Construction

2.1 STATEMENT OF WORK

STATEMENT OF WORK

I. Introduction The contractor shall provide all necessary labor, materials, equipment, and supervision to renovate housing unit "M", located at the Federal Correctional Complex, 3901 Klein Boulevard, Lompoc, California 93436. The Federal Correctional Complex will be identi-fied as the complex, throughout this Statement of Work.

II. Objective

1. Unit "M" Plumbing Chase

A. Remove and discard all existing plumbing, straps, supports and appurtenances.

B. Remove and discard all existing electrical conduits, j-boxes and appurtenances.

C. Remove and discard all existing exhaust fans, shrouds and appurtenances.

D. Remove and discard all existing metal grating planks, dirt, rubbish and debris.

E. Clean and disinfect plumbing chase and leave ready to receive installation of new work.

F. Provide and install new plumbing lines, straps, supports and appurtenances to provide complete and functioning systems. Water supplies to plumbing fixtures to be provided with an isolation solenoid shut-off valves with controls to be located immediately inside the lower level plumbing chase doors.

G. Provide and install new conduit , conductors, j-boxes, and appurtenances to provide complete and functioning systems.

H. Provide and install new variable speed exhaust fans, shrouds, and appurtenances. Controls to exhaust fans to be located at a remote office location outside the plumbing chase. Location to be determined on site with FBOP Contract Monitor.

I. Provide and install new galvanized metal grating cat-walk system for access for maintenance.

J. Provide and install new security hollow metal plumbing chase doors and frames, with certification that construction is in accordance with the proper UL fire rating. Locking hardware shall be 86 series type lock (prison lock).

K. Provide and install Thermostatic mixing valve with re-circulation system for shower use and additional service valve for mainten-ance.

2. Unit "M" Cells

A. Remove and turn over to the FBOP all existing plumbing fixtures.

B. Remove and discard all security air grilles.

C. Provide and install new stainless steel security plumbing fixtures (combination units), in all cells.

1. Water Closet/Lavatory Combination Units- Cabinet: Floor mounted, 14-gauge type 304 stainless steel, fully welded seamless con-struction, with an integral toothbrush and toilet paper holder.

2. Water Closet: Elongated bowl, low flow (6.0 lpf), wall outlet, blow-out type with an integral seat. Flush valves shall be cast brass or cast bronze. Operation shall be by a penal pushbutton located on the unit.

3. Lavatory: Provide a pneumatically operated dual temperature metered (5 to 90 seconds) valve with penal pushbuttons and filler/ bubbler. Valve shall be cast brass or cast bronze and have a maximum flow rate of 2 LPM. Note that existing combination unit is an Acorn, Model 1418-CT-1LF-4-CW-W03

D. Provide and install new security type mirrors and air grilles. Mirrors shall be detention grade heavy duty minimum 20 gauge stain-less steel with high-reflective 2B bright annealed surface. Mirror shall be tamper resistant and formed in one piece; mounted directly to wall at a minimum of 6 points.

E. Provide and install at all cells, security type fire sprinklers heads.

1. Sprinklers: Sprinklers shall have a minimum pressure rating of 1200 kPa. Institutional grade sprinkler heads. Manufactures standard maximum security head for correctional facilities. Head is to have a chrome finish and retaining flange. O-ring type sprinklers are NOT acceptable for any portion of the work of the contract.

F. Provide and install, in each cell, an inmate duress system with local annunciation/control panels in accordance with the FBOP Technical Design Guidelines, as described below:

F.1 SYSTEM DESCRIPTION

A. An INMATE DURESS push button shall be located in each inmate cell for the purpose of signaling staff.

B. A reset station with a three position (maintained center position) key switch and two red LED's shall be located in the day space between each pair of cells. For the last cell of a row with an odd number of cells there shall be a single cell reset station consisting of a single red LED and a two position key switch with a maintained left position and momentary right position.

C. Each housing annunciator panel is equipped with a red LED for each cell. a summary LED for the opposite wing of the housing unit (where applicable), a tone silence switch, and a gang reset key switch, The gang reset key switch must be keyed different from the cell reset key switch.

D. The Central Control touchscreen shall have an alarm icon associated with each Inmate Duress housing annunciator panel described in the previous paragraph.

