About this file
This is a Request for Bid (RFB) #ILI0020 issued by the Wisconsin Department of Workforce Development for Chiropractic Dispute Resolution Services. The procurement is governed by Wisconsin Statutes section 16.75 and seeks to establish a panel of up to eight qualified chiropractors to provide expert review services for workers' compensation disputes within the state of Wisconsin.
The contracted services involve conducting fair and impartial reviews of disputed chiropractic treatments between healthcare providers and workers' compensation insurers or self-insured employers. Panel members must be licensed chiropractors engaged in full-time practice (minimum 30 hours per week with at least 20 hours in Wisconsin) with a minimum of 10 years of chiropractic experience and 5 years of treatment review experience. The contract will be awarded to the lowest cost, responsible bidders based on hourly rates, with payments made upon completion of each review. The initial contract period is three years with two one-year automatic renewal options, subject to fund availability. During fiscal year 2016-2017, the department spent approximately $18,000 on similar services. Pricing must remain firm for the first year, with subsequent increases limited to documented industry-wide cost increases approved by the contract administrator. The RFB includes a 5% preference for certified minority business enterprises and requires written expert opinions to be delivered within 90 days of receiving case materials.

1.0 INTRODUCTION AND PURPOSE
1.1 Purpose and Intent of Request for Bid
The purpose of this document is to provide interested vendors with information on preparing and submitting a sealed bid for Chiropractor Dispute Resolution Services for the Department of Workforce Development (DWD). The goal of the service provider is to resolve disputes between a chiropractor and an insurer or a self-insured employer regarding the necessity of treatment for an injured employee claiming benefits under the Wisconsin Worker’s Compensation law.
The DWD Worker’s Compensation Division is creating a panel of chiropractors to perform fair and impartial reviews and issue written opinions on whether treatment which is being disputed by a workers compensation insurer or self-insured employer was necessary to cure and relieve the effects of a work-related injury. The panel members must be chiropractors who are appropriately licensed to practice and are engaged in full time practice.
The State, as represented by DWD, intends to use the results of this request for bid (RFB) process to establish DWD Procurement Contracts for up to eight reviewers within the state of Wisconsin.
Contractors will be contacted as cases are identified. The decision to contract with a specific contractor will be at the discretion of the Division on a case by case basis, based on a determination of proposed service effectiveness and contractor’s availability.
The results of this bid process may also be used by the State to award additional similar contracts with other state agencies.
The State of Wisconsin retains the right to award contracts for related services from other existing State of Wisconsin Procurement Contracts, if any.
1.2 Project Overview/Scope of Bid
In making a decision regarding the necessity of the treatment in dispute, the panel member shall use accepted chiropractic standards that are in use at the time the services were provided in the Wisconsin chiropractic community and treatment guidelines the Division may adopt by administrative rule. When necessary to provide a fair and informed decision in a specific dispute, the expert may contact the chiropractor under review, the insurer or self-insured employer which is a party for clarification of issues raised in the written materials. If the contact is in writing, the panel member shall provide all parties to the dispute with copies of the request and the responses. If the contact is by telephone, the panel member shall arrange a conference call giving all parties an opportunity to participate simultaneously. The panel member must notify the Division when the parties have been contacted for clarification of the issues. The panel member shall provide a copy to the Division of all additional documents received by the panel member. The Division shall not incur the costs (including photocopy charges) associated with a panel member’s request for additional information.
The panel member shall issue a written opinion regarding the treatment in dispute within 90 days after he or she has received the materials relating to the dispute from the Worker’s Compensation Division. Copies of the written opinion must be provided to the Division and the parties to the dispute. A request for additional information from the parties by the panel member does not extend the 90-day time limit for submitting a written opinion to the Division.
1.3 Retention of Rights
The State of Wisconsin retains the right to accept or reject any or all bids if it is deemed to be in the best interests of the State of Wisconsin.
The results of this bid may also be used by the State to award additional similar contracts with other State agencies.
The Contractor shall not have exclusive rights to provide all services and supplies during the term of the contract or any extension of the contract.
All bids become the property of DWD upon receipt. All rights, title and interest (including the right to exploit for the State’s purposes) in all materials prepared by the responder for the bid to DWD shall be the exclusive property of DWD and may be used by the State at its option.
DWD retains the right to obtain services other than the Contractor’s to accomplish required processes and/or procedures to the system through whatever means deemed necessary by DWD.
1.4 DWD Contract Administrator
The contract resulting from this RFB will be administered by Carmen Hidalgo, Department of Workforce Development, Purchasing Section. All contacts between the bidder and the contracting agency will be through the designated agency representative unless otherwise instructed. The designated agency representative will be Jim O’Malley. The bidder shall meet with the designated agency representative as requested to resolve problems. Any problems which cannot be resolved between the designated agency representative and the bidder will be referred to the Contract Administrator. The Contract Administrator will inform the bidder in writing of the unresolved issues and the bidder will respond with proposed corrective actions within 10 days of receipt of letter. The state and/or the bidder can request meetings to address unresolved contract issues.
1.5 Contract Period and Extensions
Contract period will be for three years with two one-year automatic renewals. The Contract shall automatically be extended unless DWD Procurement is notified, in writing from the contractor or, DWD notifies the contractor, in writing ninety (90) days prior to expiration of the current contract period. Renewals are subject to the availability of funds. Additional contract extensions may be granted in order to complete a case which was initiated during the original one-year or two one-year renewal periods. The extension may continue until the resolution of the pending case.
