4. Authority:

FAR 13.501(a) – brand name acquisition under the authority of the test program for certain commercial items

5. Applicability of Authority:

The Orbix Standard Runtime support and maintenance to be acquired under this requirement is essential to the Government’s requirements and is being acquired on a brand name basis because it is particular to one manufacture, Micro Focus.

The AF DCGS network system is currently fielded with Orbix software as a baseline accredited enterprise Common Object Request Broker Architecture (CORBA) solution. The AF DCGS accredited baseline is based on The Enterprise Approval to Operate (ATO), given on 04 March 2010 by the AF DCGS Chief Information Assurance Officer (CIAO). The purpose of the ATO is to provide authority from the CIAO to test, certify, and accredit software/hardware that is compatible to protect Sensitive Compartmentalized Information (SCI) within Information Systems. The hardware and software utilized in the network system meets strict technical specification and requirements that were tested to ensure reliability and compatibility to protect sensitive information and through the certification and accreditation (C&A) process resulted in an ATO, without which the system cannot operate on a Department of Defense (DoD) network.

By establishing an accreditation baseline, the CIAO is able to enhance and improve the security of the Department of the Air Force (DAF) networks by developing a consistent C&A process across the DAF to facilitate reduced cycle time, improved reliability, and improved security across DAF networks. This enables the AF to maintain a distributed, homogenous network of exploitation workstations capable of receiving, processing and disseminating intelligence products and information from a variety of sources.

The requested Orbix Standard Runtime maintenance and support provides for, but is not limited to, 24/7/365 access to SupportLine telephone support services, access to the SuportLine website which includes the Knowledge Base, problem submission and reporting tools, Corrections, tools, and documentation; and updates to maintained software. Renewal of the maintenance and support for the existing Orbix Standard Runtime test licenses is required to ensure consistency of the current configurations, secure database management, continuity with already fielded software, and interoperability. Orbix software is required for the deployable workstations and is essential to facilitate the transfer of mission critical data to direct and remote sites. Using other CORBA solutions in the Enterprise infrastructure is not mission effective or cost effective and places additional testing, training, administration, and fiscal burden on the Government as Orbix is currently fielded in the system and has already been approved, certified, and accredited within the weapon system accreditation baseline. This requirement will provide support and maintenance to existing Orbix licenses. Therefore, soliciting new products would be cost prohibitive and the renewal of the support and maintenance for the existing Orbix Standard Runtime licenses is in the Government’s best interest.

6. Efforts to Obtain Competition:

In an effort to ensure that offers are solicited from as many potential sources as is practicable, this requirement will be solicited as a combined synopsis/solicitation in accordance with FAR 5.203(a)(2) and FAR 12.603 in FedBizOpps. Any responsive, responsible small business may submit a quote for consideration.

7. Contracting Officer Determination – Fair and Reasonable Cost:

The Contracting Officer has determined that the anticipated cost to the Government for this acquisition will be fair and reasonable. Actions anticipated to ensure the reasonableness of the price will be accomplished with the procedures and criteria contained in FAR Subpart 15.404, as appropriate. Adequate price competition is anticipated to establish a fair and reasonable price. In addition, the Contracting Officer will use various price analysis techniques and procedures to ensure a fair and reasonable price. Examples of such techniques may include, but are not limited to: comparison of the quoted prices with historical prices paid for the same or similar items, comparison of the quoted prices with the independent Government estimate, comparison of quoted prices received in response to the request for quote, and/or any other reasonable basis.

8. Market Research:

In accordance with the FAR Subpart 8.002 and 8.003 there are no mandatory sources of supply for the requested items under this requirement. Therefore, in accordance with FAR Subpart

8.004 Use of Other Sources and GSA Memorandum - “Updated Preferred Use of Existing GSA Contract Vehicles” dated 11 October 2012 the use of GSA Federal Supply Schedules was given first consideration. A review of GSA Advantage on 24 February 2015 determined that there are some Orbix products and support on GSA Schedule; however, the exact requested Orbix support and maintenance is not available on GSA Schedule. The manufacturer, Micro Focus, confirmed on 20 February 2015 that the requested maintenance and support is not currently available on GSA Schedule. The manufacturer also stated that sufficient competition does not exist on any other existing Government contract vehicle. Based on this information, it was determined that competition does not exist under GSA Schedule or any other existing Government contract vehicle, but that the requested items are available via Open Market. Market research from GSA requirement ID40140016 determined there is a reasonable expectation of obtaining offers from two or more responsible small business concerns; therefore, this requirement will be a total small business set-aside under North American Industry Classification System (NAICS) Code 541519

– Other Computer Related Services with a corresponding size standard of $27.5M.

9. Other Supporting Facts:

Market research indicates that no other companies’ services meet, or can be modified to meet, the agency’s needs. This requirement will provide support and maintenance to existing Orbix licenses. Therefore, soliciting new products would be cost prohibitive and the renewal of the support and maintenance for the existing Orbix Standard Runtime licenses is in the Government’s best interest. The existing Orbix software currently integrated in the AF DCGS network system is an intellectual property of Micro Focus. The requested Orbix maintenance and support is proprietary to Micro Focus and only Micro Focus or its resellers can provide the requested support services for the existing Orbix licenses.

10. Listing of Sources:

Potential sources may include any responsive, responsible small business that can provide the Orbix Standard Runtime maintenance and support.

All responsive and responsible small business concerns will be given due consideration.

11. Statement of Actions to Overcome Barriers to Competition:

In an effort to remove or overcome barriers to competition in the future, the market will be scanned frequently for new companies and products that could satisfy the Government’s requirements. The Government meets regularly with equipment manufacturers and vendors and attends manufacturer and industry training to keep current on technology. Vendor and trade magazines are scanned for new, open technologies that can satisfy future infrastructure requirements. The Air Force reviews all products currently being used by the agency annually.

As an integration lab, the agency continually revisits the brand name equipment currently being used and researches for the manufacturers and products that will be in the Government’s best interest as a best value for future replacement equipment at the agency’s site and at sites the agency supports. Since there is a continual revisit to the brand names currently being used by the agency for the present equipment, if/when alternatives to the requested equipment become available, they will be reviewed for approval to use.

12. Requiring Agency Certification:

I certify that the supporting data under my cognizance which form the basis for this justification are accurate and complete to the best of my knowledge and belief.

Roger Crumpton Date Software Acquisition Support Manager

10. Contracting Officer Certification and Approval:

The undersigned has determined that the anticipated cost to the Government for this acquisition will be fair and reasonable. Further, I certify that this justification is accurate and complete to the best of my knowledge and belief.

Melissa J. Mould Date Senior Contracting Officer