F.2 - PRODUCTS

A. Cell call-in switch shall be flush mounted security type installed in cells as shown on the drawings. Faceplate shall be 11 gauge stainless steel with beveled edges installed with approved security fasteners. Switch shall be momentary contact type. Switch as-sembly shall be similar to Atlas/Soundolier VPB-1 or similar product approved by the Contract Officer and Contract Monitor.

B. Dual Cell Reset station shall consist of a three position (momentary contact left and right positions, maintained center position), key operated switch with two vandal proof, flush mounted red LEDs on a single gang stainless steel switch plate installed with ap-proved security fasteners. Switch shall be operated by a standard 25 mm mortise cylinder. Cylinder shall be furnished. All cylinders shall be keyed alike. Switch contacts shall be rated 5 amperes at 24 volts. The back box mounting plate shall be equipped with a slot-ted hole to allow field adjustment so that the switch can be installed straight. It shall not require excessive force to operate the key switch, as a test, if a common tooth pick is inserted into the key ring hole of the key and is used as a lever the key switch shall operate before the tooth pick breaks. The switch mechanism shall be protected by a stop so that the switch can not be destroyed by actuating the key. The reset station shall be the DR series reset station by Easter Owens or approved equal.

C. Single Cell Reset Station shall be the same as a Dual Cell Reset station except it shall consist of a two position (momentary right position, maintained left position), key operated switch and a single vandal proof, flush mounted red LED.

D. All reset switches shall be keyed alike and all group reset switches shall be keyed alike. Reset station switches shall be keyed dif-ferent from group reset switches.

E. Contractor shall furnish a total of 20 keys for reset stations and 10 keys for group reset key switches.

F. Group reset key switches shall be 4 tumbler, tubular type, two position, key pull in left position, momentary right position with back locking ring, as manufactured by Chicago Lock Ace II series.

G. The Programmable Logic Controller shall be as specified as Programmable Logic Controller.

H. Control panels shall be custom fabricated.

I. If the conduit for the switches and push buttons is installed at or below ground level, slab cables or conductors from the devices shall be rated for wet locations.

F.1 INSTALLATION

A. Install inmate duress system at locations as shown on the drawings.

B. Develop PLC software to effect required system operation.

C. Communications circuits shall be extended from the PLC to the PLC network for report to Central Control via the Security Monit-oring and Control System.

D. Apply security caulk to fill gaps, including mortar joints, around the faceplate for inmate duress pushbuttons or reset stations.

E. Testing: The completed system shall be tested by the Contractor prior to the acceptance test.

3. Unit " M" Showers

A. Remove and discard existing fixtures, curbs, drains, finishes, etc. as required and adjust existing space to receive new stainless steel showers. Walls of drying area shall be ceramic tile, 110 mm x 110 mm (4 1/4" x 4 1/4"), glazed tile. Floor tile and floor curbs shall be porcelain tile 51 mm x 51 mm (2" x 2"), unglazed slip resistant tile. Grout shall be water-cleanable epoxy grout. (ANSI A118.3). Use latex Portland cement tile setting mortar (ANSI A118.4).

B. Provide and install new security control panels, valves, handles and appurtenances for complete and operable shower units at the following locations: four per floor at levels 1,2, and 3. Total units required = 12. Shower cabinets shall be constructed of 14 gauge type 304 stainless steel, fully welded seamless construction, slip resistant base, integral soap dish and tension release towel hook.

Provide a pneumatically operated single temperature metered (5 to 90 seconds) valve with a penal pushbutton and a 9.5 LPM shower head. Valve shall be cast brass or cast bronze. Provide closure panels to prevent top of cabinet from being used to hide contraband and to conceal piping behind and beside shower cabinet. Closure panels shall be continuously supported along walls and ceilings by angles anchored to the surface. Fasteners are to be stainless steel rivets 150 mm (6") on center.

4. Unit "M" Basement

A. Remove and discard all existing plumbing, straps, supports and appurtenances.

B. Remove and discard all existing electrical conduits, j-boxes and appurtenances.

C. Provide and install new plumbing lines, straps, supports, and appurtenances to provide complete and functioning systems.

D. Provide and install new conduit, conductors, j-boxes, and appurtenances to provide for complete and functioning systems.

5. Unit "M" Common Areas and Staff Office

A. Remove and discard all existing plumbing, straps, and appurtenances to washing machines, fire hose boxes, and mop sinks at each level.

