2. Schedule of Assemblies, Materials, and Estimated Quantities. For this Project, the schedules of assemblies, material specifications and associated estimated quantities are identified on the Contract Drawings and Technical Specifications (Divisions 01, 02, 31, 33, 50, 60, and 90). Estimated quantities for each Bid Item are shown on the Plan Sheet identified as “Estimate of Quantities”.

The existing condition of the levee has been evaluated by the Government, and is included in a report entitled “Condition Assessment of US International Boundary and Water Commission, Lower Rio Grande Valley Levees, South Texas, October 2003”. The applicable sections of this report are available to the Contractor for the purposes of understanding the existing condition of the levee within the project limits of this Contract. Additionally, geotechnical investigations were performed during the final design of the project, and the associated geotechnical data and reports are identified in 00.31.32 Geotechnical Data herein.

SURVEY INFORMATION

For these Contract Drawings, surveying and data collection was performed as follows:
(1) Light Detection and Ranging (LiDAR) was obtained from the Government and used for preliminary information.
(2) Control was performed in April / May 2009 by RODS Surveying, Inc. who developed and provided the following (at .01-foot accuracy):
(a) Control. The surveyor established points at cross-roads to establish horizontal and vertical control; control sheets were developed for each control point set, signed and sealed by a Texas Registered Professional Land Surveyor (RPLS). The control sheet includes a drawing of the control point with a 3-point tie to existing physical features, description of the control point, X,Y & Z coordinates and the coordinate system. Plan Sheet No. XX, within the Contract Drawings includes the control information data for all the control points set for the project, signed and sealed by the RPLS.
(b) Benchmarks. The surveyor established bench marks along project limits; vertical benchmarks were set at 1000-foot intervals at the right of way (ROW) line of the levee reach. A tabulation of the benchmarks is shown on Plan Sheet No. XX within the Contract Drawings.
(3) Ultimately, an aerial survey (at 0.1-foot accuracy) was performed in April / May 2009 by RODS
Surveying, Inc. and RODS Aerial Mapping, LLC who developed and provided the following, which was used as the basis of design:
(a) Field Control for Photogrammetry. The surveyor set panels for aerial photogrammetry along the levee reach for a low-level flight (1500 feet). Panels were set along the flight path at 800-foot intervals and wing panels were set at cross-roads or 2400-foot intervals. The surveyor performed a global positioning (GPS) survey to establish x-y-z coordinates of the panel points.
(b) Aerial Photogrammetry. The aerial photogrammetry was developed as follows:
1. Black and white photography at a 1-inch = 250-foot photo scale (1500 feet above ground level (AGL))
2. Data Processing. The aerial photography was scanned at 12 microns to produce 0.25-foot pixel resolution; aerial triangulation process was performed to orient individual stereo pairs.
3. Planimetric and Topographic Data Compilation. Planimetric and topographic data was compiled (suitable for 1-inch = 50-foot map scale showing 1-foot contours.
4. Digital Orthophotos. A digital elevation model (DEM) or should this be DTM? was created for the project area to support the orthophoto rectification; rectified mosaic digital
USIBWC Contract No.: IBM09B0005 Page 00.31.21 - 2 images to hold 0.25-foot ground pixel resolutions suitable for a 1-inch = 50-foot map scale.
(4) Supplemental ground surveys were performed by RODS Surveying, Inc., Dos Land Surveying, LLC, and Valley Data Collection Specialists as follows:
(a) Voids. A topographic survey was performed by the surveyors to fill-in the voids of the aerial planimetrics; additionally, the surveyor performed topographic survey on existing structures, including bridges, inlets, culverts and irrigation structures.
(b) ROW Verification. The surveyors recovered and staked ROW points from available ROW maps supplied by the Government. This ROW information is shown on the plan / profile sheets of the Contract Drawings.
(c) Geotechnical Borings Survey. The surveyors obtained x-y-x coordinates for the geotechnical borings along the levee reach spaced at approximately 500-foot spacings.
(d) Utility Survey. The surveyors coordinated with utility notification companies to get utilities marked in the field; the surveyor performed field location of underground utilities as marked by utility companies along the levee reach and intersecting streets. These locations are shown on the plan / profile sheets of the Contract Drawings. NOTE: IT IS THE CONTRACTOR’S
RESPONSIBILITY TO VERIFY LOCATIONS OF ALL EXISTING UTILITIES (SHOWN
AND NOT SHOWN ON THE CONTRACT DRAWINGS) PRIOR TO CONSTRUCTION.

