About this file

This justification and approval document authorizes a sole source contract award to King Nutronics Corporation for calibration standards ancillary equipment for the Metrology Calibration program. The Naval Air Warfare Center Aircraft Division will procure 88 tire gauge calibrators and 5 master gauges from King Nutronics for a total value of $1,914,569. The equipment will support aviation maintenance assets and all Navy and Marine Corps calibration laboratories. As the original equipment manufacturer, only King Nutronics can provide parts that fit existing fleet assets. Introducing new equipment would require duplicating 35 calibration procedures at a cost of $744,975. Market research found no other qualified sources.

PATUXENT RIVER, MD 20670-1127

IN REPLY REFER TO

J&A Number: 21-0065

JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity.

Naval Air Warfare Center Aircraft Division (NAWCAD) Patuxent River, MD

2. Description of the Action Being Approved.

This Justification and Approval (J&A) authorizes and approves the issuance of a Firm-Fixed Price contract action on a sole source basis to King Nutronics Corporation (King Nutronics), 6421 Independence Ave, Woodland Hills, CA 91367 for the procurement of Calibration Standards (CALSTDs) ancillary equipment for the Metrology Calibration (METCAL) Program.

It is requested that King Nutronics Corporation be approved as the sole source supplier for the METCAL program.

3. Description of Supplies/Services.

The procurement of CALSTDs ancillary equipment for Aviation Fleet Intermediate Calibration

Activities, Fleet Training Activities, and Aviation Navy Calibration Laboratories (NCLs) to support Aviation Organizational and Intermediate level maintenance assets, which is used by the METCAL Program, which supplies all of the Navy and Marine Corp Calibration Laboratories test equipment worldwide. The procedures of Part 13.5 and Part 12 will be utilized for this commercial acquisition.

The estimated total value of the contract is $1,914,569.00 and is expected to be awarded in FY21. The anticipated delivery date is 120 days after contract award.

The specific CALSTD ancillary equipment consists of the following items:

Item Part Number Description Qty

1 3665-1-1 Tire Gauge Calibrator 88

2 3712-20-10000 Master Gauge 5

Estimated Dollar Value

Funds Type FY 21

APN $ 1,914,569.00

Total $ 1,914,569.00

J&A Number: J&A: 21-0065

4. Statutory Authority Permitting Other Than Full and Open Competition.

10 U.S.C. 2304(c)(1), Only one responsible source and no other supplies or services will satisfy agency requirements.

5. Rationale Justifying Use of Cited Statutory Authority.

King Nutronics is the Original Equipment Manufacturer (OEM) of the current fleet assets. Due to the equipment being highly specialized, the parts from the OEM are the only ones that can fit the pressure calibration of the support equipment for the METCAL Program. This requirement is to replace damaged units and fleet deficits that are either no longer reliable or not economically repairable. The listed P/N’s are required due to their capabilities, ranges and the mating requirements for the Test Instruments (TI’s). As such, the above listed part numbers’ and all of their internal and/or external components are only available from King Nutronics. Additionally, King Nutronics has proprietary rights to the design, engineering and documentation of the associated parts. These models are being procured for use with NAVAIR workload Instrument Calibration Procedures (ICP's) and hundreds of test instruments for the calibration of Pressure Gage Calibrators, Pressure Gage Cleaning Systems, and Thermo Units.

Per NAVAIR METCAL Subject Matter Experts, an attempt to introduce a new model number would require a total of 35 instrument calibration workload procedures to be duplicated. Each ICP procedure includes: procedure re-write, bench-test, quality assurance check, calibration interval analysis and/or change as required, publication costs, data element/database support/updates at a cost of $21,285.00 per procedure for a total cost of $744,975.00 resulting in a substantial duplication of cost to the Government that would not be recovered through competition. In addition, there are no other model numbers that could replace the equipment due to the systems supported. All calibration activities now utilize the same CALSTDs and Standard Instrument Calibration Procedures to support similar workloads and cannot be deviated or substituted. This has minimized the number of calibration procedures used Navy-wide, reduced the training requirements, causing fewer interface problems between equipment, reduced calibration time and improved compatibility between calibration laboratories. King Nutronics CALSTD ancillary equipment’s scale, design, and proven calibration activities will reduce program risk, schedule, and cost.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

As described in paragraph 5 above, NAVAIR METCAL Subject Matter Experts who support the Engineering Group are familiar with current trade studies and the technology environment. The Subject Matter Experts regularly conduct market research by utilizing various web searches and staying current on the marketplace for these items. The Subject Matter Experts are unaware of any other sources that are capable of satisfying the Government’s requirements.

No additional market research was conducted because it is not practicable, for the reasons discussed in paragraph 5 above, for any company other than King Nutronics to provide the required supplies and services. Purchasing a brand other than King Nutronics would require a

J&A Number: J&A: 21-0065 duplication of work and cost for the Government.

A Notice of Intent was posted to Beta-SAM on 31 July 2020, for a period of 15 days. No responses were received. King Nutronics is the only source with the requisite knowledge, experience, and technical expertise for calibration equipment as necessary for the METCAL program in a timely and cost effective manner.

A synopsis of the proposed procurement was published in the System Award Management (SAM) Beta and in accordance with FAR Part 12, the Government issued a Request for Quotation (RFQ) for this sole source requirement for a period of 15 days. No additional responses were received.

7. Determination of Fair and Reasonable Cost.

In accordance with FAR 15.402, the Contracting Officer shall ensure that all supplies provided under this contract are procured at a fair and reasonable price. An analysis of the proposals will be performed by the Contract Specialist. The Contracting Officer will use price analysis as the basis of determining the price as fair and reasonable for the Tire Gauge Calibrator and Master Gauge covered by this J&A. Information related to prices including established catalog prices and previous procurement for commercial and Government purchases will be utilized in justifying a fair and reasonable price.

8. Actions to Remove Barriers to Future Competition.

For the reasons set forth in paragraph 5, NAVAIR has no plans at this time to compete future contracts for the type of supplies covered by this document. NAVAIR METCAL Subject Matter

Experts will continue to conduct market research to allow for future competition. If another potential source emerges, the contracting activity will assess whether competition of future requirements is feasible.