B. Remove and discard front door and frame to Unit. Lockset to be turned over to FBOP.

C. Remove and discard the electrical sub-panels in the staff office.

D. Remove and discard all emergency lighting, conduits, j-boxes and appurtenances.

D. Provide and install new electrical sub-panels, breakers and appurtenances to provide complete and functioning systems.

E. Provide and install new plumbing lines, mop sinks, straps, supports, and appurtenances to provide complete and functioning sys-tems.

F. Provide and install new front door, frame and appurtenances. Door face sheet thickness shall be 12 gauge and door frame shall be 12 gauge. Locking hardware shall be 86 series type lock (prison lock).

G. Provide and install new emergency lighting, conduits, j-boxes and appurtenances to provide complete and functioning systems.

III. ADDITIONAL INFORMATION

A. A site visit shall be scheduled prior to the close of Invitation for Bids (IFB). Vendors are encouraged to attend, although not re-quired. The contractor may inspect and identify components of individual systems at that time.

All work on the Unit "M" project shall meet all current Federal, State, and local building codes and National Fire Protection Associ-ation (NFPA) codes and standards.

The contractor awarded the contract will be responsible to ensure the premises clean and free from accumulations of waste materials and rubbish at all times. The contractor will remove all debris, scrap, and rubbish from the work area daily. Surplus materials and all equipment shall be promptly removed from the site upon completion of the work. Prior to final acceptance, the Contractor shall restore all areas affected by his work to their original state of cleanliness and repair all damage done to the premises, by his workmen and equipment.

B. Contractor Security/Working Regulations.

1) Access to the site will be available during normal working hours except during emergencies. It shall be the responsibility of the Contractor to familiarize himself, his employees, and his subcontractors of the working hours and conditions in the correctional facil-ity, as working hours may not constitute a full eight-hour work day. The Government assumes no responsibility to the Contractor nor to any of his subcontractors for shorter hours due to institutional emergencies or entry and/or exit of workers necessitated by normal institution routines. The procedures and institutional entrance/exit routines applicable to this project will be explained at both the pre-bid conference/site visit and the pre-construction meeting.

2) Any work required to be completed at any other time than noted above must be scheduled five (5) working days prior to the start of work.

3) No work will be conducted on weekends, or federal holidays unless prior written approval from the FCC Lompoc Contracting Of-ficer and is received five (5) working days prior to the start of the work.

C. Occupancy Requirements

Full Bureau of Prisons (BOP) Occupancy: The BOP will occupy the site during the entire construction period. Cooperate with the BOP during construction operations to minimize conflicts and facilitate government usage. Perform the work so as to not interfere with the BOP's operations.

D. Delivery of Materials

1) All construction materials/equipment required for work on this project is required to be processed by the Contractor and coordin-ated with the institution Contract Monitor for temporary storage.

2) All other construction related deliveries which are directly shipped to the contractor can be received between the hours of 7:30 a.m.

to 2:00 p.m., Monday through Friday, excluding Federal Holidays. At no point will a Bureau of Prisons (BOP) staff member receive or sign for a delivery if the contractor or his representative is not present to verify and accept the delivery. Under no circumstances will FCC Lompoc or its staff be responsible for the acceptance of any Contractor or company deliveries.

3) The contractor shall be responsible for providing their own mean's of loading and unloading contractor material or equipment.

4) The contractor shall not use the Complex entry/driveway for the loading, unloading, or storage of any materials and equipment. The contractor will not impede/block the driveway at any time during or after the work shift.

E. Storage of Materials and Equipment

1) All construction materials/tools shall be stored in a designated area mutually agreed upon between the Contract Monitor and the contractor. The storage area will be a secure lockable gang box or similar, size to be determined by the contractor and the Contract Monitor. A gang box can be stored inside the rear gate area and would be required to be double locked with a contractor lock and an FCC Lompoc lock for security purposes. All tools will be inventoried prior to entering the Complex Institution and will be inventoried back in to ensure accurate accountability when exiting the institution at the end of the work day.

F. Security Clearance/Contractor Badges

1) All Contractors/subcontractors working at FCC Lompoc will be issued and required to wear a picture ID/contractor badge provided by the Complex. For security reasons, the badge will be worn in a visible manner as directed by the Contract Monitor. Note: This will also be dependent upon the actual length of time that the Contractors are expected to be on-site.

