Justification and Approval for Other than Full and Open Competition Sole Source Acquisition FAR Subpart 6.3 Other Than Full and Open Competition l . Identification of the agency and contracting activity: Defense Health Agency (DHA), Component Acquisition Executive (J4), Contract Operations -Falls Church (CO-FC), 7700 Arlington Blvd., Falls Church, VA 22042.

2. Nature and/or Description of Action being approved: Approval is being requested for an award of a sole source Firm Fixed Price (FFP) contract to support the existing level of effort. This sole source award does not provide for new work or a change in scope.

Approval is being requested for a contract to be awarded to Booz Allen Hamilton, Inc., to complete work that is currently being performed under contract number HT001 l -16-C-0004, for Office of the Deputy Assistant Secretary of Defense (ODASD), Wounded Warrior Care and Transition Policy (WWCTP), expiring on January 16, 2017. The contract will prevent a gap in necessary services and will provide the agency with sufficient time to complete the acquisition process for a new follow-on contract. The period of performance of this contract will be four (4) months, with two (2) one-month option periods, for a total of six potential months beginning on January 17, 2017 .

3. Description of Supplies/Services: The contractor shall provide administrative and operational support necessary to sustain the mission and functions of the organization.

Operational support includes general office management services such as supply management, distribution services, logistical support, analyst services such as Power Point and other presentation development , organizing and attending meetings and events and reporting minutes, preparing senior leaders for Congressional testimony and hearings, updating documentation, and the organization and management of critical documentation. The initial funded period of performance shall be a base period of four (4) months from January 17, 2017 thru May 16, 2017. The estimated price of the 4 month base period is REDACTED. The contract will also have two

(2) one month option period s, with an estimated price per month of REDACTED. The contract will also include the option to extend for an additional six months under FAR 52.217-8 (Option to Extend Services). The estimated price for a total six month period is REDACTED. The total estimated price, including the FAR 52.217-8 option to extend for an additional six months, is estimated to be REDACTED. FYI 7 Operations and Maintenance funds will be utilized for this Firm Fixed Price contract.

4. Statutory Authority Cited permitting other than full and open competition: The statutory authority permitting "other than full and open" competition for this acquisition is 10 U.S.C.2304(c) (1) as implemented by Federal Acquisition Regulation (FAR) and in accordance with FAR 6.302-1(a)(2)(iii)(B) -"Only One Responsible Source and No Other Supplies or Services Will Satisfy the Agency Requirements"; and services are deemed to be available only from the original source in the case of follow-on contracts for the continued provision of highly specialized services when it is likely that award to any other source would result in unacceptable delays in fulfilling the agency's requirements (10 U.S.C. 2304(d)(l)(B)).

5. Reason for Authority Cited: The incumbent, Booz Allen Hamilton, Inc., possesses the operational infrastructure and knowledge required for successful performance. The contractor can continue to provide the support required during this short duration transitional contract without a loss of efficiency and negative impact to the Warrior Care Program (WCP) support function. Only Booz Allen Hamilton, Inc. can start performance within this short period of time and prevent a gap in services. These services must continue uninterrupted in order to meet the needs of our wounded warriors.

Although there are other sources available that can meet the Government's requirements, none would have the infrastructure or expertise available to support a fully functional Warrior Care Program (WCP) without significant delays, lead-time, incurred costs, duplication of efforts and substantial investments of time and resources by the Government. This is a follow-on transitional contract funded for an initial four (4) months period, with two (2) one-month option periods and includes clause FAR 52.217-8 Option to Extend Services for an additional 6 months period. It is anticipated that the Government will receive two to four offers for the logical follow-on contract. The two one-month option periods may be utilized to provide lead time in the evaluation process; particularly if there is a higher than anticipated number of offers; and the FAR clause 52.217-8 may be utilized to provide lead time in awarding of the logical follow-on contract.

6. Efforts to Obtain Competition: Bids, proposals, or quotations have not been solicited from additional sources as prescribed by FAR 5.207(c)(l 5). A direct award will be made to the incumbent Booz Allen Hamilton, Inc. based on the expected short term of the contract and the authority of FAR 6.302-l(a)(2)(iii), the Government may make and award to the incumbent in the case of follow-on contracts. However, proposals will be solicited for the logical follow-on contract with an anticipated award date in REDACTED.

The proposed action will be synopsized in accordance with FAR 5.207, noting that pursuant to FAR 5. l 02(e) the Government only needs to provide copies of a solicitation issued under other than full and open competition to firms requesting copies that were not initially solicited, but only after advising the requester of the determination to limit the solicitation to a specified firm or firms as authorized under FAR 6.3.

Due to the limited amount of time between the J&A approval period and needed contract award date, an additional Request for Information (RFI) will not be posted. In accordance with the Defense Federal Acquisition Regulation (DFARS) Procedures, Guidance, and Instruction (POI) 206.302-l(d) the Contracting Officer has received a waiver, dated December 7, 2016, from the Head of Contracting Activity designee to not post the RFI.

7. Actions to Increase Competition: The current bridge contract (HT001l -16-C-0004) for these services will end January 16, 20 I 7. The Agency began preparations for a new contract competition in late 2015. This request for sole source contract is not due to the Agency 's lack of planning. WCP and the Contracting Officer have decided that the new contract wil l be competed using full and open competition after exclusion of sources, and will be a 100% small business set-aside in accordance with FAR 6.203. The award of a logical follow-on incurred unanticipated delays due to the refinement of acquisition documents.

8. Market Research: The Government conducted market research as a routine course of action in pursuit of a logical follow-on contract. Based on the current market research, CO-FC anticipates that the required level of competition shall be obtained by soliciting offers from potential sources. Research indicated that no existing vehicle is present that can meet this complex requirement. The sensitivity and complexity of the work coupled with the geographical challenges make this requirement challenging. Although there are other sources available that can meet the Government's requirements, none would have the infrastructure or expertise available to support a fully functional WCP without significant delays, lead-time, incurred costs, duplication of efforts and substantial investments of time and resources by the Government. Services would have to be fully operational on the period of performance start date, without a transition in period.

9. Other Facts: This sole source contract is being implemented in order to keep the current services operational until the logical follow-on is awarded.

a. The acquisition package documents have been developed, but are continuing to be refined to ensure all interested offerors in a logical follow-on have a clear understanding of the work requirements and solicitation evaluation criteria.

b. Historical data. This contract was previously awarded to Booz Allen Hamilton, Inc.

1. A Justification and Approval (Tracking # JA16-0012 (Award HTOO l l-16-C- 0004)) was approved on November 19, 2015, citing the authority of FAR 6.302- 1(a)(2)(iii)(B).

2. Justification # JA16-0012 was prepared to support the procurement before this contract. There have been significant changes to award the follow-on contract due to refining of the requirements. A Solicitation Review Board was held on December 5, 2016 for the follow-on contract.

c. Unusual and compelling urgency. This is a logical follow on contract necessary to avoid a break in service. A break in service will cause delays in support to wounded warriors that will have a severely negative cascading effect on the care and morale of wounded warriors and their families. Likewise, the interruption and possible change in vendor would cause a significant monetary loss to the government for transition work that would have to be ramped up and delays due to security mandates and CAC requirements.

10. Interested Sources: Booz Allen Hamilton, Inc.

11. Methods to overcome barriers: The agency is currently in process to solicit for a follow-on contract under full and open competition after exclusion of sources, as a 100% small business set-aside. The anticipated award dated is REDACTED.
