U.S. General Services Administration
Federal Acquisition Service
Assisted Acquisition Services (AAS)
819 Taylor Street, Room 13A33
Fort Worth, TX 76102
JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION:
1. Identification of the Agency, Contracting Activity, and Document being Approved:
Procurement Office: General Services Administration – FAS, Region 7 AAS Client Agency: Department of the Air Force, 502nd Contracting Squadron, JBSA Randolph Task Number: ID07200022 Description of Requirement: Patient Handling System for the UH-60 Blackhawk Helicopter.
2. Description of Action Being Approved: This Justification and Approval (J&A) is for the award of a sole source contract, for an effort required to set up Aeromedical training simulators for the UH-60 Helicopter by the U.S. Air Force 502nd Trainer Development Squadron.
Per FAR Part 6.302-1 – Only one responsible source and no other supplies or services will satisfy agency requirements.
(a) Authority
(1) Citations: 10 U.S.C. 2304(c)(1)
This J&A seeks approval to procure the Patient Handling System on a sole source basis from the manufacturer, Air Methods Corporation (United Rotorcraft Aircraft, Products Division).
3. Description of Supplies or Services Required: The 502nd Trainer Development Squadron (TDS) has identified a bona fide need for the upgrade and set up of Aeromedical Trainers located at Wright-Patterson Air Force Base. This requirement is for the purchase of a Patient Handling System for the UH-60 Aeromedical Trainer. The 502nd TDS is developing a training simulator for the United States School of Aerospace Medicine (USAFSAM) at Wright- Patterson Air Force Base (WPAFB), Ohio. The patient handling system is to be sourced through the sole source procurement. The expected total value of this requirement is around $178,000.00.
4. Identification of Statutory Authority: The statutory authority permitting the sole source of this product is FAR 6.302-1, 10 U.S.C. 2304(c)(1), “Only one responsible source and no other supplies or services will satisfy agency requirements”.
5. Demonstration that the Acquisition Requires the Use of the Authority Cited: The UH-60 Patient Handling System as manufactured by Air Methods Corporation (United Rotorcraft Aircraft, Products Division) is the only Multi-Patient Stacking system that has been developed and approved for use and installation for patient transport in the UH-60 Blackhawk Helicopter (see attached articles citing the award of contracts for up to $17M to United Rotorcraft for the development of the patient handling systems when the Army upgraded the patient litter lift system and ambulatory patient seating in July 2007). The purchase of this patient handling system is imperative so that the UH-60 patient transport is accurately simulated during aeromedical training missions for doctors, nurses, and medical technicians attending the USAFSAM training courses.
6. Description of Efforts to Solicit as Many Offers as Practicable or Exception: Based on the customer’s knowledge of the product and confirmed by the article: “Sikorsky HH-60M MEDEVAC Black Hawk Helicopter” from the Army Technology website (see copy attached)… “Air Methods’ Products Division was awarded a contract by Sikorsky Aircraft to upgrade the patient litter lift system and ambulatory patient seating in July 2007…” It is determined that the products offered by Air Methods Corporation are the only known source that can meet the customer’s requirement.
7. Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: A statement of price reasonableness will be included in the contract file. In this solicitation, Air Methods/United Rotorcraft will be requested to submit any available pricing data and sales history for the item requested in order to substantiate the price reasonableness of their quote to the Government.
8. Description of Market Research Conducted: Market research was conducted by GSA and Technical Order personnel from the 502nd, along with internet searches for the UH-60 Patient Handling System yielded no other manufacturers or distributors other than United Rotorcraft, Air Methods Corporation. Even the manufacturer of the UH-60 helicopter (Sikorsky Aircraft) relies on United Rotorcraft for the supply of this and other patient handling systems. Before any future acquisitions are made further efforts and searches for additional manufacturers and/or distributors will be made.
9. Other Facts Supporting Other Than Full and Open Competition: All facts to support the award of the sole source contract have been identified above.
10. List of Sources that Expressed an Interest in the Acquisition: Air Methods Corporation is the only known and authorized source interested in having a contract with the Government and capable to fulfill this requirement at this time.
11. Statement of Actions to Overcome Barriers of Competition: Market research from commercial websites indicates that there are no available sources that manufacture these patient handling systems specific to the UH-60 Black Hawk Helicopters. Due to the highly specialized requirements of the 502nd Trainer Development Squadron, the only known source at this time capable of meeting their requirements is Air Methods Corporation. Substantial duplication of costs would occur if this open-market procurement is completed on a competitive basis.
12. The Contracting Officer certifies by signature below that the information contained in this justification is accurate and complete to the best of his/her knowledge and believe.