2) The Contractor shall be responsible for providing the necessary information for security clearance on employees to the Contract Monitor; including names, date of birth, social security number, and U.S. Citizenship documentation, if not U.S. born.

3) In the event a Contractor's employee does not pass the security clearance, it shall be the Contractor's responsibility to submit anoth-er employee for security clearance.

4) All security clearances shall be submitted to the Contract Monitor, a minimum of fourteen working days prior to the start of work.

Security clearances will be in effect for the term of one year, and prior to the time of expiration it is the responsibility of the contract-or/worker to notify the Contract Monitor to have clearance conducted and a badge issued.

5) All contractors and subcontractor employees will provide a check list of all employees on site each day to the Contract Monitor, verifying the number of workers on site each day and that all workers are approved to be on site.

G. Safety and Personal Protective Equipment

1) All contractors and employees shall have and wear the required personal protective equipment prescribed by industry standards at all times while on the job site. It is the responsibility of the contractor to provide such equipment.

2) All ladders regardless of the size shall be stored, and secured to a stationary fixture with a chain and lock in a predetermined area, in a way that they cannot be removed.

3) All extension cords regardless of length shall be in good condition with no broken outer insulation and will be secured in a locked construction gang box.

4) Any system requiring Lock-out/Tag-out shall have both Contractor and FCC Lompoc locks on the isolation point to prevent shock.

All Lock-out/Tag-out procedures will be in compliance with the Complex Lock-out program.

H. FCC Lompoc staff shall ensure all power sources required for safety to prevent back feeding are locked-out and tagged-out with Contractor and FCC Lompoc representative signatures.

I. FCC Lompoc staff will ensure a representative is present to allow access to all areas requested by the Contractor.

J. The Contractor shall provide to the Contract Monitor (3) copies of the Material Safety Data Sheets (MSDS) on all materials and substances that may be used during the course of the project. In the event the material is not approved by the Complex Safety Man-ager, it shall be the responsibility of the Contractor to locate and procure an alternative product.

K. Contractors will NOT be allowed to bring cell phones, cameras or two way pagers into the Complex Institutions. FCC Lompoc Fa-cility Operations Department maintains a digital camera that will be utilized by Complex staff to document the project work. The Con-tractor may have copies of these documentation photos for record keeping.

L. Any deviations from the work schedule hours must be approved by the Contracting Officer and Contract Monitor.

M. At no point will Complex staff receive or sign for a delivery of the Contractor's materials, parts, equipment or other related con-struction items. The Contractor shall accept these deliveries and coordinate with the Contract Monitor the transfer of the delivered items to the work site.

N. Lost time due to security restrictions/considerations. Contractors should plan for a certain amount of time accrued for security con-siderations, i.e., check-in screening, delay due to inmate movements, Complex lock-down, Complex emergencies, etc. In the event of a Complex emergency, the Contractor will be instructed to secure from all work, secure and stow all tools, equipment and materials, and the Contractor will be escorted out of the Complex Institutions. Work will be suspended until the Complex emergency passes.

O. The Contractor shall be responsible for removing all old existing equipment and materials from the Complex property.

P. All Contractor's and their construction staff awarded the project will be required to attend a four-hour orientation and security pro-cedures meeting. The Contractor's and their construction staff shall be required to attend.

2. The Federal Correctional Complex shall not be responsible to provide any telephone or communication lines through any provider for personal or business use.

Clauses by Full Text

FAO-0001 BONDS

(a) Bid Guarantee. Each bidder shall submit with his bid a Bid Bond (Standard Form 24) with good and sufficient surety or sureties acceptable to the Government, or other security as provided in contract provision 52.228-1, in the form of twenty percent (20) of the bid price or not to exceed $3,000,000. The bid bond penalty may be expressed in terms of a percentage of the bid price or may be ex-pressed in dollars and cents. A bid bond is not required for bids of $100,000 or less. (FAR 28.102-1)

(b) Performance and Payment Bonds. Within 10 days after award the contractor shall execute and submit to the Contracting Officer two bonds, each with good and sufficient surety or sureties acceptable to the Government, as follows; a Performance Bond (Standard Form 25) and a Payment Bond (Standard Form 25A). The penal sums of such bonds will be as follows: (Not required for contracts of $100,000.00 or less)

(1) Performance Bond: The penal sum of performance bonds at the time of contract award shall be 100 percent of the original contract price.

