Justification and Approval for Other than Full and Open Competition Sole Source Acquisition FAR Subpart 6.3 Other Than Full and Open Competition

DoP-18-04517

TRACKING #JA17-0110

1. Identification of the agency and contracting activity: Defense Health Agency (DHA), Health Information Technology (HIT) J-6 Directorate, Solutions Delivery Division (SDD), Contracting Operations – Falls Church (CO-FC)

2. Nature and/or Description of Action being approved: Approval is being requested for award of a sole source Firm Fixed Price (FFP) bridge contract to support the existing level of effort. This sole source award does not provide for new work or a change in scope.

Approval is being requested for a bridge contract to be awarded to Irving Burton Associates (IBA) to provide Configuration Management and Agile Support Services to the Defense Health Agency (DHA) HIT (J-6), Solution Delivery Division (SDD). The Contractor shall provide continued support services to the DHA that are currently being provided under contract W81XWH-08-D-0032, Order# 0013 by United States Army Medical Research Acquisition Activity (USAMRAA) for; product oversight and support; configuration management support;

and agile support services which will expire on October 16, 2017. The RFI waiver was submitted on 29 August 17 and approved by the HCA on 12 September 2017.

Continued support is required without a break in service Configuration Management and Agile Support Services currently being provided by IBA. IBA is critical in ensuring that multi-level healthcare management information is available for Military Treatment Facilities (MTF) and the appropriate DoD decision-makers. The PM, CM, and Agile Support Team manages several health IT systems that make healthcare management information available by receiving, validating, editing, processing, aggregating, and integrating all data as a result of healthcare encounters for the military active duty, retirees, and their dependents. This information is essential not only at the front lines of healthcare delivery at MTF, but also for decision-makers in the offices of Lead Agents (LA) and at corporate levels. Corporate level includes Intermediate and Major Subordinate Commands, Unified and Specified Commands, Surgeons General, the Defense Health Agency (DHA) and Office of the Assistant Secretary of Defense Health Affairs (OASD (HA)). If the support by the PM, CM and Agile Support contract is not available, then SDD Clinical Support Branch will not be able to provide multi-level healthcare management information to MTFs or the appropriate DoD decision-makers.”

3. Description of Supplies/Services: IBA shall cont inue to provide support for the subject area contained in the current contract W81XWH-08-D-0032, Order# 0013 to assist DHA in planning and managing its activities and programs. This includes but is not limited to the following tasks: project management; product oversight and support; configuration management support; and agile support. The approximate to ta l cost of th is requirement is

, FY18 Operations and Maintenance funds shall be utilized for this Firm- Fixed Price (FFP). The period of performance shall be for a four (4) month base bridge with two (2) four (4) month Option periods. Per FAR Clause 52.217-8 is included in this requirement and will be evaluated. It’s inclusion in all J&A’s utilizing part Far Part 6, see paragraph 3.1.1.1. of PD 06-01, Rev. 004, dated March 31, 2017.

FAR Subpart 6.3 Other Than Full and Open Competition

The Periods of Performance is as follows:

Bridge POP: 10/17/2017 – 02/25/2018

OP1: 02/26/2-18 – 06/14/2018

OP2: 06/15/2018 – 09/30/2018

-8 extension: 10/01/2018 – 04/30/2019 =

4. Statutory Authority Cited permitting other than full: The statutory authority permitting “other than full and open” competition for this acquisition is 10 U.S.C.2304(c) (1) as implemented by Federal Acquisition Regulation (FAR) and in accordance with FAR 6.302- 1(a)(2)(iii)(B) – “Only One Responsible Source and No Other Supplies or Services Will Satisfy the Agency Requirements”; and services are deemed to be available only from the original source in the case of follow-on contracts for the continued provision of highly specialized services when it is likely that award to any other source would result in unacceptable delays in fulfilling the agency’s requirements (10 U.S.C. 2304(d)(1)(B)).

5. Reason for Authority Cited: The incumbent, IBA, possesses the operational infrastructure and knowledge required for successful performance. The Contractor can continue to provide the support required during this short duration transitional contract without a loss of efficiency and negative impact to the project management; product oversight and support; configuration management support; and agile support. Only IBA can start performance within this short period of time and prevent a gap in services. These services must continue uninterrupted in order to meet the needs of our DHA, HIT-6/SDD. Although there are other sources available that can meet the Government’s requirements, none would have the infrastructure or expertise available to support a fully functional project management; product oversight and support; configuration management support; and agile support services without significant delays, lead-time, incurred costs, duplication of efforts and substantial investments of time and resources by the Government. This is a follow-on transitional contract funded for a base period of four (4) month and additional two (2) four (4) months option periods.

6. Efforts to Obtain Competition: Bids, proposals, or quotations have not been solicited from additional sources as prescribed by FAR 5.207(c) (15). A Bridge contract will be issued to the incumbent IBA. Based on the expected short term of the contract and the authority of FAR 6.302-1(a) (2) (iii), the Government may make an award to the incumbent in the case of follow-on contracts. However, proposals will be solicited for the logical follow-on contract with an anticipated award date in October 17, 2017.

7. Actions to Increase Competition: The current contract W81XWH-08-D-0032, Order# 0013 awarded by USAMRAA for the project management; product oversight and support;

configuration management support; and agile support services will expire on October 16, 2017.

The Agency began preparations for a new contract competition in late 2016. This request for sole source contract is not due to the Agency’s lack of planning. SDD and the Contracting Officer have decided that the new contract will be competed using full and open competition after exclusion of sources, and will be a 100% small business set aside in accordance with FAR 6.203-

FAR Subpart 6.3 Other Than Full and Open Competition

Set-asides for small business concerns. The award of a logical follow-on incurred unanticipated delays due to the refinement of acquisition documents.

8. Market Research: Market research was not conducted as SDD The period of performance shall be for a four (4) month base bridge with two (2) four (4) month Option periods, be made to IBA on a sole-source base in accordance with FAR 16.505(b)(2)(i)(C). The order must be issued on a sole-source in the interest of economy and efficiency because it is a logical follow-on to the original order that was competed and issued under the USAMRAA Teams contract and of which, all awardees were given a fair opportunity to be considered for the order.

9. Other Facts: This sole source contract is being implemented in order to keep the current services operational until the logical follow-on is awarded.

a. The acquisition package documents have been developed, but are continuing to be refined to ensure all interested offerors in a logical follow-on have a clear understanding of the work requirements and solicitation evaluation criteria.

b. Historical data. This contract was previously awarded to IBA Associate, Inc. IBA Associates, Inc.

c. Unusual and compelling urgency. This bridge contract is necessary to avoid a break in service; a break in service will cause delays in support to the project management; product oversight and support; configuration management support; and agile support services.

The interruption and possible change in vendor would cause a significant monetary loss to the government for transition work that would have to be ramped up and delays due to security mandates and Common Access Card (CAC) requirements.

10. Interested Sources: IBA Associate, Inc. IBA Associates, Inc.

11. Methods to overcome barriers: The agency is currently in process of soliciting for a follow-on contract under full and open competition after exclusion of sources, as a 100% small business set-aside. The anticipated award dated is October 17, 2017.
