LIMITED-SOURCES JUSTIFICATION

Prepared in Accordance with FAR 8.405-6 Defense Manpower Data Center (DMDC)

Public Record Data Registration Licenses and Engineering Support

This document is prepared in accordance with the requirements of FAR 8.405-6(c)(2). This acquisition will be conducted under the authority of the Multiple Award Schedule Program.

Requiring Agency and Contracting Agency [8.405-6 (c)(2)(i)):

The requiring activity is the Defense Manpower Data Center (DMDC), Alexandria, VA 22350.

The contracting activity is General Services Administration, Federal Acquisition Services, (GSA/FAS), Mid-Atlantic Region, Philadelphia, PA 19106.

This document is hereby identified as a Limited-Sources Justification.

Nature and/or description of the action being approved (8.405-6 (c)(2)(ii)J:

The action being approved is a Limited Source, RELX, Inc. (formerly Lexis/Nexis) to purchase additional Public Record Data Registration Licenses from RELX, Inc.

Under the subject action, GSA will acquire the additional licenses (300,000) as a modification to the current Task Order awarded to RELX, Inc., (awarded in accordance with RELX, Inc. GSA Schedule 76 Contract, GS-02F-0048M), GSQ0317DS0023, and GSA IT Solution Ship #ID03170031.

Note: This Limited Source Justification serves as an Amendment to the original Limited Sources

Justification signed March 3, 2017.

The Independent Government Cost Estimate for this action is $810,000.00 thus increasing the total value of the task order from $11,905,000.00 to $12,715,000.00.

Description of the supplies or services required to meet the agency's needs (8.405-6 (c)(2)(iii)):

DMDC requires 300,000 additional comprehensive public record information licenses thus increasing the quantity from 1,100,000.00 to 1,400,000.00. These licenses are used to detect personnel security issues among personnel holding national security clearances and national security clearance applicants, and for suitability determinations for positions of public trust.

The additional licenses are needed during the last period of performance of the task order, Option Year III, 9/28/2018 – 3/27/2019.

The authority and supporting rationale (8.405-6 (c)(2)(iv)J :

This acquisition is being conducted under the authority of the Multiple Award Schedule program.

The statutory authority permitting other than full and open competition is Section 201 of the Federal Property and Administrative Services Act of 1949 (40 U.S.C. 501), as implemented by FJ\R 8.405-6.

In accordance with FAR 8.405-6 (a) (1) (i) (B) - Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized.

The only solution for acquiring the required products and support is the RELX, Inc.'s GSA Schedule 76 Contract, GS-02F-0048M. This action is being processed as a Limited Source due proprietary nature of the required products.

Only Lexis-Nexis (RELX, Inc.) products provide the comprehensive data required by DMDC to support the CE pilot program. Lexis-Nexis (RELX Inc.) has a complete aggregate of data sources and partnerships with the social intelligence communities that provide the ability to evaluate the most data sources and compare to the CE database. Lexis-Nexis (RELX Inc.) comprehensive data includes the largest available set of public and proprietary records, with 10,000+ sources; the most comprehensive commercial database of 2.5+million risk entities, from global sanctions and watch lists; as well as vast social media, law enforcement records management systems (RMS), and other data sets. There is no other competitor in the marketplace that can provide DMDC with a single source of collective information in this capacity for continuous evaluation. For example, other contractors can provide a credit check, or a check on local motor vehicle registration records; but no company provides a single collective source of all the required information in this capacity. A snapshot of what the aggregate data provided by the LexisNexis ProMonitor (Alert Service) provides is listed below:

Furthermore, Lexis-Nexis (RELX Inc.) is the only company capable of integrating its products into the DMDC environment. Under this requirement, Lexis-Nexis (RELX, Inc.) will utilize its web interface gateway to provide public record data to DMDC. Only Lexis-Nexis (RELX Inc.) engineers and data analysts are capable of configuring Lexis-Nexis products to meet the specific needs of the DMDC CE program, as Lexis-Nexis does not authorized outside contractors to work with their proprietary software. The Lexis-Nexis engineering team is the only personnel that are qualified to successfully integrate their data in to DMDC’s CE solution. The product integration is key to the success of this Pilot, as DMDC is working to build and automated Continuous Evaluation (CE) solution that constantly feeds public record data and cross checks it with the Government databases to determine if an action needs to be taken on an individual's status with the Government. Without the successful integration of the LexisNexis products, the pilot will not be successful.

Determination that the order represents the best value consistent with 8.404(d) [8.405-6 (c)(2)(v)J:

The assigned GSA ITM will complete a technical evaluation on the contractor's technical submission to ensure that the products and services quoted by the contractor are acceptable and commensurate with the work requirement of this delivery order. The GSA Contracting Officer will conduct a price analysis of the contractor's submitted prices for all products and ensure that there are no math errors or pricing caveats. Quoted product prices and labor rates will be checked to ensure that they are reflected in the contractor's current GSA Schedule 76 contract.

In accordance with FAR Subpart 8.4, GSA has already determined the GSA Schedule 76 prices to be fair and reasonable since they are derived from and reflect the actual prices in the GSA Schedule. In addition, the Government will seek discounts in accordance with FAR 8.405-2. The Contracting Officer has determined that these combined efforts will result in the greatest overall benefit to the Government in response to the requirement, attaining the best value and fair and reasonable prices.

Description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted (8.405-6 (c)(2)(vi)J:

Market Research revealed that no other products provide the comprehensive data required by DM DC to support their CE pilot program.

A review of the Lexis-Nexis Schedule 76 contract reveals that the contractor offers the required products and related services under its GSA Schedule contract number GS-02F-0048M. This research was conducted using GSA's Schedules E-library website and the contractor's web site.

Any other facts supporting the justification (8.405-6 (c)(2)(vii)J:

None.

A Statement, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made (8.405-6 (c)(2)(viii)J:

For this acquisition, it was determined that there is not a reasonable acquisition alternative to remove or overcome the barriers that led to the restricted consideration.