(2) Payment Bond: The penal amount of payment bonds at the time of contract award shall be 100 percent of the original contract price.

( c ) For construction contracts greater than $30,000 but not greater than $100,000, the Contracting Officer shall select two or more of the following payment protections, giving particular consideration to inclusion of an irrevocable letter of credit as one of the selected alternatives (FAR 28.102-1(b)(1):

(1) A Payment Bond;

(2) An irrevocable letter of credit (ILC);

(3) A tripartite escrow agreement;

(4) A Certificate of Deposit; or

(5) A deposit of the types of security listed in 28.204-1 and 28.204-2.

(d) Individual Sureties.

(1) Bidders may elect to furnish individual surety bonds. If individual surety bonds are furnished for bid bonds, payment or perform-ance bonds, the individual sureties must submit their bonds proof of ownership and value of the assets which they claim in their net worth at time of bid opening. The Government's preferred method of proof is to have a statement of net worth prepared by a Certified Public Accountant (CPA) in accordance with Generally Accepted Accounting Principles (GAAP). Statements from a CPA that con-tain disclaimers are not acceptable. The statement of net worth on the Standard Form 28, Affidavit of Individual Surety, is insufficient and will not be accepted without additional proof of value and ownership.

(2) Bidders are cautioned that individual sureties must provide complete and detailed information in Block 9 of Standard Form 28 con-cerning other contracts on which they have provided bonds. This information shall include contract number, contract location, amount, and type of bond and telephone number of the involved contracting office. Failure to provide the proof and information required may

IFBP0617IPE10001 Page 15 of 37 result in rejection of the bid or termination of the contract for failure to provide adequate bonds.

FAO-0002 MAGNITUDE

The magnitude of this project is between $1,000,000.00 and $5,000,000.00.

FAO-0003 SIZE STANDARD

The small business size standard is $33.5 million average annual receipts for an offeror's preceeding three fiscal years. The North American Industrial Classification System (NAICS) code for this acquisition is 236118.

FAO-0004 LIQUIDATED DAMAGES

Liquidated damages in the amount of $692.76 shall be assessed for each day of delay (see Clause 52.211-12, Liquidated Damages - Construction).

FAO-0005 REQUIRED INSURANCE

See FAR 52.228-5, Insurance - Work on a Government Installation.

(a) The contractor shall, at his own expense, provide and maintain during the entire performance of this contract at least the kinds and minimum amounts of insurance required in the Schedule or elsewhere in the contract.

TYPE AMOUNT

(1) WORKERS COMPENSATION & EMPLOYER'S LIABILITY $100,000.00

The required Workmen's Compensation Insurance shall extend to cover employee's liability for accidental bodily injury or death and for occupational disease with a minimum liability of $100,000.00.

(2) COMPREHENSIVE GENERAL LIABILITY with a minimum limit of:

Per accident or occurrence for bodily injury $500,000.00

This insurance shall include contractor's protective and contractual liability.

(3) COMPREHENSIVE AUTOMOBILE LIABILITY with the following minimum limits:

Per person $200,000.00 Per Occurrence for Bodily Injury $500,000.00 Per Occurrence for Property Damage $ 20,000.00

(b) Before commencing work under this contract, the contractor shall certify to the Contracting Officer in writing that the required in-surance has been obtained. The policies evidencing required insurance shall contain an endorsement to the effect that any cancellation or any material change adversely affecting the Government's interest shall not be effective (1) for such period as the laws of the State in which this contract is to be performed, or (2) until 30 days after insurer or the contractor gives written notice to the Contracting Of-ficer, whichever period is longer.

( c ) The contractor shall insert the substance of this clause, including this paragraph c, in subcontracts under this contract that require work on a Government Institution and shall require subcontractors to provide and maintain insurance required in the Schedule or else-where in the contract. The contractor shall maintain a copy of all subcontractor's proofs of required insurance, and shall make copies available to the Contracting Officer upon request.

FAO-0006 INSPECTION OF WORK

This provision in no way authorizes anyone other than the Contracting Officer to commit the Government to changes in the terms of the contract. It is determined necessary to designate a Contract Monitor (CM) for this contract, such designation shall be by a separate letter to the individual selected with a copy furnished to the contractor upon award of the contract.

