Justification for an Exception to Fair Opportunity

Navy Renewable Energy Program Office (REPO) Support Services Order #ID03150010

1. Identification of the Agency and the Contracting Activity and Specific Identification of the Document as a “Justification for an Exception to Fair Opportunity”

This document is identified as a Justification for an Exception to Fair Opportunity and is processed on behalf of the Deputy Assistant Secretary of the Navy (DASN) Energy, Renewable Energy Program Office (REPO) in Washington, DC.

The contracting activity is GSA/FAS, Region 3, The Dow Building, 100 S Independence Mall West, Philadelphia, PA 19106.

2. Nature and/or Description of the Action Being Approved

Task Order GSQ0315DS0033 was issued against GSA's OASIS IDIQ Contract, GS00Q14OADU108 on behalf of the Deputy Assistant Secretary of the Navy (DASN) Energy, Renewable Energy Program Office (REPO) to provide Program Support Services in June 2015. This order was issued as a Cost- Reimbursement type task order with a twelve-month base period and two (2) twelve-month option periods. The total task order value including all option periods was $21,090,433.15. Task summary is as follows: Base Period- $7,018,547.90, Option Year 1- $6,995,886.14, and Option Year 2- $7,075,999.11.

The purpose of this modification is to incorporate the Water Energy Nexus project into Option Year 1 and Option Year 2.

3. Description of the Services Required to Meet the Agency’s Needs (including the estimated value)

For the remainder of OY1 and through the execution of OY2, if it is exercised, this effort will assist the Water Energy Nexus project which seeks to identify renewable energy projects that both contribute to fulfilling Navy-wide energy goals, and align with known water supply projects in areas where water is more valuable and where its capture is restricted by the cost and/or availability of energy. Only opportunities that align with the REPO mission will be pursued. The work required to support the Water Energy Nexus is an extension of the work being acquired by this task order in that it must fully conform to requirements and specifications in addition to seeking opportunities that are adjacent to valuable water resources that are too expensive to exploit using traditional energy sources. The resources/skills required include renewable energy engineering, real estate specialist, and financial support which are all included in this task order.

The level of additional effort required to support this added requirement is approximately 1 FTE, which represents approximately a 3% increase to the task order level of effort. The estimated value of this action is $432,876.61 ($216,029.97 for Option Year 1 and $216,846.64 for Option Year 2).

4. Identification of the Exception to Fair Opportunity and Supporting Rationale

In accordance with FAR 16.505(b)(2)(i)(B), only one awardee is capable of providing the services required at the level of quality required because the services ordered are unique or highly specialized.

EFO - Order # ID3150010

The work currently being performed to support the establishment of one gigawatt of renewable energy, REPO’s overall mission, and that required to support the Water Energy Nexus are highly specific to Navy’s overall goals, and very much interdependent on developed knowledge of ongoing project activities. Hence, it would be more efficient and effective to execute this small requirement as part of the REPO order. The Contractor currently has approximately 32 FTE’s engaged in the identification and related support activities for RE opportunities around the globe. The work required to support the Water Energy Nexus is an extension of this work in that it must fully conform to the requirements and specifications of the REPO task order in addition to seeking opportunities that are adjacent to valuable water resources that are too expensive to exploit using traditional energy sources. The additional resources/ required include renewable energy engineering, real estate specialist, and financial support, each of which are key resources already supporting the REPO task order.

This exception is justified because no source, other than the incumbent, has the current level of highly specialized knowledge, regarding Navy’s renewable energy program, necessary to effectively and efficiently perform these requirements. The identification and development of RE projects necessary to meet the one gigawatt of Renewable Energy (RE) goal in support of Navy installations worldwide is a highly coordinated effort. This work is being performed by the incumbent contractor in conjunction with a large number of Navy Program Offices and base organizations. Any attempt to segment the basic effort of identification and development of RE opportunities across multiple sources at this stage in the process would require considerable additional effort by the incumbent to transfer project knowledge and provide significant coordination to ensure that the projects identified would complement the work completed and combine with that underway to effectively support the Navy’s 2016 and 2017 commitments. The potential division of this work across two independent contractors would require considerable more coordination by both the contractors and Government resources in avoiding duplication of effort, and ensuring the continuity of the solutions being delivered. The highly specialized nature of this effort would require ongoing additional oversight and coordination that is not required through use of existing source.

Based upon the above, Booz Allen Hamilton is the only responsible source that can satisfy the Government’s requirements in assisting the Water Energy Nexus project to identify renewable energy projects.

5. A Determination by the Contracting Officer that the Anticipated Costs to the Government will be Fair and Reasonable

A price analysis will be performed documented in the Modification Memorandum to File. In accordance with FAR Subpart 16.505, GSA has already determined the prices to be fair and reasonable since they are derived from and reflect the actual prices in the GSA OASIS IDIQ. The Contracting Officer will determine that this effort will result in the greatest overall benefit to the Government in response to the requirement, attaining the best value.

6. Any Other Supporting Facts

Not Applicable.

7. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome Any Barriers that Led to the Exception to Fair Opportunity Before Any Subsequent Acquisition for the Supplies or Services is Made

The Government will only solicit Booz Allen Hamilton under its GSA OASIS IDIQ contract to enable the fulfillment of this requirement. No other firm can provide the necessary services at requisite level of expertise within the timeframe required.