1.6 Contract Termination
The Contract shall be subject to termination under any of the following conditions:
1.6.1 Default by the Contractor
DWD may, by ninety (90) calendar days prior written notice to the Contractor signed by DWD’s Contract Administrator, terminate the Contractor’s right to proceed as to the contract if the Contractor:
• Materially fails to perform the services in accordance with the contract, or
• Fails to make progress as to materially endanger performance of the contract in accordance with its terms.
Termination at the option of DWD shall be effective ninety (90) calendar days after receipt of such notice, unless the Contractor shall have corrected any alleged failure(s) within thirty (30) calendar days after receipt by the Contractor of such written notice which shall specify fully and in detail each material failure to be corrected by the Contractor. DWD shall waive its right to terminate for cause any such failure(s) to perform which, in the exercise of due diligence, cannot be cured in such thirty (30) calendar day period provided that: (a) the Contractor produces a written plan of correction accepted by DWD, in writing, and (b) the Contractor shall within such thirty (30) calendar day period commence and thereafter continue diligently to cure such failure(s) to perform, and
(c) no such extension has been granted previously. In the event of such termination, in addition to any other legal rights or remedies DWD may have, DWD may procure or furnish services similar to those so terminated, and the Contractor shall be liable to compensate DWD for any costs up to the amount of the contract and any federal penalties attributable to the Contractor under the contract.
1.6.2 Financial Instability
DWD may terminate the contract without paying termination costs if the Contractor files or has filed against it a petition in bankruptcy or insolvency and that petition is not dismissed within forty-five (45) calendar days.
1.6.3 Termination in the Interest of the State
DWD’s Contract Administrator, by ninety (90) calendar days prior written notice, may terminate performance of work under the contract when it is in the best interest of the State to do so. In the event of such termination, the Contractor will be compensated for all work performed prior to such termination date and for all reasonable costs and liabilities to which the Contractor has, out of necessity, obligated itself as a result of the contract which are applicable to any period after such termination up to the term of the contract as determined in accordance with the applicable provision of 41 CFR, Sections 1-8. The Contractor shall use reasonable efforts to minimize the cost to the State.
1.6.4 Default by the State
The contract may be terminated by the Contractor, for cause, upon the failure of DWD to perform any material provision required of it by the contract, provided the Contractor give DWD’s Contract Administrator ninety (90) calendar days prior written notice of the reasons for such termination, including sufficient details to enable DWD to correct these errors and/or omissions. Termination, at the option of the Contractor, shall be effective ninety (90) calendar days after receipt of such notice, unless DWD shall have corrected said failure(s) within thirty (30) calendar days from receipt of the notice. DWD shall not be deemed in default so long as DWD shall within such period commence and thereafter continue diligently to cure such failures and provide relief as necessary to the Contractor through the Change Order and Delay provisions of the contract. The competency of DWD staff shall not be reason for finding the State in default.
The Contractor shall, in the event of a termination, be paid all monies due the Contractor at the effective date of the termination, including all applicable portions of the holdback and payment for completed work for all current deliverables.
1.6.5 Availability of Funds
It is understood and agreed by the parties hereto that all obligations of DWD, including the continuance of payments hereunder, are contingent upon the availability and continued appropriation of State and federal funds, and in no event shall DWD be liable for any payments hereunder in excess of such available appropriated funds. In the event that the amount of any available or appropriated funds provided by the State or federal sources for the purchase of services hereunder shall be reduced, terminated or shall not be continued at an aggregate level sufficient to allow for the purchase of the specified amount of services to be purchased hereunder for any reason whatsoever, DWD shall notify the Contractor of such reduction of funds available and DWD shall be entitled to reduce its commitment hereunder as it deems necessary.
1.7 Sales Volume
During the fiscal year period of July 1, 2016, through July 1, 2017, DWD spent approximately $18,000.00 for chiropractic dispute resolution services.
1.8 Pricing and Discounts
All costs for the contract must be included in the cost detail sheet. These cost items are detailed in and are included in Section 6.0, Cost Information and the Bidder Cost Sheet(Attachment A).
Prices are to remain firm during the first year of the contract. After that date, if there has been an industry-wide price increase, prices may be increased by the same amount as the cost increase to the contractor. Notice of price increases must be fully documented and submitted to the Contract Administrator 30 days before the date of the proposed effective change. Documentation shall include copies of the supplier's notification to the vendor of the increase including the effective date. Increases shall not affect any orders written prior to the effective date of the increase. The Contract Administrator shall approve price increases.
Any price reductions passed on to other customers occasioned because of a competitive "softening" of the market are to be correspondingly offered at the same ratio to the state. Prices may be lowered at any time. Failure on the part of the vendor to promptly accord such industry-wide price decreases may constitute a breach and the contract may be cancelled. The state reserves the right to award any cancelled contract to the next low bidder if it is determined to be in the state's best interest. In the event of a decrease in price, the contractor(s) shall immediately notify the contract administrator of such decreases and issue revised price lists to cover this reduction. The decrease in price to the State of Wisconsin shall become effective on the same date as the decrease is effective to the contractor(s).