FAO-0007 PRE-CONSTRUCTION CONFERENCE

(a) A pre-construction conference will be held prior to construction, at the institution, between institution officials and the Contractor's representative to discuss general rules and regulations, including tool control, fraternization, conduct, dining facilities, review of the contract documents, etc. Minutes of this conference will be made, covering all items discussed, with copies distributed to all of those in attendance, and to the Regional Facilities Administrator.

(b) The Contractor shall familiarize himself/herself with all procedures involved in normal institution routines. Any requirements which may constitute a problem or result in conflict, will be brought to the attention of the Contracting Officer or his representative for determination.

FAO-0008 MATERIAL APPROVAL SUBMITTAL

Within 10 calendar days after commencement of work or as otherwise established by the Contracting Officer, all materials and articles requiring approval, as contemplated by the Materials and Workmanship clause, shall be submitted by the contractor using the forms furnished at the Preconstruction Conference.

FAO-0009 PREPARATION OF PROGRESS SCHEDULES AND REPORTS

The reports contemplated by the clause herein entitled "Schedules for Construction Contracts" shall be accomplished on and in ac-cordance with instructions pertaining to the forms, Construction Progress Chart and Contract Progress Report. A revised progress schedule is required at each progress meeting.

FAO-0011 CONTRABAND

The Contractor shall inform his employees that intoxicating beverages, drugs, weapons, etc., will not be allowed on federal property in any capacity. This is to include vehicles. Introduction of contraband shall be subject to the penalties prescribed by Title 18 USC-1791.

FAO-0012 EXPLOSIVES

The use of explosives is absolutely forbidden without written authorization from the Contracting Officer and Contract Monitor.

FAO-0013 PARKING AND TEMPORARY OFFICE

Parking will be available at the site to the extent it does not interfere with construction activities. Otherwise, parking shall be provided for by the Contractor, at his expense, off the site for workmen employed on the project. Any temporary field office used by the Con-tractor shall be located in an area approved by the Project Representative.

FAO-0014 SAFETY AND ACCIDENT PREVENTION

In performing work under this contract the contractor shall:

(a) Conform to the specific safety requirements established by this contract;

(b) Comply with the safety rules of the Government institution that concern related activities not directly addressed in this contract;

( c ) Take all reasonable steps and precautions to prevent accidents and preserve the life and health of contractor and Government per-sonnel performing or in anyway coming in contact with the performance of this contract; and

(d) Take such additional immediate precautions as the Contracting Officer may reasonably require for safety and accident prevention

FAO-0015 INSPECTING THE SITE

The site is located at:

FCC Lompoc 3901 Klein Boulevard Lompoc, California 93436

As you are aware, this is federal prison property, patrolled 24 hours a day. You must have authorization to be on site from the Con-tracting Officer and Contract Monitor.

FAO-0016 PAYMENT SERVICES

(a) Application for payments in original and 3 copies shall be prepared on AIA (American Institute of Architects) Form G-702 "Applic-ation and Certificate for Payment" and submitted to the Contracting Officer. The contractor may use another form; however, it shall contain similar information within the AIA Form G-702. The Contracting Officer will indicate his approval of the amount of payment by signing and forwarding the application and certificate as follows:

FAO-0017 REQUEST FOR FINAL INSPECTION

The Contractor shall give the Project Representative at least 10 days advanced written notice of the date on which the work will be fully completed and ready for final inspection.

FAO-0018 DRAWINGS

Four sets of all shop drawings, where indicated in the specifications, as finally approved are required to be furnished upon completion of work.

FAO-0019 CONTRACT SECURITY (3000-03 Human Resource Management Manual)

A package shall be submitted to FCC Lompoc to obtain clearance for each contract employee. Upon clearance, the contractor will be notified. Should a contract employee NOT be cleared to work on this project, the contractor will be notified immediately and responsible to submit a new contract employee as soon as possible. Be advised, the Bureau of Prisons cannot disclose why an individual does not pass the se-

FAO-0025 ASSIGNMENT OF CONTRACT ADMINISTRATION OFFICE AND FUNCTIONS

Pursuant to FAR 42.201 and 42.202, the assigned Contract Administration Office is listed in Block 26 of the Standard Form 1442 Back. This assignment carries with it the authority to perform all of the contract administration functions listed in FAR 42.302(a) and 42.302(b) to the extent that those functions apply to the contract.