ENVIRONMENTAL DOCUMENT INFORMATION
(Main and North Floodway)
The Project’s environmental documents entitled “Final Programmatic Environmental Impact Statement, Improvements to the USIBWC Rio Grande Flood Control Projects along the Texas-Mexico Border, January 2008” and “Final Environmental Assessment, Improvements to the North and Main Floodways Levee Systems, November 2007” are available for the Contractor to review upon request.
1. Establishing and Acquisition Authorities. Various authorities include:
• Fish and Wildlife Act of 1956 [16 U.S.C. 742f (a) (4)], [16 U.S.C. 742f(b)(1)]
• An Act Authorizing the Transfer of Certain Real Property for Wildlife, or other purposes [16
U.S.C. 667b]
• Refuge Recreation Act, as amended [16 U.S.C. 460k-1], [16 U.S.C. 460k-2]
• Migratory Bird Treaty Act [16 U.S.C. 703]
• National Wildlife Refuge System Improvement Act of 1997
Abatement and Mitigation of Excessive or Unnecessary Noise. Minimize noise throughout all phases of the Contract. Exercise particular and special efforts to avoid the creation of unnecessary noise impact on adjacent noise sensitive receptors in the placement of non-mobile equipment such as air compressors, generators, pumps, etc. Place mobile and stationary equipment to cause the least disruption of normal adjacent activities.
All equipment associated with the work must be equipped with components to suppress excessive noise and these components must be maintained in their original operating condition considering normal depreciation. Noise attenuation devices installed by the manufacturer such as mufflers, engine covers, insulation, etc. must not be removed nor rendered ineffectual nor be permitted to remain off the equipment while the equipment is in use.
Preservation of Cultural and Natural Resources and the Environment. If the Contractor initiates changes to the Contract and IBWC approves the changes, the Contractor is responsible for obtaining clearances and coordinating with the appropriate regulatory agencies.
A. Cultural Resources. Cease all work immediately if a site, building, or location of historical, archeological, educational, or scientific interest is discovered within the right of way. The site, building, or location will be investigated and evaluated by IBWC.
B. Texas Pollutant Discharge Elimination System (TPDES) Permits and Storm Water Pollution Prevention Plans (SWP3). IBWC will file the Notice of Intent (NOI) and the Notice of Termination (NOT) for work shown on the plans in the right of way. Adhere to all requirements of the SWP3.
C. Work in Waters of the United States. For work in the right of way, IBWC will obtain any required Section 404 permits from the U.S. Army Corps of Engineers before work begins. Adhere to all agreements, mitigation plans, and standard best management practices required by the permit. When

Contractor-initiated changes in the construction method changes the impacts to waters of the U.S., obtain new or revised Section 404 permits.
D. Work in Navigable Waters of the United States. For work in the right of way, IBWC will obtain any required Section 9 permits from the U.S. Coast Guard before work begins. Adhere to the stipulations of the permits and associated best management practices. When Contractor-initiated changes in the construction method changes the impacts to navigable waters of the U.S., obtain new or revised Section 9 permits.
E. Work Over the Recharge or Contributing Zone of Protected Aquifers. Make every reasonable effort to minimize the degradation of water quality resulting from impacts relating to work over the recharge or contributing zones of protected aquifers, as defined and delineated by the TCEQ. Use best management practices and perform work in accordance with Contract requirements.
F. Project-Specific Locations. For all project-specific locations (PSLs) on or off the right of way (material sources, waste sites, parking areas, storage areas, field offices, staging areas, haul roads, etc.), signing the Contract certifies compliance with all applicable laws, rules, and regulations pertaining to the preservation of cultural resources, natural resources, and the environment as issued by the following or other agencies:
• Occupational Safety and Health Administration,
• Texas Commission on Environmental Quality,
• Texas Department of Transportation,
• Texas Historical Commission,
• Texas Parks and Wildlife Department,
• Texas Railroad Commission,
• U.S. Army Corps of Engineers,
• U.S. Department of Energy
• U.S. Department of Transportation,
• U.S. Environmental Protection Agency,
• U.S. Federal Emergency Management Agency, and
• U.S. Fish and Wildlife Service.
All subcontractors must also comply with applicable environmental laws, rules, regulations, and requirements in the Contract. Maintain documentation of certification activities including environmental consultant reports, Contractor documentation on certification decisions and contacts, and correspondence with the resource agencies. Provide documentation upon request.
Obtain written approval from the Engineer for all PSLs in the right of way not specifically addressed in the plans. Prepare an SWP3 for all Contractor facilities, such as asphalt or concrete plants located within IBWC right of way. Comply with all TCEQ permit requirements for portable facilities, such as concrete batch plants, rock crushers, asphalt plants, etc. Address all environmental issues, such as Section 404 permits, wetland delineation, endangered species consultation requirements, or archeological and historic site impacts. Obtain all permits and clearances in advance.

9. Other considerations. The Contractor is required to adhere to the following:
(a) No excavation event should be performed on LRGV NWR property. If during construction it is found that there is a need to perform construction on LRGV NWR property, the Contractor shall not begin construction without obtaining a Special Use Permit from the LRGV NWR or without the notification of the activity to the Refuge Manager; all federally mandated consultations and the procurement of permits will be completed by the Government, including, but not limited to, those required by the U.S. Army Corps of Engineers and the Texas State Historic Preservation Office.
(b) Vegetated areas will be clearly marked by an environmental monitor and work activities will avoid these areas.
(c) Proper training will be given to machine operators to reduce the risk of accidental mortality to less mobile terrestrial wildlife.
(d) Ensure that all Environmental Permits, Issues, and Commitments (EPIC), which are included within the PS&E are followed and implemental to ensure potential impacts are avoided.

Geotechnical investigations were performed by Professional Services Industries, Inc., entitled:
“Geotechnical Engineering Services Report, United States Section, International Boundary & Water Commission, Lower Rio Grande Project – Interior Levees, Rehabilitation of Main Floodway, From 23rd Street to FM 1015, Hidalgo County, Texas, May 2009.”
The Contractor may request a copy of the report from the Government.
The data and report are not intended as a representation or warranty of continuity of conditions between soil borings nor of groundwater levels at dates and times other than date and time when measured. The Government will not be responsible for interpretations or conclusions drawn there from by the Contractor. Data are solely made available for the convenience of Contractor. Additional test borings and other exploratory operations may be made by Contractor subsequent to award of the Contract at no additional cost to the Government.
