work on a sensitive technology area that is based on expertise and previous development available only at CFDRC. Therefore, acquisition data suitable for full and open competition has not been developed for this additional effort. The basic effort of the contract was awarded competitively. No future requirements for this program are anticipated by this office. Any future requirements that may be developed from this program by transition partners will be managed by the requiring office and they will decide on competition methods.
c. Subcontracting Competition. The existing contract includes the Competition in Subcontracting clause, FAR 52.244-5 and Small Business Subcontracting Plan clause, FAR 52.219-9. However, CFDRC is a Small Business and therefore, in accordance with FAR 19.702(b)(1) is not required to submit a Small Business Subcontracting Plan.