F.1 PERIOD OF PERFORMANCE

The period of performance for the anticipated contract is 271 calendar days after receipt of the notice to proceed.

G.1 CONTRACT ADMINISTRATION DUTIES

1. Contracting Officer Responsibility: Authority to negotiates changes in terms, conditions, or amounts cited in this contract is re-served to the Contracting Officer.

2. Ordering Official: Modifications may be issued only by the Contracting Officer or other contracting officers holding an appropriate certificate of appointment. A modification shall be in the form of an SF-30, Modification Of Contract.

3. Contract Monitor (CM): The Contracting Officer shall designate in writing a Contract Monitor who shall be responsible for:

a) Monitoring the technical progress on individual task orders, including surveillance and assessment of performance and issuing tech-nical changes to individual task orders;

b) Interpreting the Statement of Work;

c) Technical Evaluation as required;

d) Technical inspection and acceptance;

e) Assisting in the resolution of technical problems encountered by the service provider during contract performance;

f) Monitoring funds available for obligations;

g) Ensuring that task orders are issued in accordance with the appropriate terms;

h) Ensuring that task orders and resultant invoices and payments are processed in a timely manner;

i) Assisting in resolution of administrative problems encountered by the service provider during contract performance.

52.21-603-70 Contract Monitor (CM) (AUG 2008)

(a)James Kovach ,Construction Inspector , FCC Lompoc,805-736-4154 x5070, is hereby designated as the Contract Monitor (CM) un-der this contract.

(b) The CM is responsible, as applicable, for: receiving all deliverables, inspecting and accepting the supplies or services provide here-under in accordance with the terms and conditions of this contract; providing direction to the contractor which clarifies the contractor effort, fills in details or otherwise serves to accomplish the contractual Scope of Work; evaluating performance; and certifying all in-voices/vouchers for acceptance of the supplies or services furnished for payment.

(c) The CM does not have the authority to alter the contractor's obligations under the contract, and/or modify any of the expressed terms, conditions, specifications, or cost of the agreement. If as a result of technical discussions it is desirable to alter/change contrac-tual obligations or the Scope of Work, the Contracting Officer shall issue such changes.

52.24-403-70 Notice of Contractor Personnel Security Requirements (OCT 2005)

Compliance with Homeland Security Presidential Directive-12 (HSPD-12) and Federal Information Processing Standard Publication 201 (FIPS 201) 1 entitled "Personal Identification Verification (PIV) for Federal Employees and Contractors," Phase I.1. Long-Term Contractor Personnel:

In order to be compliant with HSPD-12/PIV I, the following investigative requirements must be met for each new long-term 2 con-tractor employee whose background investigation (BI) process begins on or after October 27, 2005:a. Contractor Personnel must present two forms of identification in original form prior to badge issuance (acceptable documents are listed in Form I-9, OMB No.

1615-0047, "Employment Eligibility Verification," and at least one document must be a valid State or Federal government-issued pic-ture ID);

b. Contractor Personnel must appear in person at least once before a DOJ official who is responsible for checking the identification documents. This identity proofing must be completed sometime during the clearance process but prior to badge issuance and must be documented by the DOJ official;

c. Contractor Personnel must undergo a BI commensurate with the designated risk level associated with the duties of each position.

Outlined below are the minimum BI requirements for each risk level:

• High Risk - Background Investigation (5 year scope)

• Moderate Risk - Limited Background Investigation (LBI) or Minimum Background Investigation (MBI)

• Low Risk - National Agency Check with Inquiries (NACI) investigation

d. The pre-appointment BI waiver requirements for all position sensitivity levels are a:

1) Favorable review of the security questionnaire form; 2) Favorable fingerprint results; 3) Favorable credit report, if required;3 4) Waiver request memorandum, including both the Office of Personnel Management schedule date and position sensitivity/risk level;

and 5) Favorable review of the National Agency Check (NAC) 4 portion of the applicable BI that is determined by position sensitivity/ risk level.

A badge may be issued following approval of the above waiver requirements.If the NAC is not received within five days of OPM's scheduling date, the badge can be issued based on a favorable review of the Security…
