2. Description of Action:
This justification and approval is for the purchase of Computenix Audio Video
Communications Equipment for the Department of Commerce, National Oceanic and
Atmospheric Administration (NOAA) at the NOAA Satellite Operations Facility
(NSOF), Suitland MD. The requested Computenix Audio Video Communications
Equipment is required to maintain the NOAA System compliance with the Office of
Satellite Products and Operations’ (OSPO) existing voice communications infrastructure, which is used throughout the organization.

4. Authority:
FAR Part 13.501 (a) (1) (ii) Sole source acquisitions
5. Applicability of Authority:
This justification and approval is for the purchase of Computenix Audio Video
Communications Equipment for NOAA. The use of this brand name product is essential to the Government’s requirements, for Office of Satellite Products and Operations’
(OSPO) infrastructure connectivity requirements, thereby precluding consideration of the products of another company.
The current situation requires brand name hardware and software as Computenix is the only brand currently certified to run in the agency’s network that can provide the level of security needed for the system to be fully accredited.
National Environmental Satellite, Data, and Information Service (NESDIS) is the agency responsible for the operation of the NOAA geostationary and polar orbiting meteorological satellites. The OSPO provides a wide array of operational products and operates various computer and communications systems on a 24-hour, seven days a week schedule. The Computenix Audio Video Communications Equipment will dramatically improve the audio video communications capabilities and enhance the manageability of mission critical requirements for the Agency. The Computenix Audio Video
Communications Equipment is needed to sustain uninterrupted service of OSPO operations and maintenance mission critical equipment associated with mission critical instruction distribution. The support is necessary to support the processes of the Suitland
Program Office.
The quality of Compunetix products is unparalleled in the industry. It is significant to note that each Compunetix product is built in-house to military specifications, ensuring the highest possible standard of reliability, with a fit and finish that custom made for customers facilities.
Compunetix’s electronics manufacturing department is located on the same site as their engineering and support departments. The easy accessibility and regular interaction between these departments guarantees an extraordinary level of knowledge about each product throughout the company.
6. Contracting Officer Determination – Fair and Reasonable Cost:
The Contracting Officer has determined that the anticipated cost to the Government for this acquisition will be fair and reasonable. Actions anticipated to ensure the reasonableness of the price will be accomplished with the procedures and criteria contained in FAR Subpart 15.404, as appropriate. In addition, the Contracting Officer will use various price and cost analysis techniques and procedures to ensure a fair and reasonable price including comparison of competitive published price lists, comparison of the proposed prices with the independent Government cost estimate, and unit pricing under Federal Supply schedule which have been determined fair and reasonable.
7. Market Research:
Market research was conducted in accordance with FAR Part 10.
In accordance with FAR Subpart 8.004(a)(1) Use of Other Sources, both the use of GSA
Federal Supply Schedules (FSS) and the NASA SEWP ID/IQ in accordance with FAR
Subpart 8.4 were both given consideration for available sources.
A review of NASA SEWP determined that the requested Computenix Audio Video
Communications Equipment is not readily available under the NASA SEWP Contract.
An RFI was posted on NASA SEWP on July 1, 2015 and yielded no responses.
A review of GSA Advantage determined that the requested Computenix Audio Video
Communications Equipment is also not readily available under the GSA Multiple Award
Schedule (MAS) Program from any contract holders either. An RFI was posted on eBuy on July 1, 2015 and yielded no responses. A review of the GSA Schedules determined that this requirement cannot be fulfilled under any GSA Schedules contract. Therefore, this procurement will be an open market limited source competition issued only to
Computenix, Inc. for quote.
Market research revealed that Computenix, Inc. is the only known sources that can provide the required items. Computenix, Inc. is the software designer and owns all of the intellectual property rights of the audio video equipment. The requirement shall be conducted under the FAR authority 13.501 (a) (1) (i) as a sole source purchase to
Computenix, Inc.
8. Other Supporting Facts:
In accordance with FAR Part 10, Market Research was performed and revealed via internet searches, trade magazine reviews, and data calls with users in the field, that there were no other software developers with the potential to fulfill the requirements of the
Computenix Audio Visual as follows:
Mission Critical Systems
The Compunetix Federal Systems Division (FSD) is a leading supplier of mission-critical voice communications systems for communications interoperability and command and control applications such as military test ranges, launch control and satellite control.
Compunetix equipment satisfies the most demanding requirements for reliable communications all of the time with commercial-off-the-shelf systems. A single
CONTEX MVP platform provides up to 1300 mission instrument ports, 5000 voice ports, or a combination of the two. CONTEX MVP platforms can be combined into a multi-site system to support very large facilities, and all of the platforms can be administered from a single location.
Digital Voice Communication Systems
The Compunetix Federal Systems Division provides mission-critical voice communications systems—the CONTEX MVP. The CONTEX MVP was designed by the Compunetix engineering staff to meet the extremely demanding requirements of the military and aerospace industries. CONTEX MVP systems are built to operate in crisis management and mission-critical situations in which reliability is paramount. The
CONTEX MVP systems are the most advanced high capacity mission-critical communications solutions in the world.

9. Statement of Actions to Overcome Barriers to Competition:
In an effort to remove or overcome barriers to competition in the future, the market will be scanned frequently for new companies and products that could satisfy the
Government’s requirements. The NOAA staff meets regularly with equipment manufacturers and vendors and attends manufacturer and industry training to keep current on technology. Vendor and trade magazines are scanned for new, open technologies that can satisfy future infrastructure requirements. As an integration lab, the agency will continually revisit the brand name equipment currently being used and will research for the manufacturers and products that will be in the Government’s best interest as best value for future replacement equipment at the agency’s site and at sites the agency supports. Since there is a continual revisit to the brand names currently being used by the agency for the present equipment, if/when alternatives to the requested equipment become available, they will be reviewed for approval to use.
