1.3. PROCUREMENT OFFICER

The Procurement Officer, acting on behalf of the FDACS, is the sole point of contact for official meetings, questions, and all procurement related matters relating to this solicitation.

The Procurement Officer for this ITB is:

Brenda Paul, Procurement Officer Florida Department of Agriculture and Consumer Services Email: ConstrcutionBids@FDACS.gov

Between the release of the solicitation, and the end of the 72-hour period following the agency posting the notice of intended award, excluding Saturdays, Sundays, and State holidays, any employee or officer of the executive or legislative branch concerning any aspect of this solicitation, except in writing to the Procurement Officer or as provided in the solicitation documents. Violation of this provision may be grounds for rejecting a response.

1.4. MANDATORY REQUIREMENTS

The FDACS has established certain requirements with respect to bids to be submitted by Bidders. The use of “shall”, “must” or “will” (except to indicate simple futurity) in this ITB indicates a requirement or conditions from which a material deviation may not be waived by the Department. A deviation is material if, in the Department’s sole discretion, the deficient response does not substantially accord with the ITB requirements, provides an advantage to one Bidder over other Bidders, has potentially significant effect on the quantity or quality of items bid, or on the cost of the Department. Material deviations cannot be waived. The words “should” or “may” in this ITB indicate desirable attributes or conditions but are permissive in nature. Deviation from, or omission of, such a desirable feature, will not in itself cause rejection of a Bid.

1.5. CONFLICTS AND ORDER(S) OF PRECEDENCE

All bids are subject to the terms of the following provisions of this ITB, which in case of conflict shall have the following order of precedence:

1) Addenda, in reverse order of issuance,

2) ITB, including attachments and appendices, and

3) Construction Contract.

1.6. MANDATORY PRE-BID CONFERENCE

The mandatory pre-bid conference for prospective Bidders will be held at 10:00 AM (ET), on December 2, 2025, at 6265 County Road 832, Felda, FL 33930. Bidders will be required to sign in at the pre-bid conference with their company and company representative.

The purpose of this conference will be to clarify the contents of this bid to prevent misunderstanding of the Department’s terms, conditions, and specifications for this project. The conference will consist of a session wherein each page of the bid (including technical specifications) will be discussed. General questions related to the specifications and plans for this project will be answered. Any material changes to the bid terms, conditions, plans, or specifications must be stated in writing in the form of an addenda issued through the Department’s purchasing office (see Section 4.4 ADDENDA).

mailto:Bids@FDACS.gov

Bidders must submit their signed copy of the ATTACHMENT A - CERTIFICATION OF SITE VISIT with their bid response. Any bid received from a prospective Bidder who did not attend the mandatory pre-bid conference will not be considered.

SECTION 2.0 TECHNICAL SPECIFICATIONS

2.1. SCOPE

The Contractor awarded the bid (“Contractor or Awarded Contractor”) shall furnish all labor, materials, equipment, tools, transportation, supplies, and supervision required to complete the project in accordance with the specifications outlined herein.

2.2. SPECIFICATIONS

The Contractor shall perform road improvement and repair services on approximately two (2) miles of forest roads within Okaloacoochee Slough State Forest. Work shall include crowning, capping, adding road base, shoulder stabilization, grading and packing secondary forest roads.

The roads identified for improvement were previously constructed using compacted lime rock material. However, for the purposes of this project, any existing lime rock or other aggregate shall not be counted toward the total aggregate required for this project.

The primary road work area will require the addition of lime rock road base. This project is intended to enhance the existing roadbed and does not include improvements to low water crossings or culverts. Please refer to APPENDIX I – MAPS for project location details.

2.3. MATERIALS

All aggregate road materials used in the project must be Florida Department of Transportation (FDOT) certified grade road base. Materials shall be free of lumps or aggregates that would prevent the Florida Forest Service (FFS) from achieving a smooth, pit-free surface.

• Product must be free of trash, foreign matter, and exotic plant species.

• The FFS reserves the right to inspect the Awarded Contractor’s source mine for invasive species and may reject the bid if such species are present.

2.4. GRADING AND SLOPING

The finished road surface shall be graded and compacted to create a smooth, durable driving surface. Specifications include:

• Finished road width: 16.5 feet, where feasible.

• *Centerline crown slope: 2% to 3% (approximately 1 inch per 10 feet).

• Four inches (4") of compacted FDOT-certified lime rock at the *centerline crown on designated sections (APPENDIX I – MAPS).

• Non-compacted shoulder material shall not contribute to the road surface width and must be blended into the existing shoulder.

2.5. DELIVERY AND ACCESS

The Forester Area Supervisor must be contacted before the Awarded Contractor may begin work on this project. In the event of a large amount of rainfall and high traffic use, the Forest Area Supervisor reserves the right to adjust routes or postpone delivery or work if road conditions deteriorate to prevent further road damage that may result in more work or repairs.

