The County Project Manager will advise the contractor with regard to matters set forth in the drawings and specifications. In addition to any specific responsibilities assigned elsewhere in the contract documents, the County’s Project Manager must decide any and all questions which may arise as to the rate of progress of the work. 2. The County’s Project Manager, as a representative of the County, will visit the site at intervals appropriate to the stage of the contractor's operations:

a. to become generally familiar with and to keep the County informed about the progress and quality of the portion of the work completed;

b. to endeavor to guard the County against defects and deficiencies in the work; and

c. to determine if the work is being performed in a manner indicating that the work, when fully completed, will be in accordance with the contract documents. However, the County’s Project Manager will not be required to make exhaustive or continuous on-site visits to check the quality or quantity of the work. The County’s Project Manager will neither have control over nor charge of, nor be responsible for, the construction means, methods, techniques, sequences or procedures, or for the safety precautions and programs in connection with the work, since these are solely the contractor's rights and responsibilities under the contract documents.

3. The County’s Project Manager will not be responsible for the contractor's failure to perform the work in accordance with the requirements of the contract documents. The County’s Project Manager will not have control over nor charge of and will not be responsible for acts or omissions of the contractor, Subcontractors, or their agents or employees, or any other persons or entities performing portions of the work except as otherwise provided in the contract documents, or when direct communications have been specially authorized, the County and contractor must endeavor to communicate with each other, directly, about matters arising out of or relating to the Contract.

Communications by and with the County’s departments must be through the County’s Project Manager. Communications by and with Subcontractors and material suppliers must be through the contractor. Communications by and with separate contractors must be through the County.

Whenever the County’s Project Manager considers it necessary or advisable, the County’s Project Manager will have authority to require inspection or testing, whether or not such work is fabricated, installed or completed. However, neither this authority of the County’s Project Manager nor a decision made in good faith, either to exercise or not to exercise such authority, must give rise to a duty or responsibility of the County’s Project Manager to the contractor, Subcontractors, material and equipment suppliers, their agents or employees, or other persons or entities performing portions of the work.

6. The County’s Project Manager will review or take other appropriate action upon the contractor's submittals such as Shop drawings, Product Data and Samples but only for the limited purpose of checking for conformance with information given and the design concept expressed in the contract documents. The County’s Project Manager action will be taken with such reasonable promptness as to cause no delay in the work or in the activities of the County, contractor or separate contractors, while allowing sufficient time, in the County’s Project Manager professional judgment, to permit adequate review. Review by the County’s Project Manager of such submittals is not conducted for the purpose of determining the accuracy and completeness of other details such as dimensions and quantities, or for substantiating instructions for installation or performance of equipment or systems, all of which remain the responsibility of the contractor as required by the contract documents. The County’s Project Manager review of the contractor's submittals must not relieve the contractor of the obligations. The County’s Project Manager review must not constitute approval of safety precautions or, unless otherwise specifically stated by the County’s Project Manager, of any construction means, methods, techniques, sequences or procedures. The County’s Project Manager approval of a specific item must not indicate approval of an assembly of which the item is a component.

7. The County’s Project Manager will review change orders and construction change directives, and may authorize minor changes in the work.

Additionally, the County’s Project Manager will issue a final Certificate for Payment, upon compliance by the contractor with the requirements of the contract documents.

9. The County’s Project Manager will interpret and decide matters concerning performance under, and requirements of, the contract documents on written request of contractor. The County’s Project Manager response to such requests will be made in writing within any time limits agreed upon or, otherwise, with reasonable promptness. If no agreement is made concerning the time within which interpretations required of the County’s Project Manager, then delay must not be recognized or adjusted in the Construction Schedule on account of failure by the County’s Project Manager to furnish such interpretation until fifteen (15) days after written request is made for them.

10. Interpretation and decisions of the County’s Project Manager will be consistent with the intent of, and reasonably inferable from, the contract documents and will be in writing or in the form of drawings. When making such interpretations and initial decisions, the County’s Project Manager will endeavor to secure faithful performance by both County and contractor, will not show partiality to either and will not be liable for results of interpretations or decisions rendered in good faith.

Only requests for extra working days where adverse weather prevents work on critical activities of scheduled work must be considered.