Access can be gained to all tracts from paved public roads. Refer to the APPENDIX I - MAPS for access points and haul routes.

It is the responsibility of the Contractor to ensure access for hauling materials and construction.

In the event of significant rainfall or other road deterioration, the contractor will be expected to improve conditions to meet construction deadlines.

2.6. STORAGE

Material staging areas may be provided to the Contractor upon request. The designated staging area will be established by the FFS Forest Area Supervisor. Contact Thomas Gonzalez, Forest Area Supervisor, at (239) 229-0132 if any access improvements are required or to establish a designated staging area.

2.7. ESTIMATED QUANTITIES

The mileage provided is an estimate and should be used as a guideline for bid preparation. It does not represent the exact mileage to be completed.

• The FFS may contract for up to 20% additional mileage at the same unit price, subject to mutual agreement.

• Road mileage will be rounded to the nearest one-tenth (0.1) mile.

• Additional work may be contracted under this ITB within Okaloacoochee Slough State Forest if completed prior to June 30, 2026, at the same unit price per one-tenth (0.1) mile.

The Department reserves the right to increase or decrease the total mileage for this project.

2.8. CONTRACT / CONSTRUCTION PERIOD

Whenever the word “day” is used in the contract documents, it shall mean a calendar day, unless otherwise specifically provided. The date of commencement of the work is the date established in a written Notice to Proceed. The Department shall furnish a Notice to Proceed along with the executed contract.

Construction shall be substantially complete within 150 calendar days after issuance of the Notice to Proceed. The contract period shall be completed by June 30, 2026, which shall consist of 150 calendar days to substantial completion of work after issuance of the Notice to Proceed and 60 calendar days beyond substantial completion to complete the project close-out process. The time for completion of the work includes, without limitation, obtaining any required permits not obtained by the Department, and other governmental and quasi-governmental approvals, acquiring bonds and interim and final inspections. TIME IS OF THE

ESSENCE WITH RESPECT TO THE TIME OF COMPLETION OF THE WORK.

2.9. CONTRACT / PROJECT MANAGER

The Contractor will coordinate and schedule all work with the Department’s Contract Manager, Michael Weston, Forestry Resources Administrator, (239) 220-2404.

2.10. CONTRACTOR WARRANTY AND GUARANTEE

The Contractor shall furnish to the Department a one (1) year written warranty and guarantee per specifications, which includes all parts and labor. The guarantee shall be provided within 10 days from substantial completion of the project. The one (1) year period will start upon substantial completion of the project as determined by the Department.

2.11. PRODUCTS FOR APPLICATION AND INSTALLATION

The Contractor shall not change the approved products at any time during the performance of the awarded contract, without prior written approval from the Department’s Contract Manager.

Liquidated damages in the “per day” amount set forth in Section 5 hereof shall begin upon the Department’s Notice of use of improper products and continue until the Contractor remediates and substitutes the improper product with an authorized product, all at the expense of the contractor. If an unapproved substitution is submitted with a bid, the subject Bidder will be deemed nonresponsive and subsequently disqualified. The Department reserves the right to reject any substitution requests.

SECTION 3.0 BIDDER QUALIFICATIONS

3.1. PERFORMANCE QUALIFICATIONS

The Department reserves the right to investigate or inspect at any time whether the product, qualifications, or facilities offered by Contractor meet the Contract requirements. Contractor shall at all times during the Contract term remain responsive and responsible. In determining Contractor ’s responsibility as a vendor, the agency shall consider all information or evidence which is gathered or comes to the attention of the agency that demonstrates the Contractor ’s capability to fully satisfy the requirements of the solicitation and the contract.

Contractor must be prepared, if requested by the Department, to present evidence of experience, ability, and financial standing, as well as a statement as to plant, machinery, and capacity of the Contractor for the production, distribution, and servicing of the product bid. If the Department determines that the conditions of the solicitation documents are not complied with, or that the product proposed to be furnished does not meet the specified requirements, or that the qualifications, financial standing, or facilities are not satisfactory, or that performance is untimely, the Department may reject the response or terminate the Contract. Contractor may be disqualified from receiving awards if Contractor, or anyone in Contractor’s employment, has previously failed to perform satisfactorily in connection with public bidding or contracts. This paragraph shall not mean or imply that it is obligatory upon the Department to make an investigation either before or after award of the Contract, but should the Department elect to do so, Contractor is not relieved from fulfilling all Contract requirements.

3.2. CLARIFICATIONS / REVISIONS

Before award, the Department reserves the right to seek clarifications or request any information deemed necessary for proper evaluation of submissions from all Bidders deemed eligible for Contract award. Failure to provide requested information may result in rejection of the response.
